ORDINANCE 81-6B
AN ORDINANCE AMENDING ORDINANCE NO. 900 BY RE-DEFINING AND
CHANGING STANDARDS FOR HOME OCCUPATIONS
The City Council of the City of Elk River does ordain as follows:
Section 8. Section 8 of Ordinance No. 900 of the Elk River Municipal Code which
relates to definitions used in the Zoning Ordinance is hereby amended
to read as follows:
30 -Home Occupations. A service business customarily conducted
entirely within a dwelling principally by members of a family
residing therein which use is clearly incidental and secondary
to the use of the dwelling for residential purposes and does
not change the character thereof.
Section 20. Subsection 3 of Section 20 of Ordinance No. 900 of the Elk River
Municipal Code which relates to conditional uses under the City Zoning
Ordinance is hereby amended to read as follows:
3 - Home Occupations. A home occupation may be established and
conducted only in accordance with the following requirements
following receipt of a conditional use permit as outlined in
Section 900.42 of the Zoning Ordinance.
a. Subordinate Use - The use of the dwelling unit for
the home occupation shall be clearly incidental and subordinate
to its residential use.
b. Outside Appearance - Conduct of the home occupation shall
result in no substantial change in the outside appearance of
the buildings or land. If such change is allowed, it shall
have no contrasting difference from the existing structure.
Any sign or visible advertisements authorized in the conditional
use permit shall not exceed two (2) square feet in area and shall
be mounted flat on the outside wall of the dwelling.
c. Hours of Operation - Hours of operation for such occupations
shall be in accordance with the conditional use permit.
d. Non-Resident Employees - The number of non-resident employees
which may be employed as part of the occupation may be limited
by the terms of the conditional use permit.
e. Traffic - No traffic shall be generated by such home occupation
in greater volume than would normally be expected in a residential

neighborhood, and any need for parking generated by the
conduct of such home occupation shall be met off the
street and other than in a required front yard.

Sherburne County Star News and has full knowledge of the facts herein stated as
follows: (1) Said newspaper is printed in the English language in newspaper
format and in column and sheet form equivalent in printed space to at least 900
square inches. (2) Said newspaper is a weekly and is distributed at least once
each week. (3) Said newspaper has 50% of its news columns devoted to news of
local interest to the community which it purports to serve and does not wholly
duplicate any other publication and is not made up entirely of patents, plate
matter and advertisements. (4) Said newspaper is circulated in and near the
municipality which it purports to serve, has at least 500 copies regularly
delivered to paying subscribers, has an average of at least 75% of its total
circulation currently paid or no more than three months in arrears and has entry
as second-class matter in its local post-office. (5) Said newspaper purports to
serve the City of Elk River In the County of Sherburne and it has its known office
of issue in the City of Elk River in said county, established and open during its
regular business hours for the gathering of news, sale of advertisements and sale
of subscriptions and maintained by the publisher of said newspaper or persons in
his employ and subject to his direction and control during all such regular
business hours and devoted exclusively during such regular business hours to the
business of the newspaper and business related thereto. (6) Said newspaper files
a copy of each Issue immediately with the State Historical Society. (7) Said
newspaper is made available at single' or subscription prices to any person,
corporation, partnership or other unincorporated association requesting the
newspaper and making the applicable payment. (8) Said newspaper has complied
with all the foregoing conditions for at least one year preceding the day or dates
of publication mentioned below. (9) Said newspaper has flied with the Secretary
of State of Minnesota prior to January 1, 1966 and each January 1 thereafter an,
affidavit in the form prescribed by the Secretary of State and signed by the
publisher of said newspaper and sworn to before a notary public stating that the
newspaper is a legal newspaper.
