84-001 ORD ORDINANCE 84-1 The City Council of the City of Elk River does ordain as follows: Section 1. That Section 102.06 of the City of Elk River Code of Ordinances titled, "City Administrator" be amended to read as follows: 102.06 - City Administrator. chief administrative and responsibilities The word "City Administrator" shall mean the City's official appointed by the City Council with duties per Section 202.02 of this Code. Section 2. That Section 200.04 of the City of Elk River Code of Ordinances titled, "Minutes", Sub. 1 - Minutes Recorded, and Sub. 2 - Approval, be amended to read as follows: 200.04 - Minutes. 1. Minutes Recorded. Minutes of each Council meeting shall be kept by the City Clerk, or the City Clerk's designee. In the absence of both, the presiding officer shall appoint a secretary pro tem. Ordinances, resolutions, and claims need not be recorded in full in the minutes if they appear in other permanent records of the City Clerk and can be accurately identified from the description given in the minutes. 2. Approval. The minutes of each meeting shall be reduced to type- written form, shall be signed by the City Clerk, and copies thereof shall be delivered to each Council member as soon as practicable after the meeting. At the next regular Council meeting following such delivery, approval of the minutes shall be considered by the Council. The minutes need no.t be read aloud, but the presiding officer shall call for any ad- ditions or corrections. If there is no objection to a proposed addition or correction, it may be made without a vote of the Council. If there is an objection, the Council shall vote upon the addition or correction. If there are no additions or corrections, the minutes shall stand approved. Section 3. That Section 200.10 of the City of Elk River Code of Ordinances titled, "Ordinances, Resolutions, Motions, Petitions and Communications, Sub. 2 - Signing and Publication Proof, be amended to read as follows: 200.10 - Ordinances, Resolutions, Motions, Petitions and Communications. ( 2. Signing and Publication Proof. Every ordinance and resolution passed by the Council shall be signed by the Mayor, attested by the City Clerk, and filed by the City Clerk in the ordinance or resolution book. Proof of publication of every ordinance shall be attached and filed with the ordinance. Section 4. That Section 202.02 of the City of Elk River Code of Ordinances titled, "City Administrator" Sub. 2 - General Duties, be amended to read as follows: Ordinance 84-1 Page Two 200.02 - City Administrator. 2. General Duties. The City Administrator shall act as the chief ad- ministrative official of the City, and be responsible for the proper ad- ministration and coordination of all the affairs of the City and for the fair and impartial provision of city services, consistent with City Council policy and direction. He shall supervise and direct the various city departments and otherwise be responsible for the implementation of Council directives and policies. The Administrator may be responsible for other duties as prescribed by the Council by resolution or job description. Section 5. That this Ordinance shall take effect and be in full force from and after the date of its publication. Passed and adopted this 16th day of January, 1984. (4) Said newspaper is circulated in and near the municIpality which it purports to serve, has at least 500 copies regularly delivered to paying subscribers, has an average of at least 75 percent of its total circulation currently paid or no more than three mon- ths in arrears and has entry as second-class matter in its local post office. (5) Said newspaper pur- ports to serve the City of Elk River in the County of Sherburne and it has its known office of issue in the City of Elk River in said county, established and open during its regular business hours for the gathering of news, sale of advertisements and sale of subscriptions and maintained by the managing officer of said newspaper or persons in its employ and subject to his direction and control during all such regular business hours and devoted exclusively during such regular business hours to the business of the newspaper and business related thereto. (6) Said newspaper files a copy of each issue immediately with the State Historical Society. (7) Said newspaper is made available at single or subscription prices to any person, corporation, partnership or other unincorporated association requesting the newspaper and making the applicable payment. (8) Said newspaper has complied with all the foregoing conditions for at least one year preceding the day or dates of publication mentioned below. (9) Said newspaper has filed with the Secretary of State of Minnesota prior to January 1. 1966 and each January 1 thereafter an affidavit in the form prescribed by the Secretary and signed by the managing officer of said newspaper and sworn to before a notary public stating that the newspaper is a legal newspaper.
