Resolution 21-38
A Resolution Approving a Conveyance of Certain Property to Elk River
Municipal Utilities
WHEREAS, the City of Elk River ("City") desires to convey the property legally described in
Exhibit A ("City Property") by quit claim deed to Elk River Municipal Utilities ("ERMU") in
connection with ERMU's platting of the property.together with property owned by ERMU for
continued use and development of .the platted property as a government facility;
WHEREAS, the Planning Commission has reviewed the proposed conveyance and has
detertnuied that it is consistent with the City's comprehensive plan;
WHEREAS, the City finds that the conveyance of the City Property is in the public's interest and
.furthers the aims and purposes of the City;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River,
Minnesota, as follows: The conveyance.of the City Property to ERMU is hereby approved and the
Mayor and City Clerk are hereby authorized to execute anddeliver all necessary documents required
to effectuate the conveyance.

EXHIBIT A
Legal Description of City Property
All that part of Lot 1, Block 2, Auditors Addition to the Village of Elk River, described as follows:
Commencing at the Northwest corner of said Block 2; thence Southeasterly along the North line of
Block, 90 feet; thence Southerly parallel with the East lines of Lots 1, 2, 3, & 4 of said Block 2 a distance
of 243 feet to the point of beginning; thence Easterly at right angles to said last described course 42 feet
to the East line of Lot 1; thence Southerly along said East line to the North line. of Depot Street; thence
Southwesterly and Northwesterly along the North line of Depot Street to the Southwest comer of Lot
1; thence Northeasterly along the West line of said Lot 1 to a point which is 232 feet Southwesterly from
the Northwest corner of Block 2; thence Southeasterly to the point of beginning.
