Adopt, by motion, a resolution authorizing submission of a Minnesota Capital Grant Application.
Background/Discussion
The Rolling Hills subdivision, located in the northeast corner of the Municipal Service Area, has experienced a
failed Subsurface Sewage Treatment System (SSTS). The Minnesota Pollution Agency has acknowledged it poses
an imminent threat to public health and safety and needs replacement.
Connecting to the WWTP appears to be the most feasible solution for the Rolling Hills Homeowners
Association. Assessment estimates for each lot are detailed in the Resolution.
The HOA has proposed applying for a Capital Grant through the State of Minnesota to help offset a portion of
the cost to connect to city services.
The city is supportive of this proposal providing that if awarded the grant, any costs not covered by the grant be
paid via special assessment.

A Resolution of the City Council of the City of Elk River Authorizing
Submission of a Minnesota Capital Grant Application
WHEREAS, the Rolling Hills Subdivision (“Subdivision”), located within the City of Elk
River (“City”), currently has a community Subsurface Sewage Treatment System (“SSTS”)
serving 28 properties in the Subdivision; and
WHEREAS, the SSTS has failed and requires replacement in order to serve the 28
properties within the Subdivision and protect ground water in the area; and
WHEREAS, the most cost-effective solution to replace the SSTS appears to be to connect
the Subdivision to the City Waste Water Treatment Plant (“WWTP”); and
WHEREAS, the WWTP has the capacity to serve the Subdivision; and
WHEREAS, the cost of connecting the Subdivision to the WWTP is estimated to be
approximately $93,000 for each of the 28 homes within the Subdivision; and
WHEREAS, the City will likely not be able to assess, and many of the properties within
the Subdivision will not be able to pay, $93,000 per lot; and
WHEREAS, the Rolling Hills Homeowners Association (“HOA:”) has proposed that the
City seek a Capital Grant (“Grant”) to assist in the costs of connecting the Subdivision to
the WWTP; and
WHEREAS, the City is willing to apply for the Grant provided that the properties within
the Subdivision pay, by special assessment otherwise, all costs not covered by the Grant for
connecting the Subdivision to the WWTP; and
WHEREAS, the City has the legal authority to receive financial assistance, and the
institutional, managerial, and financial capability to ensure adequate project administration;
and
WHEREAS, the local match identified in the Grant application will be paid by the
properties within the Subdivision; and
WHEREAS, the City has not violated any Federal, State or local laws pertaining to fraud,
bribery, graft, kickbacks, collusion, conflict of interest or other unlawful or corrupt practice;
and
WHEREAS, that upon approval of the Grant by the state the City may enter into an
agreement with the State of Minnesota for the above-referenced Grant; and
WHEREAS, the City certifies that it will comply with all applicable laws and regulations as
stated in all contract agreements.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Elk
River, Minnesota, does hereby authorize the Mayor and City Clerk to execute such
documents and agreements as are necessary to request the Grant on behalf of the City and
the HOA.
