ORDINANCE 88 - 21 AN ORDINANCE AMENDING THE CODE OF ORDINANCES FOR THE CITY OF ELK RIVER SECTION 604.08(3} TO INCREASE THE CITY LANDFILL FEE The City Council of the City of Elk River does ordain as f llows: Section 1. The Code of Ordinances for the City of Elk Rver, Section 604.83(3} is amended to read as follows: 3. In addition to the application fee and annual license fees required by Sections 1 and 2 above, any operator of a facility for the disposal of mixed municipal solid waste located within the City of Elk River shall pay a fee of $.35 per cubic yard of waste or its equivalent disposed of at the facility. The revenue from this fee shall be credited to the City's general fund. Revenue produced by $.25 of the fee shall be used only for pruposes of landfill abatement or for purposes of mitigating and compensating the local risks, costs and other adverse effects of such facilities. Revenue produced by $.10 of the fee may be used for any general fund purpose. Solid waste facility operators shall pay this fee on a monthly basis. Section 2. This ordinance shall become effective on the f rst day of August, 1988.
