78-010 ORD lhf:lc:02:3l9-04 ORDINANCE No. 78-10 AN ORDINANCE AMENDING ORDINANCE NO. 8.05 OF THE ELK RIVER MUNICIPAL CODE RELATING TO SPECIAL LICENSES PERMITTING THE SALE OF INTOXICATING LIQUOR ON SUNDAYS The City Council of the City of Elk River does ordain as follows: Section 1. That Section 2 of Ordinance No. 8.05 of the Elk River Municipal Code be amended to read as follows: SECTION 2. License Required. Subdivision 1. General Requirement; Hours and Days Regulated. (a) No person, except a wholesaler or manufacturer to the extent authorized under state license, shall directly or indirectly deal in, sell, or keep for sale in the. city any intoxicating liquor without a license to do so as provided in this ordinance. Liquor licenses shall be of three kinds: "on-sale", special club licenses, and special licenses permitting the sale of intoxicating liquor on Sundays. (b) No sale of intoxicating liquor shall be made after 1:00 a.m. on Sunday, nor until 8:00 a.m. on Monday, except as hereinafter provided, nor between the hours of 1:00 a.m. and 8:00 p.m. on the day of any state-wide election. No lion-sale" shall be made between the hours of 1:00 a.m. and 8:00 a.m. on any weekday. Subdivision 2. On-sale Licenses. "On-sale" licenses shall be issued only to hotels and res taurants having a seating capacity of not less than 100 guests at one time and shall permit "on-sale" of liquor only. Subdivision 3. Special Club Licenses. Special club licenses shall be issued only to incorporated clubs which have been in existence for 15 years or more or to congressionally chartered veterans' organi- zations which have been in existence for 10 years. Subdivision 4. Special Licenses Permitting the Sale of IntoY~cating Liquor on Sundays. Establishments to which "on-sale" licenses have been issued or hereafter may be issued for the sale of intoxicating liquor which arc hotels or restaurants or clubs as defined in Minnesota Statutes, Chapter 34D and incorporated herein by reference pursuant to Section 1 hereof, and which have facilities for serving not less than 30 guests at one time, may serve intoxicating liquor beh!een the hours of 12:00 noon and 12:00 midnight on Sundays in conjlli~ction with the serving of food. It is unlawful for any such establishment, directly or indirectly, to sell or serve intoxicating liquor as provided in this subdivision without having first obtained a special license therefor. Application for said ~3pecial license shall be made to the City Council in the same manner as application h; made for other licenses to sell intoxicating liquor. Section 2. That Section [, of Ordinance No. 8.05 of the Elk River Hunicipal Code be amended to read as follows: SECTION 1;. License Fees. Subdivision 1. Fees. The annual fee for a liquor license shall be $2500 for an "on-sale"license, $100 for. a special club license, and $200 for 0 special licen:;e permitting the sale of intoxicating liquor on Sundays. Subdivision 2. Payment. Each application for a license :3holl be accornpan:ind by a receipt from the City treasurer for payment in full of the license fee. All fees shall be paid into the general fund. If an application for a license is rejected, the treasurer shall refund the amount paid. Subdivision 3. Term; Pro Rata Fee. Each license shall be issued for a period of one year except that if the application is made during the license year, a license may be issued for the remainder of the year for a pro rata fee, with any unexpired fraction of a month being counted as one month. Every license shall expire on the las t day of June. Subdivision 4. Refunds. No refund of any fee shall be made except as authorized by statute. Section 3. That this Ordinance shall take effect and be in force from and after the date of its publication.
