AN ORDINANCE PROVIDING FOR THE REGULATION AND
LICENSING OF SAUNAS AND MASSAGE ESTABLISHMENTS
MASSEURS AND MASSEUSES AND THEREBY AMENDING THE
MUNICIPAL CODE BY ADDING CHAPTER 19
The City Council of the City of Elk River does ordain as follows:
Section 1. The Municipal Code of the City of Elk River is hereby amended by adding
thereto the following chapter.
Chapter 19
SAUNAS, MASSAGE PARLORS, MASSEURS AND MASSEUSES
19.01 Definitions. As used in this chapter, the terms defined in this section shall
have the meanings ascribed to them:
(a) "Sauna" means and includes a steam bath or heat bathing room used for
the purpose of bathing, relaxation or reducing, utilizing steam or hot
air as a cleaning, relaxing or reducing agent, and for which a fee is
charged.
(b) "Massage Parlor" means and includes any room or rooms where any person
for a fee may receive from another person a massage, or any room or rooms
from which a masseur or masseuse is dispatched by telephone or otherwise,
for the purpose of giving a massage; provided that no massage for a fee
shall be given except on a licensed premises.
(c) "Massage" means the rubbing, stroking, kneading, tapping or rolling of
the body with the hands or other devices or implements, for the exclusive
purposes of relaxation, physical fitness or beautification, and for no
other purposes.
(d) "Masseur" means a male person who practices massage.
(e) "Masseuse" means a female person who practices massage.
(f)' "Sanitaryll means free from the vegetative cells of pathogenic m~cro-
organisms.
(g) "Adequate" or "approved" means acceptable to the Chief Building Inspector
or his agents following his determination as to conformance with public
health practices and standards.
19.02 Massage Distinguished. The practice of massage ~s hereby declared to be distinct
from the practice of medicine, surgery, osteopathy, ch iropractic, phys ical therapy or
podiatry and persons duly licensed in this state to practice medicine, surgery,
osteopathy, chiropractic, physical therapy or podiatry and nurses who work solely under

the direction of any such persons, athletic directors and trainers are hereby expressly
excluded from the provisions of this chapter. Beauty culturists, barbers, and
cosmetologists who do not give or hold themselves out to give massage treatments as
defined herein, other than is customarily given in such shops or places of business
for the purpose of beautification only, shall be exempt from the provisions of this
chapter.
19.03 Licenses Required; Exceptions.
(a) Business License. It shall be unlawful for any person to engage ~n the
business of operating a sauna or a massage parlor, either exclusively
or in connection with any other business enterprise, without being
licensed as provided in this chapter. Any person who conducts such
business either in whole or in part by arranging for massage by means
of telephonic, verbal or written communication shall administer such
massages only on a licensed premises, if such massage is to be.
administered within the City of Elk River. A separate license must be
obtained for each place of business. Business licenses are not
transferable. No more than three (3) business licenses issued hereunder
may be in force at anyone time.
.(b) Masseur or Masseuse License. It shall be unlawful for any person to
perform massage services within the City unless currently licensed under

this chapter. Licenses are not transferable.
(c) Exceptions. A license is not required under this chapter as follows:
(1) For premises on which saunas but not massages are provided incidental
to the use of exercise and recreational equipment and facilities
situated on the same premises, provided that the sauna facilities
shall occupy floor area equivalent to not more than 10% of the floor
area used for the exercise and recreational equipment and facilities.
(2) For hotels, motels, rooming houses and apartment buildings in which
saunas but not massages are provided incidental to the rental of
rooms and the use of which is limited to tenants of the respective
facili ties.
(3) For premises at which massage parlors or sauna facilities are
provided by a non-profit corporation or association; provided,
however, that such corporation or association is duly organized
under the laws of the State of Minnesota for civic, fraternal, social
or business purposes which organization shall have more than 50
members and which shall for more than two years prior to application
have owned, hired or leased a building or space in a building of
such extent and character as may be suitable and adequate for the
reasonable and comfortable accommodation of its members and whose
affairs and management are conducted by a Board of Directors,
Executive Committee or other similar body chosen by the members
at a meeting held for that purpose, none of whose members, officers,
agents or employees is paid directly or indirectly in a compensation
by way of profit from the services offered by the organization to
the members or their guests, beyond the amount of such reasonable
s?lary or wages as may be fixed and voted each year by the Board

of Directors or other governing body.
19.04 Business License for Sauna or Massage Parlor.
(a) Business License Application. The initial application for a business
license provided in this chapter shall be made to the City Clerk by filing
the annual license fee and by completing an application form or forms
as provided by the City Clerk. In addition to such information as the
Clerk may require, the application shall include:
(1) Whether the applicant is a natural person, a corporation, a partner
or other form of organization.
(2) If the applicant is a natural person:
i. The true name, place and date of birth, street address and phone
number of applicant.
ii. Whether the applicant 1S a citizen of the United States.
iii. Whether the applicant has ever used or has been known by a
name other than his or her true name; and if so, what was such name
or names and information concerning dates and places where used.
iv. The name of the business if it is to be conducted under a
designated name or style other than the full individual name of
the applicant; in such case, a copy of the certification as required
by M.S.A. chapter 333, certified by the Clerk of the District Court,
shall be attached to the application.
v. The street addresses at which applicant has lived during the
preceding five years.
vi. The kind, name and location of every business or occupation
the applicant has been engaged in during the preceding five years.
vii. The names and addresses of applicant's employer(s) and
partner(s), if any, for the preceding five years.

