91-024 ORD tit ORDINANCE 91 - 24- AN ORDINANCE ESTABLISHING SECTION 906 - WILD AND SCENIC RIVER MANAGEMENT ORDINANCE The City Council .of the City of Elk River does ordain as follows: Section 1. That Section 906 of the City of Elk River Code of Ordinance titled, "Wild and Scenic River Management Ordinance" be established to read as follows: pectio~ 906 - Wild and Scenic River Management Ordinance 906.00 Purpose and A~thor~~~t~on The purpose of this Ordinance is to regulate development within the Mississippi Wild, Scenic, and Recreational River District, as required by Minnesota Statutes, Section 103F.301 to 103F.345. 906.02 - Scope and InterpretatiQ!l e 1. The provisions of this Ordinance shall apply to the entire area within the designated Recreational River Land Use District as described by the Management Plan for Parts of the Mississippi River; Minnesota Rules, parts 6105.0910 to 6105.0950. 2. The provisions of this Ordinance shall be interpreted to be mInImum requirements. The provisions of any other Ordinance, statute or rule which imposes greater restrictions or provisions not addressed by this Ordinance shall apply within the lands controlled by this Ordinance. 906.04 General Provisjons All applicable minimum standards set forth in Minnesota Rules, parts 6105.0800 6105.0960, especially parts 6105.0870, Subparts 6 & 8, are hereby adopted by reference and made a part hereof as fully as if set forth herein. Copies of the applicable regulations and rules shall be kept on file in the office of the City Administrator. 906.08 lls~~ The uses allowed within the Mississippi Recreational River District shall be those prescribed by the Zoning Ordinance of the City of Elk River and any other Ordinances controlling the use of land within these areas, except that marinas are prohibited. 906.10 - Sanitary Facilities -- 1. Publicly-owned sewer systems must be used where available. 2. exceed All private sewage treatment systems must the Minnesota Pollution Control meet or Agency's e e e "Individual Sewage Treatment Systems Standards, Chapter 7080", a copy of which is hereby adopted by reference and declared to be a part of this Ordinance, and any applicable local government standards. 3. Sanitary facilities and systems that do not meet the requirements of Chapter 7080 shall be considered nonconforming, and must be brought into compliance in accordance with Section 904.08(8) and Section 904.10(3) of the Elk River Code of Ordinances. 906.12 EQforcement an.d Administrati.on This ordinance shall be enforced and administered in accordance with Minnesota Rules, parts 6105.0010-6105.0070 and 6105.0210-6105.0250 and with the procedures and requirements of the Zoning Ordinance of the City of Elk River. pecj:j....Q1:L-.2...:...
