ORDINANCE 90 - 4
AN INTERIM ORDINANCE IMPOSING A MORATORIUM
ON THE DEVELOPMENT OF CERTAIN PROPERTY LOCATED
WITHIN THE CITY OF ELK RIVER
The City Council of the City of Elk River does ordain as
follows:
Section 1. Purpose. The City of Elk River is presently
conducting a planning study, identified as: "Area B Focused
Planning Study", for the purpose of considering adoption
and/or amendment of official controls, as defined in Minnesota
Sr.a.tutes, SE:c.l:ion 462.352, Subd. 15, including Chapters IX
(.the Zoning Ordinance) and X (Building and Land Development)
of the Elk River City Code. The official controls and
amendments will consider, among other things, appropriate land
uses and zoning districts for the property identified as
"Area B", as shown on Exhibit A to this Ordinance. However,
while new official controls and amendments are being
considered, proposals for development in Area B and certain
properties surrounding Area B continue to be made. Therefore,
in order to protect the planning process and the health,
safety and welfare of the citizens of the City of Elk Riv.er,
it is necessary and desirable to impose the following
moratorium pursuant to the authority granted by Minnesota
Statutes Section 462.355, Subd. 4.
Section 2. Moratorium. From the effective date of this
ordinance to and including September I, 1990, unless earlier
terminated by resolution of the Elk River City Council, the
City Council, Planning Commission, and the City of Elk River
staff shall not accept any applications for, or continue to
process or act on, any applications or requests for rezonings,
conditional use permits, variances, plats, administrative
subdivisions or other land use approvals within the area shown
on attached Exhibit A, generally described as the properties
located on both sides of State Highway 169 from the
intersection of Highway 169 and School Street on the south to
north of the intersection of IIighway 169 and Jackson Avenue on
the north.
Section 3. Effective Date. This ordinance shall be in
full force and effect upon its passage and publication.

PUBLIC HEARING
CITY OF ELK RIVER
The Elk River City Council will conduct a public hearing on
Monday, March 19, 1990, to be held at the Elk River Public
Library at 7:00 p.m., to consider an interim ordinance imposing
a moratorium on the development of certain property located
within the City of Elk River.
The property affected by this moratorium includes parts of
Sections 26, 27, 34 and 35, Township 33, Range 26, Sherburne
County, Minnesota. The specific areas affected are shown on
the included map.
All interested persons are invited to attend the public hearing
to express their questions and/or comments. If you would like
further information regarding this public hearing, please call
the Elk River City Hall at 441-7420.