viii. Whether the applicant has ever been convicted of any crime.
If so, the applicant shall furnish information as to the time, place
and offense for all incidents.
ix. The physical description of the applicant.
x. Whether the applicant has any training or experience in
performing massage services.
(3) If the applicant is a partnership:
~. The names and addresses of all partners and all information
concerning each partner as is required of an individual applicant
in subparagraph 2 above.
ii. The name of the managing partner(s) and the interest of each
partner in the business.
iii. A true copy of the partnership agreement shall be submitted
with the application. If the partnership is required to file a
certification as to a trade name under the provisions of M.S.A.
Chapter 333, a copy of such certificate, certified by the Clerk
of District Court, shall also be attached.
(4) If the applicant is a corporation or other organization:
~. The name, and if incorporated, the state of incorporation.
ii. A true copy of the Certificate of Incorworation, Articles of
Incorporation or Association Agreement, and By-Laws shall be attached
to the application. If a foreign corporation, a Certificate of
Authority, as described in M.S.A. Chapter 303, shall also be
attached.
iii. The name of the manager or proprietor or other agent in charge
of the business to be licensed and all information concern~ng said
person(s) as is required in subparagraph 2 above.

iv. A list of all parties who control or own an interest in excess
of five percent in such corporation or organization and all
information concerning said person as is required in subparagraph
2 above.
v. If the applicant is a non-profit corporation the application
shall include a list of all members of such non-profit corporation.
(5) Whether the applicant is licensed in other communities to operate
similar businesses; and if so, where.
(6) The names of applicant's employees to be licensed and employed by
the applicant in the City.
(7) Whether the applicant has previously been denied a business license,
or has had a license revoked. If so, give details of each.
(8) The names, residences, and business addresses of three residents
of the metropolitan area, of good moral character, not related to
the applicant or financially interested in the premises or business,
who may be referred to as the applicant's or manager's character.
(9) A description and location of the premises to be licensed. If the
premises are not constructed and furnished at the time the
application is filed, the detailed plans of the premises and
furnishings shall be filed with the application.
(10) A description of the services to be provided.
(11) List of types of equipment to be used in the business.
(12) Such other information as the Council may requ~re.
(b) Review of Business License Application and Council Action.
(1) All business license applications shall be referred to the Chief
of Police and such other city departments as the City Administrator
deems necessary for verification and investigation of the facts

set forth in the application. The Chief of Police and ,other
department heads consulted shall submit their reports and
recommendations to the City Council.
(2) The, City Council shall, upon receipt of the recommendations required
in subparagraph 1, afford the applicant and all interested
parties a public hearing, and shall consider the standards contained
in Section 19.06 of this chapter. The Council shall also have the
discretion to consider in granting, denying or renewing the license,
any reasonable fact or circu~stance relating to the public health
safety and welfare; including but not limited to the following:
i. The character and suitability of the area or neighborhood in
which the licensed premises is to be located;
ii. The proximity of the site for the sauna or massage parlor to
churches, schools, playgrounds parks or other community facilities
adversely affected;
iii. Numbers and proximity of existing sauna or massage parlors
so as not to cause excessive concentration in an area or
, neighborhood;
iv. Traffic congestion and parking problems; and
v. Reasonably anticipated likelihood of excessive noise,
disturbances or fighting by persons in or about the sauna or massage
parlor.
(3) The Council may deny an application for renewal, or grant a license
on the basis of a determination that the public health, safety or
welfare would be otherwise adversely affected, taking into account
one or more of the facts or circumstances in paragraph.

A license, unless revoked, is for the calendar year or part thereof,
for which it has been issued. Upon denial of any application for a
business license, the City shall refund the amount paid. No other refunds
shall be made.
(b) Investigation Fee. At the time of each initial application for a business
license for a sauna or massage parlor, an investigation fee of
shall be paid in full. No investigation fee shall be refunded.
19.06 Business License Restrictions and Regulations.
(a) Licenses may be granted only in the appropriate zone to be determined
by the City Council and laws and ordinances of the City of Elk River.

