ORDINANCE 89-18 AN ORDINANCE AMENDING THE CODE OF ORDINANCES FOR THE CITY OF ELK RIVER SECTION 802.02(3) TO ALLOW THE SALE OF INTOXICATING MALT LIQUOR AT ON SALE The City Council of the City of Elk River does ordain as follows: Section 1. The Code of Ordinances for the City of Elk River, Section 802.02(3) is amended to read as follows: 3. On-Sale Wine Licenses. On-sale wine licenses shall be issued only to restaurants meeting the qualifications of Minnesota Statutes, Section 340A.404, Subd. 5, and shall permit only the sale of wine not exceeding fourteen percent (14%) alcohol by volume for consumption on the licensed premises only, in conjunction with the sale of food. The sale of intoxicating malt liquor at on-sale shall be allowed to any restaurant establishment which is also licensed to sell wine and nonintoxicating malt liquors at on-sale pursuant to Section 340A. 411 of the Minnesota State Statutes, and whose gross receipts are at least 60 percent attributable to the sale of food. If these qualifications are met, no additional license shall be required to sell intoxicating malt liquor at on sale. Section 2. This ordinance shall take effect and be in full force from and after the day of its publication. Passed and adopted by the Elk River City Council, this 6th day of November, 1989.
