83-003 ORD CITY OF ELK RIVER ORDINANCE 83-3 WHEREAS, the City Council has deemed it desirable to create an Economic Develop- ment Commission. NOW, THEREFORE, be it enacted by the City of Elk River: Section 215 - Economic Development Commission Section 215.00 - Composition of Commission. The Economic Development Com- mission shall be composed of 20 members. The Commission may appoint ad- ditional non-voting members as necessary. Section 215.02 - Organization. The members of the Economic Development Com- mission by a majority vote shall elect one of the members at the first meeting of the year to serve as chairman and another member to serve as secretary, with duties in addition to the commission membership as implied by these titles. The chairman shall be responsible for presiding at the meetings and shall be entitled to an equal vote with the members. Other officers may be elected as deemed necessary. Rules of procedure may also be adopted, which shall con- form to the provisions of the City Code and resolutions adopted by the City Council. Section 215.04 - Meetings. At the annual organizational meeting, the committee shall designate the time and place of its regular meetings, which shall not be less than quarterly. Special meetings may be called by the chairman or by any five (5) members of the committee by giving written notice to all members of the commission 48 hours prior to the time of the meeting. All meetings shall be open to the public and shall be held at the City Hall or other public or semi-public facility. The City Council reserves the right to adopt, by resolu- tion, additional rules for the operations of the commission. Section 215.06 - Annual Work Program. The Economic Development Commission shall prepare an annual work program with a detailed budget which shall be submitted to the City Council for approval on or before September 1st of the year prior to commencement. Any major deviation from the approved work program during the year shall be approved in advance by the City Council. Section 215.08 - Political Issues. The commission shall not advocate any position on an issue in any election without prior approval of the City Council. Section 215.10 - Compensation. Members of the commission shall not be entitled to compensation for serving in such city, but may, at the Council's discretion, be reimbursed for such out-of-pocket expenses as they incur which directly re- late to their position. Section 215.12 - Functions. The functions of the Economic Development Commission shall be as follows: Ordinance 83-3 Page Two a) To work on achieving and maintaining Star City recognition for the City of Elk River. b) To promote Elk River by rpojecting an image of a community with a high quality of life that provides for an excellent environment for raising a family and where community pride encourages industrial and commercial estab- lishments. c) To bring about balanced economic development by the locations of industrial and commercial concerns in the City of Elk River. d) To promote and give priority to the development of that industrial and commercial land already served with utilities and bearing substantial assessments. e) To attract a broad spectrum of job opportunities. f) To strengthen the City's existing industrial and commercial enterprises. g) To consider general policy direction and to advise the City Council on matters pertaining to industry and commerce. (2) Said newspaper is a weekly and is distributed at least once each week. (3) Said newspaper has 50 per. cent of its news columns devoted to news of local interest to the community which it purports to serve and does not wholly duplicate any other publication and is not made up entirely of patents, plate matter and advertisements. (4) Said newspaper is circulated in and near the municipality which it purports to serve, has at least 500 copies regularly delivered to paying subscribers, has an avera~ of at least 75 percent of its total circulation currently paid or no more than three mono ths in arrears and has entry as second-class matter in its local post office. (5) Said newspaper pur- ports to serve the City of Elk River in the County of Sherburne and it has its known office of issue in the City of Elk River in said county, established and open during its regular business hours for the gathering of news, sale of advertisements and sale of subscriptions and maintained by the managing officer of said newspaper or persons in its employ and subject to his direction and control during all such regular business hours and devoted exclusively during such regular business hours to the business of the newspaper and business related thereto. (6) Said newspaper files a copy of each issue immediately with the State Historical Society. (7) Said newspaper is made available at single or subscription prices to any person, corporation, partnership or other unincorporated association requesting the newspaper and making the applicable payment. (8) Said newspaper has complied with all the foregoing conditions for at least one year preceding the day or dates of publication mentioned below. (9) Said newspaper has filed with the Secretary of State of Minnesota prior to January 1, 1966 and each January 1 thereafter an affidavit in the form prescribed by the Secretary and signed by the managing officer of said newspaper and sworn to before a notary public stating that the newspaper is a legal newspaper.
