ORDINANCE 90 - 14
AN ORDINANCE AMENDING SECTION 1008.16 - EASEMENTS
SUB 1. - PROVIDED FOR UTILITIES
The City Council of the City of Elk River does ordain as
follows:
Se_ction 1. That Section 1008.16(1) of the Elk River
City Code of Ordinances titled, "Provided for Utilities" be
amended as follows:

Provided for Utilities. Easements at least twelve
(12) feet wide, centered on rear and other lot lines,
shall be provided for utili ties where necessary; if
appropriate, easements of lesser width may be allowed
by the City, particularly easements along front lot
lines. They shall have continuity of alignment from
block to block. No fences, other structures, or
plantings other than grass can be placed in a utility
easement where it will interfere with the maintenance
of said utilities as determined by the Building and
Zoning Administrator. If removal of a fence, other
structure, or planting is necessitated for
maintenance of utilities, the cost of removal and
replacement is the responsibility of the affected
property owner.
Section 2. That this Ordinance shall take effect and be
in full force from and after the date of its publication.
Passed and adopted this 18th day of June, 1990.
