80-003 ORD . CITY OF ELK RIVER ORDINANCE NO. 80-3 WHEREAS, the City of Elk River is empowered pursuant to Minnesota Statutes Section 462.354 to revise and establish a planning commission. NOW, THEREFORE, be it enacted by the City of Elk River: 214 - Planning Commission 214.00 Establishment of Planning Commission. There is hereby established in the City of Elk River, a planning commission pursuant to Minnesota Statutes, Section 462.354. 214.02 Members and Term. The Planning Commission shall consist of five (5) members appointed by the City Council at the first meeting of the year for terms of 3 years. A vacancy shall be filled by the City Council for the remainder of the term. The members of the Planning Commission by a majority vote shall elect one of the appointed commissioners at the first meeting of the year to serve as chairman. . 214.04 Powers and Duties. The Planning Commission shall have and exercise the powers and duties conferred upon such commissions by the Municipal Planning Act (Minnesota Statutes, Section 462.351 to 462.364) and by Ordinance rules and regulations of the City. 214.06 Meetings and Procedure. The Commission shall meet regularly on the fourth Monday of each month. Special meetings may be held at any time upon the call of the Chairperson. Notice of the time and place of a special meeting shall be communicated to the members and publically noticed at least three days prior to the meeting except in the event of an emergency. A majority of the Commission members shall constitute a quorum. All Commission me~tings shall be open to the public. Except as provided herein, the Commis- sion shall be governed by and operate pursuant to Roberts Rules of Order as most recently revised. Repealer. All ordinances and ordinance provlslon in conflict with the provisions contained herein are hereby repealed. Section 2. Dare, being duly sworn on oath says he is and during all the times herein stated has been the publisher and printer of the newspaper known as Sherburne County Star News and has full knowledge of the facts herein stated as follows: (1) Said newspaper is printed in the English language in newspaper format and in column and sheet form equivalent in printed space to at least 900 square inches, (2) Said newspaper is a weekly and is distributed at least once each week. (3) Said newspaper has 50% of its news columns devoted to news of local interest to the community which it purports to serve and does not wholly duplicate any ol'her publication and is not made up entirely of patents, plate matter and advertisements, (4) Said newspaper is circulated in and near the municipality which it purports to serve, has at least 500 copies regularly delivered to paying subscribers, has an average of at least 75% of its total circulation currently paid or no more than three months in arrears and has entry as second.class matter in its iocal post'office. (5) Said newspaper purports to serve the City of Elk River in the County of Sherburne and it has its known office of issue in the City of Elk River in said county, established and open during its reguiar business hours for the gathering of news, sale of advertisements and sale of subscriptions and maintained by the publiSher of said newspaper or persons in his employ and subject to his direction and control during all such regular business hours and devoted exclusively during such regular business hours to the business of the newspaper and business related thereto. (6) Said newspaper files a copy of each issue immediately with the State Historical Society. (7) Said newspaper is made available at single or subscription prices to any person, corporation, partnership or other unincorporated association requesting the newspaper and making the applicable payment. (8) Said newspaper has complied . with all the foregoing conditions for at least one year preceding the day or dates of publication mentioned below. (9) Said newspaper has filed with the Secretary of State of Minnesota prior to January 1, 1966 and each January 1 thereafter an affidavit in the form prescribed by the Secretary of State and signed by the publisher of said newspaper and sworn to before a notary pUblic stating that the newspaper is a legal newspaper. .
