89-007 ORD . . . ORDINANCE 89 - 7 AN ORDINANCE AMENDING SECTION 900.18(2) -ACCESSORY USE SETBACKS" The City Council of the City of Elk River does ordain as follows: Section 1. That Section 900.18 (2) "Accessory Use Setbacks", of the Elk River Code of Ordinances be amended to read as follows: (see attached) Section 2. (1) A maximum of one story is permitted. ~) (2) Accessory structures used for agricultural purposes or of metal construction/exteriors. shall be setback a minimum of 300 ft. from any neighboring residence or platted area, unless within a platted area a Conditional Use Permit for the accessory structure is granted which specifies different setback distances or conditions, in which case the Conditional Use requirements shall supercede the require- ments of this section. (3) Accessory structures used for agricultural purposes (with or without metal skin) shall also be set back a minimum of 300 ft. from any neighboring residence of platted area unless within a platted area, a Conditional Use Permit for the accessory structure is granted which specifies different setback distances or conditions, in which case the Conditional Use regulation shall supercede the requirement of this section. (4) The keeping of livestock (fences) is prohibited within 200 feet of an adjacent dwelling. (5) Accessory structure, interior side and rear setback requirements may be reduced to ten (10) feet in the C-l, C- 2, C-3, I-I, I-2, and Commercial and Industrial Districts. ~ (6) Swimming pools shall be set back a minimum of eight (8) feet from the side yard and rear yard lot lines and must comply with the required front yard setback as per Section 900.18.
