ELK RIVER TOWN BOARD MEETING
January 28, 1896
The Board of Supervisors met at the Town Clerk’s office at 10 o’clock A.M. pursuant to
adjournment. Full Board present. This being the time and place set for the hearing on the road
petitions signed by F.W. Nickerson, W.G. Babcock, John Blocher, and Henry Castle and others for
four new roads.
The road petition signed by F.W. Nickerson and others for a new road beginning at a point on the
south line of section 15, Township 33, Range 26 which point is 7 chains east from the quarter
section post in the south line of said section (15) and running in a easterly and northeasterly
direction as described in said petition and it appearing to the Board by the affidavit of John Blocher
that he had served copies of the notice of hearing upon each of the occupants of the land through
which the road may pass, at least ten days prior to this meeting, and it further appearing to the
Board by affidavit of Andrew Davis that he had posted copies of the notice of hearing at least ten
days prior, hereto, in three public places in said town.
The Board proceeded to listen to arguments for and against the laying out of roads. They having
personally viewed and examined the proposed routes of the same.
Wm. Wruck owning the S.E. ¼ of N.W. ¼ Sec. 13 Township 33, Range 26 appeared and asked that
damages to the amount of $5.00 be allowed him in consequence of the laying out of said road. On
motion damages to the said amount of $5.00 were allowed said Wm. Wruck.
No one appearing further to offer objections to the laying out of said road and it appearing to the
Board to be necessary and proper that the same should be laid out, located and established, on
motion it was voted that the prayer of the petitioners be granted and that a public road four in width
be laid out, located and established accordingly. A survey was ordered made by J.H. Williams,
surveyor. It being also the time and place set for the hearing on the road petition signed by Henry
Castle and others for a new road beginning at a point 2 rods south from a point on the south line of
section (23), Township 33, Range 26 and 21 74/100 chains west from the south east corner of said
section 23 and from said first named point running westerly as described in said petition.
And it appearing of the Board by affidavit of W.L. Babcock that he had served copies of the notice
of hearing upon each of the occupants of the land through which the said road may pass at least ten
days prior to this meeting and it further appearing to the Board by affidavit of Andrew Davis that he
had posted copies of the Notice of hearing in three public places in said town at least ten days prior
hereto.
No one appearing to offer objections to the laying out of said road and it appearing to the Board to
be necessary and proper that the same should be laid out, located and established.
On motion it was voted that the prayer of the petitioners be granted and a public road four rods in
width be laid out, located and established accordingly. A survey was ordered made by J.H. Williams,
surveyor.
And it being also the time and place set for the hearing on the road petition signed by W.L. Babcock
and others for a new road beginning at the north east corner of the south east quarter of section 16,
Township 33, Range 26, and running thence westerly and northwesterly on the most practicable
route for a road as described in said petition.
And it appearing to the Board by affidavit of W.L. Babcock that he had served copies of the notice
of hearing upon each of the occupants of the land through which said road may pass at least ten
days prior to this meting and it further appearing to the Board by affidavit of Andrew Davis that he
had posted copies of the Notice of hearing in three public places, in said town, at least ten days
hereto.
No one appearing to offer objections to the laying out of said road and it appearing to the board to
be necessary and for the public’s interest that the same should be laid out, located and established.
On motion it was voted that the prayer of the petitioners be granted and a public road four rods in
width by laid out, located and established accordingly. A survey was ordered made by J.H. Williams,
surveyor.
And it being the time and place set of the earing on the road petition signed by John Blocher and
others for a new road. Beginning at station 5 in the Town Road (known as the Cameron Road)
which runs from Elk River Village to the northeast corner of section 25, Township 33, Range 26 as
the same is on file and of record in the office of the Town Clerk of the Town of El River and
running from said station 5 northerly and northwesterly as described in said road petition.
And it appearing to the Board by affidavit of John Blocher that he had served copies of the notice of
hearing upon each of the occupants of the land through which the road may pass at least ten days
prior to this meeting and it further appearing by affidavit of Andrew Davis that he had posted
copies of the notice of hearing in three public places of said town at least ten days prior hereto. No
one appearing to offer objections to the laying out of said road and it appearing to the Board to be
necessary and property that the same should be laid out, located and established.
On motion it was voted that the prayer of the petitioners be granted and a public road four rods in
width by laid out, located and established accordingly. A survey was ordered made by J.H. Williams,
Surveyor. Road orders were made out according to law and signed by the Board.
