CITY OF ELK RIVER
AN ORDINANCE AMENDING SECTION 1000.00 OF THE CITY OF
ELK RIVER CODE OF ORDINANCES TITLED, "ADOPTION OF
STATE BUILDING CODE"
The City Council of the City of Elk River does hereby ordain as follows:
Section 1. Section 1000.00 of the Elk River Code of Ordinances is
amended to read as follows:

1. Those portions of the Minnesota State Building Code, as
amended, 1994 Edition, with Appendixes as set forth below are
hereby adopted as the Building Code of the City of Elk River as
follows:
A. 1300 Minnesota Building Code
B. 1301 Building Official Certification
C. 1302 State Building Construction Approvals
D. 1305 Adoption of the 1994 Uniform Building Code
including Appendix Chapters:
* 3,Division I,Detention and Correctional Facilities

Excavation and Grading
2. Enfo~eement. Enforcement of the Building Code shall
be as established by the Uniform Building Code, 1994 Edition. The
Building Code shall be enforced within the incorporated limits of
the city. The City Council shall designate the Building Official
for the City of Elk River.
3. Permits. Inspect:1,.on!ll. Fees and Surcharge
A. Permits. In~pections a~d Fees. Permits, inspections,
and collection of fees shall be as provided by the Uniform
Building Code, 1994 Edition. The Council shall establish
the fees and charges from time to time by resolution.
B. Surcharge. In addition to the required permit fee, the
applicant shall pay a surcharge to be remitted to the
Minnesota Department of Administration as prescribed by
Minnesota Statutes 1984, Section 16B.70.
4. Violations and Penalties. The violations of this section
shall be a misdemeanor. Each day that a condition in violation
of this section shall continue shall constitute a separate
offense.

Section 2. This ordinance shall be effective upon adoption and
publication, according to law.
Passed and adopted by the City Council of the City of Elk River, this
18th day of December, 1995.
