ORDINANCE 89 - 21
AN ORDINANCE AMENDING THE CITY OF ELK RIVER ZONING MAP TO ZONE
CERTAIN PROPERTY FROM PUD (PLANNED UNIT DEVELOPMENT) TO
C-3/HIWAY COMMERCIAL AND
R-2B (TOWNHOUSE, MULTIFAMILY/RESIDENTIAL)
The City Council of the City of Elk River does ordain as follows:
Section 1. The duly adopted Zoning Map of the City of Elk River is
hereby amended to zone the property described as:
.
That part of the Southeast Quarter of the Northeast Quarter of Section
34, Township 33, Range 26, Sherburne County, Minnesota described as
commencing at the intersection of the South line of said Southeast
Quarter of the Northeast Quarter with said Easterly line of the
right-of-way of U.S. Highway No. 169; thence Northwesterly along said
right-of-way 176.46 feet; thence Northeasterly at right angles 210.00
feet to the point to be hereafter known as Point "A" for the purposes of
this description; thence Southeasterly parallel with said right-of way
to intersect said South line of the Southeast Quarter of the Northeast
Quarter, said point of intersection being the actual point of beginning
of the land to be hereby described; thence return Northwesterly along
said parallel line to said Point "A"; thence Northeasterly at right
angles 80.00 feet; thence Northwesterly parallel with said right-of-way
to intersect the North line of the South 417.42 feet of said Southeast
Quarter of the Northeast Quarter: thence east along said North line of
the South 417.42 feet a distance of 465.28 feet; thence South at right
angles 417.42 to said South line of the Southeast Quarter of the
Northeast Quarter; thence West along said South line to the point of
beginning.
The eastern 140 ft. of the parcel described in exhibit "A" as measured at
right angles from the western right-of-way of Auburn Place as dedicated on
the duly recorded plat of Barrington Place from PUD to R-2B; and the parcel
described in exhibit "A" except for the eastern 140 ft. thereof from PUD TO
C-3.
Section 2. That this Ordinance shall take effect and be in full
force from and after the date of its publication.
