Only one employee and one tractor and trailer are permitted. 2. The tractor& trailer shall be parked on an approved surface ," per the ordinance requirements. CR 33 3. The idling of a truck tractor in excess of 15 minutes from April 16 through October 31, and 30 minutes from November 1 through April 15,is prohibited. 4. Any future permits,required for the home occupation, shall RR have full compliance with all commercial building, electrical, plumbing, and fire code requirements. This requires plansH `io_:j signed by a registered architect or register professional _ cue 12 engineer. ` Background/Discussion The property is zoned Rl-a where tractor trailer parking/home pP occupations require a Conditional Use Permit (CUP). The applicant is yhr seeking a CUP to park a single tractor and trailer at subject parcel. The parcel is 0.87 acres in size with a vacant parcel to the north. The area the tractor trailer will be parked is 200-300 feet to the nearest homes and there are approximately 12 homes within 500 feet. Figure i Applicable Regulations In approving a Conditional Use Permit,the council may impose such specific conditions with regard to the development or operation of the proposed use as it considers necessary to satisfy the seven standards set forth in Section 30-654 and the requirements contained in this article and to promote compatibility with and minimize any potentially adverse effects upon adjacent properties, the neighborhood or the city. This land use primarily consists of planned residential subdivisions and lots located directly on arterial roadways. This land use supports large lot residential development and allows agricultural operations as an accessory use where appropriate. The use will be consistent with the comprehensive plan. There is one vacant lot directly north of the subject parcel, but this lot is a buildable lot in the zoning district. The property is served by Tyler Street (a Collector Road) and is outside the Urban Service District. The use will be served adequately by and will not adversely affect essential public facilities and services including streets,police and fire protection,drainage, refuse disposal,water and sewer systems,parks and schools; and will not,in particular, create traffic congestion or interference with traffic on adjacent and neighboring public thoroughfares. Staff does not see a need to impose specific conditions to satisfy this standard. 5. While no new structure(s) or modifications to the existing structure are proposed, any future permits, required for the home occupation,need to have plans signed by a registered architect or register professional engineer. This requires the building(s) to meet all applicable building, electrical,plumbing, and fire codes and subsequent inspections and enforcement. Staff recommends full compliance with all commercial building, electrical,plumbing, and fire code requirements. The use will fully comply with all other requirements of this Code,including any applicable requirements and standards for the issuance of a license or permit to establish and operate the proposed use in the city. If denial of such a permit should occur,it shall accompany recommendations or determinations by findings or a report stating how the proposed use does not comply with the standards set forth in Section 30-654.
