I. Call Meeting to Order
Pursuant to due call and notice thereof, the meeting of the Elk River Planning
Commission was called to order at 6:51 p.m. by Chair Larson-Vito.
2. Consider July 27, 2021, Planning Commission Agenda
Moved by Commissioner Beise and seconded by Commissioner Jordan to
approve the July 27, 2021, Planning Commission agenda.
Motion carried 6-0.
3. Consider June 22, 2021, Planning Commission Minutes
Moved by Commissioner Beise and seconded by Commissioner Johnson to
approve the June 22, 2021, Planning Commission minutes.
Motion carried 6-0.
4.1 Roger Derrick representing Tall Pines 2 — 18409 Line Ave. NW

Mr. Carlton presented the staff report.

Commissioner Johnson asked if there were any concerns with the intersection of
Main and Line being obstructed,is there proper access for emergency services being
the road is one way in, one way out.
Mr. Carlton stated when police and fire staff review the submitted plans, there were
no additional concerns brought up regarding accessibility or access issues besides
Appendix D of the fire apparatus code for truck accessibility.
Commissioner Jordan asked if the street would be public or private.
Mr. Carlton stated it was a private street, 28'wide.
Chair Larson-Vito opened the public hearing.
There being no one to speak, Chair Larson-Vito closed the public hearing.
Commissioner Johnson stated he felt the proposed townhomes and setting was a
good contrast between the townhomes located to the north.
Moved by Commissioner Johnson and seconded by Commissioner Beise to
recommend approval of the request by Roger Derrick representing Tall Pines
2 LLC for a Zone Change from Business Park (BP) to Planned Unit
Development (P.U.D.),with the following condition:
1. A PUD agreement be approved by the City Council prior to recording
the Zone Change.
Motion carried 6-0.
Moved by Commissioner Johnson and seconded by Commissioner Keisling to
recommend approval of the request by Tall Pines 2 LLC for a Conditional Use
Permit Establishing a PUD,with the following conditions:
1. A PUD Agreement shall be developed and signed by both parties prior
to issuance of a building permit.
2. Streets and access must comply with MN State Fire Code Chapter 5
and Appendix D.
3. Provide detail connections to sewer and water systems and ensure the
watermain is looped.
4. Staff approval of all site, utility, engineering, and landscaping plans.
5. Hydrants must be spaced to ensure all portions of a residence are
within 250 feet of a hydrant.
6. DNR approval of all wetland permits related to the proposed wetland
fill.
7. A homeowner's association must be established, subject to review and
approval of the city attorney, and shall be responsible for all,
landscaping, snow clearing, and regular maintenance of private drives
and driveways.

10. Provide a trail connection from the end of the private cul-de-sac to the
trail along the west side of Twin Lakes Road or to the development to
the north.
11. No more than two of the same facade design/details shall be adjacent
to one another.
12. Mailboxes shall be clustered and located on the private street.
13. Construct a sidewalk from the south side of the entrance to Tall Pines
PUD second addition to the south side of this project area.
Motion carried 6-0.
Moved by Commissioner Johnson and seconded by Commissioner Beise to
recommend approval of the request by Tall Pines 2 LLC for the Preliminary
Plat of Tall Pines Third Addition P.U.D. on the condition that the Council
approves the related Zone Change (ZC 21-03) and Conditional Use Permit
(CU 21-08).
Motion carried 6-0.
6. General Business
Mr. Carlton reported Commissioner Alexander Feinstein submitted his resignation
from the Planning Commission effective today. Mr. Carlton stated they have a
resident who had previously submitted his application to serve on the Planning
Commission and will discuss appointment with him if he is still interested.
Mr. Carlton stated the Comprehensive Plan final draft will be available late this week
or early next week. He stated he will email it to the commission when it becomes
available and will post the draft on the city's website. An open house will be held
Monday,August 23 from 4-7 p.m. to allow comments and questions from the public.
He indicated a public hearing will be scheduled for the August 24 Planning
Commission meeting to take public comment. Additional opportunities for feedback
will be offered at a tent at the downtown farmers market and he was looking for
members of the CPAC group to cover shifts at the tent to field questions. The draft
will then be brought to the City Council for a public hearing at the September 20
meeting.
6. Council Liaison Update
Councilmember Beyer provided an update to the Planning Commission about recent
city council activities.
