The general purpose and intent of the ordinance are not met. j- 2. The proposed use is not reasonable. 3. The plight of the petitioner is not due to circumstances unique to the property and are a consequence of the petitioner's own CR 33 action. Background/Discussion • x Case No.V 21-04 RR - The subject property is zoned R1c—Single Family Residential and is Hwy 10 0.8 acres in size,which allows 1,200 square feet (SF) of attached and _ CR 12 detached accessory structures. The property currently has a 728 SF attached garage and a 120 SF detached shed for a total of 848 SF of existing accessory structures. The applicant is proposing to add 515 SF to the attached garage, yw� creating a total of 1,363 SF of accessory structures, 163 SF over the allowed amount for a property of this size in this zoning district. The applicant is requesting a variance to exceed the allowable accessory Figure I structure size by 165 SF. Applicable Regulation Variances may be granted when the petitioner establishes that the variance satisfies all five of the criteria described below. 1. Is in harmony n,,ith the general purpose and intent of the ordinance, and The general purpose and intent are limit the amount of impervious roof coverage on a property, especially within the urban service district where lots are smaller in nature. Increasing the allowed size by approximately 13%is not in harmony with the general purpose and intent of the ordinance. The property is guided Urban Residential,which primarily focuses on residential uses that will be served by the municipal sanitary sewer system. Residential uses allow for accessory structures. The request is consistent with the comprehensive plan. Variances may be granted when the petitioner establishes that there are practical difficulties in complying with the zoning ordinance. Practical difficulties means that: 3. The petitioner proposes to use the property in a reasonable manner not permitted by the Zoning ordinance; While having accessory structures is reasonable and allowed, exceeding the allowed size by 165 SF (-13%) is not reasonable. 4. The plight of the petitioner is due to circumstances unique to the property not a consequence of the petition's onm action or inaction;and There is no plight unique to the property as the applicant is requesting a variance to increase the amount of accessory structure space for personal reasons. 5. The variance, ifgranted, will not alter the essential character of the locality. If granted,the essential charact of the locale will not be altered.
