Zack Carlton, Planning Manager Simple Plat: Briarwood Farm Reviewed by Cal Portner, City Administrator Action Requested Adopt, by motion, a resolution for the final plat of Briarwood Farm with the conditions that Park Dedication shall be paid for two dwelling units at the rate applicable when the subdivision is released for recording. Background/Discussion Case Number P 21-12 The subject property is 25 acres in size, zoned R1a and located north of 213th Avenue just east of Kennedy Street (10113 213th Ave). The proposed plat consists of three lots and dedicates right-of-way. Lot 2, Block 1 will contain the existing house and the remaining two lots will be new developable lots, which are eligible for park dedication. While most of the northern portion of the subject parcel is encumbered by wetlands, there is sufficient buildable property to support the proposed plat. Parks and Recreation The Parks and Recreation Commission recommended Park Dedication be paid for the final number of dwelling units at final plat approval at the rate applicable when the subdivision is released for recording. Applicable Regulations City ordinance section 30-375 outlines the required findings for approval of a Plat. 9. The proposed subdivision is consistent avitb the honing regulations (article VI of this cbapter) and conforms in all respects witb all requirements of this Code, including the honing regulations and this article. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota, as follows: A. The proposed subdivision is consistent with Chapter 30 of the City Code of Ordinances and conforms with all its requirements. B. The proposed subdivision is consistent with all applicable general and specialized city, county, and regional plans including, but not limited to, the city's Comprehensive Plan. C. The physical characteristics of the site, including, but not limited to, topography, soils, vegetation, susceptibility to erosion and siltation, susceptibility to flooding, and drainage are suitable for the type and density of development and uses contemplated. D. The proposed subdivision will not have an undue or adverse impact on the reasonable development of neighboring land. 2. Final plat approval is hereby granted for the Property. The officers of the City are hereby authorized, once the conditions set forth in Exhibit B are met and complied with, to sign the final plat for the Property and to issue a certified copy of this Resolution giving final approval of the plat. 4. The owner of the Property is authorized to record the final plat as required by law and shall file proof of said recording with the City. No building permits will be issued for the Property until the final plat is recorded. This final plat approval shall expire two years from the date of this resolution if the final plat is not recorded within that time. Passed and adopted this 15Ih day of November 2021. John J.
