ORDINANCE 87-20

AN ORDINANCE ADOPTING THE 1985 MINNESOTA STATE
BUILDING CODE: AND AMENDING SECTION 1000.00
OF THE ELK RIVER CITY CODE OF ORDINANCES
The City Council of the City of Elk River ordains as
follows:
Section 1. That Section 1000.00 of the City of Elk River
Code of Ordinances Titled "Adoption of State Building Code" be
amended to read as follows:
A. Those portions of the Minnesota State Building Code, as
amended, 1985 Edition, with Appendixes as set forth below are
hereby adopted as the Building Code of the City of Elk River as
follows:
1. Minnesota Rules, Part 1300 - Code Administration
2. Minnesota Rules, Part 1305 - 1985 Uniform Building
Code and Uniform Building Code Appendix Chapter 35
3. Minnesota Rules, Part 1315 - National Electrical Code
(1984)
4. Minnesota Rules, Part 1320 - Elevators & Related
. Machines
5. Minnesota Rules, Part 1325 - Solar Energy Systems
6. Minnesota Rules, Part 1330 - Fall Out Shelters
7. Minnesota Rules, Part 1335 - Flood Proofing
8. Minnesota Rules, Part 1340 - Facilities for the
Handicapped
9. Minnesota Rules, Part 1345 - Minnesota Heating,
Ventilation, Air Conditioning and Refrigeration Code
10. Minnesota Rules, Part 1350 - Manufactured Homes
11. Minnesota Rules, Part 1355 - Plumbing
12. Minnesota Rules, Part 1360 - Prefabricated Structures
13. Minnesota Rules, Part 1365 - Appendix on Snow Loads
14. Minnesota Rules, Part 4215 - Model Energy Code and
Amendments
and are incorporated herein by this reference as if fully set
forth, three (3) copies of which are on file in the office of
the City Administrator.
B. Organization and Enforcement. The organization of the
Building Department and Enforcement of the Building Code shall
be as established by Chapter 2 of the Uniform Building Code,
1985 Edition.

limits of the City and extraterritorial limits two miles

distant from any point on the City limits as authorized by
Minnesota Statutes, 16B.62, Subd. 1.
The Building and Zoning Department shall be the Building, Code
Department of the City of Elk River. The Administrative
Authority shall be a State Certified "Building Official."
The City Council shall designate the Building Official for the
City of Elk River.
C. Permits, Inspections, Fees and Surcharge.
1. Permits, Inspections and Fees. Permits, inspections
and collection of fees shall be as provided in Chapter
3 of the Uniform Building Code, 1985 Edition. The
Council shall establish the fees and charges from time
to time by resolution.
2. Surcharge. In addition to the required permit fee,
the applicant shall pay a surcharge to be remitted to
the Minnesota Department of Administrator as
prescribed by Minnesota Statutes 1984, Section 16B.70.
D. Violations and Penalties. The violation of this section
shall be a misdemeanor. Each day that a condition in violation
of this section shall continue shall constitute a separate
offense.
Section 2. This ordinance shall take effect and be in full
force from and after the date of its publication.
Passed and adopted by the Elk River City Council this 20th day
of April, 1987.
