ORDINANCE 83-16
AN ORIDNANCE AMENDING THE CITY OF ELK RIVER ZONING ORDINANCE RELATING TO THE
ESTABLISHMENT OF ZONING DISTRICTS WITHIN THE CITY OF ELK RIVER
The City Council of the City of Elk River does ordain as follows:
Section 1. That Section 900.10 of the City of Elk River Zoning Ordinance
is amended by amending and adding the following zoning districts:
1. C-3A Highway Commercial District
C-3B Highway Commercial District
Section 2. That Section 900.12, Subsection 9, of the City of Elk River Zoning
Ordinance is amended as follows:
9A. C-3A Highway Commercial District.
a. Motor vehicle service stations.
b. New car, implement and marine sales.
c. Auto repair shops.
d. Business and professional offices.
e. Enclosed storage and warehousing.
f. Public garages.
g. Drive-in theaters.
h. Broadcasting studios and facilities.
i. Convenience stores.
j. Indoor and outdoor amusement and recreation centers.
k. Liquor stores.
1. Truck terminal.
9B. C-3B Highway Commercial District.
a. Nursey
b. Business offices
c. Veterinary clinics
d. Convenience stores

Section 3. That Section 900.14, Subsection 5, of the City of Elk River Zoning
Ordinance is amended as follows:
5. C-l, C-2, C-3A and C-3B Commercial Districts.
Section 4. That Section 900.16 - Conditional Uses, Subsection 6, of the City of
Elk River Zoning Ordinance is amended as follows:

All dimensional regulations are to remain as listed for C-3 Highway Commercial
Section 6. That this Ordinance shall take effect and be in full force from
and after the date of its pbulication.

AFFIDAVIT OF PUBLICATION

~ ~~, being duly sworn, on oath says he/she is and
during all the times herein stated has been the ~ ~ publisher and printer
of the newspaper known as the Elk River Star News and has full knowledge of the facts herein
stated as follows: (1) Said newspaper is printed in the English language in newspaper format and
in column and sheet form equivalent in printed space to at least 900 square inches. (2) Said
newspaper is a weekly and is distributed at least once each week. (3) Said newspaper has 50 per-
cent of its news columns devoted to news of local interest to the community which it purports to
serve and does not wholly duplicate any other publication and is not made up entirely of patents,
plate matter and advertisements. (4) Said newspaper is circulated in and near the municIpality
which it purports to serve, has at least 500 copies regularly delivered to paying subscribers, has
an average of at least 75 percent of its total circulation currently paid or no more than three mon-
ths in arrears and has entry as second-class matter in its local post office. (5) Said newspaper pur-
ports to serve the City of Elk River in the County of Sherburne and it has its known office of
issue in the City of Elk River in said county, established and open during its regular business
hours for the gathering of news, sale of advertisements and sale of subscriptions and maintained
by the managing officer of said newspaper or persons in its employ and subject to his direction
and control during all such regular business hours and devoted exclusively during such regular
business hours to the business of the newspaper and business related thereto. (6) Said newspaper
files a copy of each issue immediately with the State Historical Society. (7) Said newspaper is
made available at single or subscription prices to any person, corporation, partnership or other
unincorporated association requesting the newspaper and making the applicable payment. (8)
Said newspaper has complied with all the foregoing conditions for at least one year preceding the
day or dates of publication mentioned below. (9) Said newspaper has filed with the Secretary of
State of Minnesota prior to January I, 1966 and each January 1 thereafter an affidavit in the
form prescribed by the Secretary and signed by the managing officer of said newspaper and
sworn to before a notary public stating that the newspaper is a legal newspaper.
