83-014 ORD ORDINANCE 83-14 AN ORDINANCE AMENDING SECTION 1300.04 - PRIVATE SEWAGE DISPOSAL, OF THE CITY CODE OF ORDINANCES BY ADDING CERTAIN MINIMUM STANDARDS The City Council of the City of Elk River does ordain as follows: Section 1. That Section 1300.04, titled "Private Sewage Disposal" of the City Code of Ordinances be amended to read as follows: Where a public sanitary or combined sewer is not available under the provlslons of this ordinance, the building sewer shall be connected to a private sewage disposal system which complies with the provisions of the Minnesota Pollution Control Agency Individual Sewage Treatment Standards (6MCAR Section 4.8040 . hereinafter and heretofore referred to as WPC40) which standards are hereby adopted by reference and made a part hereof as fully as though set forth herein in full, three copies of which are filed with the City Clerk. In addition thereto, the following appendices to WPC40 are hereby adopted by reference and made a part hereof as fully as though set forth in full, three copies of each being on file with the City Clerk. (a.) Appendix A - Alternative Systems (b.) Appendix B - Figures (c.) Appendix C - Building Sewer (d.) Appendix D - Water Supply Setbacks (e.) Appendix E - Surface Water Setbacks Alternatively, in the sole descretion of the City and based upon such relevant factors including but not limited to soil type, topography and proximity to water bodies, a private sewage disposal system shall comply with the follow- ing minimum requirements and standards: (a.) 600 square feet of drainfield plus a 1,200 gallon tank, or (b.) 200 lineal feet of trenching equivalent to 600 square feet (at least two (2) trenches plus a 1,200 gallon tank. Section 2. That this Ordinance shall take effect and be in full force from and after the date of its publication. Passed and adopted this 17th day of October , 1983.
