80-006 ORD . . . ~ CITY OF ELK RIVER, MINNESOTA ORDINANCE NO. 80-6 AN ORDINANCE AMENDING SECTION 900.42, SUBSECTIONS 2 AND 3 of the ZONING ORDINANCE OF THE CITY OF ELK RIVER, RELATING TO CONDITIONAL USE PERMITS THE CITY COUNCIL ORDAINS AS AN AMENDMENT TO THE ZONING ORDINANCE OF THE CITY OF ELK RIVER: Section 900.42, Subsections 2 and 3 of the Zoning Ordinance of the City of Elk River is hereby amended to read as follows: 900.42 - Conditional Use Permits. 2. Planning Commission Review. On receipt of a completed application including necessary plans and information, the Zoning and Building Administrator shall schedule its review by the Planning Commission. The Planning Commission shall report its findings and recommendations to the Council with regard to the application. 3. Council Action. On receipt of the report of the Planning Commission, the Council shall hold a public hearing and shall make a decision upon the proposal to grant or deny a conditional use permit. At least ten (10) days in advance of each hearing, notice of the time and place of such hearing shall be transmitted to the applicant and shall be published in the official newspaper. All property owners within three hundred fifty (350) feet shall be notified by mail of the subject, time and place of the public hearing. Failure of a property owner to receive notice shall not invalidate the hearing or proceeding.
