AN ORDINANCE AMENDING THE CODE OF ORDINANCES
FOR THE CITY OF ELK RIVER
SECTION 1406
TO RESTATE THE BENEFIT RATIO AND TO
EXCLUDE CERTAIN COMMERCIAL AND INDUSTRIAL LANDS
FROM THE RURAL SERVICE DIS~RICT AND INCLUDE SUCH LANDS
IN THE URBAN SERVICE DISTRICT
The City Council of the City of Elk River does ordain as
follows:
Section 1. The Code of Ordinances for the City of Elk
River, is amended to restate Section 1406.00 and to create a
new Section 1406.02, each section to read as follows:
Section 1406 - Rural/Urban Service Districts

1406.00 - Amendment of Benefit Ratio. The benefit ratio as
defined in Minnesota Statutes, Section 272.67, and
established as 0.25 in Section 7 of the State of Minnesota
Municipal Board Order regarding the consolidation of the
Town of Elk River and the City of Elk River, dated
October 31, 1977, is hereby amended to a ratio of 0.6.

1406.02 - Rural and Urban Service Districts. The Rural
Service District established by the State of Minnesota
Municipal Board order, dated October 31, 1977, may be and
has been changed from time to time by City Council action
to exclude lands from the Rural Service District pursuant
to Minnesota Statutes, Section 272.67. The Urban Service
District shall include all lands within the boundaries of
the City of Elk River which are not included in the Rural
Service District.
Section 2. Commercial and Industrial lands identified in
Exhibit A hereto are hereby excluded from the Rural Service
District and are included in the Urban Service District.
Section 3. This ordinance shall become effective upon
filing a certified copy of the ordinance with the County
Auditor.

NOTICE OF PUBLIC HEARING
The Elk River City Council will conduct a public hearing on
September 11, 1989, at 7:00 o'clock p.m., at the Elk River City
Hall, to consider a request for an ordinance amendment to amend
Section 1406 of the Elk River Code of Ordinances titled "Rura1/
Urban Service Districts" initiated by the City of Elk River.
Approval of the request would include the commercial and
industrial lands into the Urban Tax District that are currently
in the Rural Tax District.

Re: Changes in Urban/Rural Tax Districts
On September 11, 1989, the Elk River City Council approved an
ordinance which would remove all the Commercial and Industrial
businesses from the rural service distirct and place them in the
urban service district. Attached to this letter is a list of
the businesses affected, which should be considered in the urban
district for taxes payable in 1990. A copy of the ordinance
amendment which accomplish this is also attached. Any new
Commerical and Industrial operations or Commercial and
Industrial operations that were missed on this list should be
included in the urban service district.
