AN ORDINANCE AMENDING THE CODE OF ORDINANCES
FOR THE CITY OF ELK RIVER
SECTION 605.08(3)
RELATING TO THE CITY LANDFILL FEE
Section 1. The Code of Ordinances for the City of Elk River,
Section 604.08(3) is amended to read as follows:

In addition to the application fee and annual license fees
required by Sections land 2 above, any operator of a
facility for the disposal of mixed municipal solid waste
located within the City of Elk River shall pay a volume-
based fee on a per cubic yard basis of waste or its
equivalent disposed of at the facility in an amount as
established by resolution of the City Council. The
revenue from this fee shall be credited to the City's
general fund. Pursuant to Minnesota Statutes Section
115A.921, revenue produced by $.25 per cubic yard of the
fee shall be used only for purposes of landfill abatement
or for purposes of mitigating and compensating the local
risks, costs and other adverse effects of such facilities.
Revenue produced by the balance of the fee may be used for
any general fund purpose. Solid waste facility operators
shall pay this fee on a monthly basis.
Section 2. This ordinance shall become effective upon
publication.
Passed and adopted by the Elk River City Council this 6th day
of August, 1990.