(b) Licenses shall be granted o~ly to establishments which can meet the safety
and sanitary requirements of the City Council and of the Building Code
regulations of the City of Elk River and State of Minnesota.
(c) It shall be grounds for denial of the license application if there is
any fraud or deception involved 1n the license application.
(d) It shall be grounds for denial of the application if the applicant or
persons in his employ are not complying with or have a history of
violations of state laws and local ordinances that relate to health,
safety or moral turpitude.
(e) A license shall not be granted to a person of bad repute or to a
partnership or corporation who has in its employ or is owned by any
persons of bad repute.
(f) Such establishments shall provide adequate refuse receptacles which shall
be emptied as required.
(g) It shall be grounds for rescinding a license granted to any person,
partnership or corporation under this ordinance if they fail to comply
with any of the ordinances of the City of Elk River or statutes of the
State of Minnesota~
(h) It shall be grounds for rescinding a license granted to any person,
partnership or corporation under this ordinance if the owner, manager,
lessee, or any of the employees is found to be in control or possession
of any alcoholic beverages or narcotic drugs and controlled substances
on the premises, possession of which is illegal as defined by Minnesota
Statutes or Elk River City Ordinances.
(i) It shall be grounds for rescinding of a license if the owner, manager,
lessee or any of the employees is convicted of any ordinance or state
statute violation arising within the business establishment to which

the license was granted under this chapter.
(j) It shall be grounds for rescinding any license granted under this chapter
if the premises do not comply with the health, safety and building
regulations of the City of Elk River and State of Minnesota.
(k) An application may be denied or a license may be rescinded if the presence
of such a sauna and/or massage establishment is found to be detrimental
to the health, welfare or safety of the citizens of the City of Elk River.
(1) A license may be rescinded upon evidence of a material variance in the
actual plan and design of the premises from the plans submitted pursuant
to 19.04(a)(9).
19.07 Construction and Maintenance Requirements.
(a) All sauna rooms, massage parlors and all restrooms and bathrooms used
in connection therewith shall be constructed of materials which are
impervious to moisture, bacteria, mold or fungus growth. The floor to
wall and wall to wall joints shall be cons tructed to provide a sanitary
cove with a minimum radius of one inch.
(b) All restroOms used in connection with saunas and/or massage parlors shall
be provided with mechanical ventilation with 2 cfm per square foot of
floor area, a minimum of 15 foot candles of illumination, a hand washing
sink equipped with hot and cold running water under pressure, sanitary
towels and a soap dispenser.
(c) Each sauna and/or massage parlor establishment shall have a janitor's
closet which shall be provided for the storage of cleaning supplies.
Such a closet shall have mechanical ventilation with 2 cfm per square
foot of floor area and a minimum of 10 foot candles of illumination.
Such closet shall include a mop sink.
(d) Floors, walls and equipment in sauna rooms, massage parlors, restrooms

and in bathrooms used in connection therewith must be kept in a state
of good repair and sanitary at all times. Linens and other materials
shall be stored at least 6 inches off the floor. Sanitary towels, wash
cloths, cleaning agents and toilet tissue must be made available for
each customer.
(e) Individual lockers shall be made availab Ie for use by patrons. Such
lockers shall have separate keys for lbcking.
(f) Doors on massage rooms shall not be locked or capable of being locked.
Locks, latches or other devices intended to secure a door so as to prevent
its being opened by any person from either side of the door with or
wi thout a key cannot be present on any doors on massage rooms. All
massage rooms shall be clearly identified by signs.
19.08 Masseur or Masseuse Licenses.
(a) Masseur or Masseuse License Application. The initial application for
a masseur or masseuse license shall be made to the City Clerk by filing
the annual license fee and by completing an application form or forms
as provided by the City Clerk. In addition to such information as the
Clerk may require, such application shall include:
(1) The name, age and address of the applicant.
(2) The length of experience in this occupation and the past places
of employment and position held.
(3) A description of any crime or other offense including the time,
place, date and disposition for which the applicant has been arrested
.and convicted.
(4) Photographs of the applicant taken by the Elk River Police Department
showing both the front and side view.
(5) A complete set of fingerprints taken by the Elk River Police
ll.
Department.
(b) Educational Requirements. Each applicant for a masseur or masseuse
license shall furnish with the applicat~on a diploma or certificate of
graduation from a school which
(1) is either accredited by a recognized educational accrediting
association or agency, or is licensed by the state or local
governmental agency having jurisdiction over the school; and
(2) offers course work or degree programs in physical therapy, anatomy,
physiology, physical culture, massage, hydrotherapy and hygiene;
and
(3) has for its purpose either wholly or in part, the teaching of the
theory, method, work or profession of massage; and
(4) as a prerequisite of graduation requires a resident course of study
of not less than seventy (70) hours of instruction in the above
subjects and teaching.
In the event that such applicant is not a graduate of such a school
or such course work, is not a prerequisite of graduation, the
applicant may present a transcript certified by the school showing
the completion with passing grades of seventy (70) hours of course
work or instruction in the above subjects and teaching. New
applicants for such licenses shall be required to comply with these
requirements. Persons already licensed as a masseur or masseuse
on the effective date of this ordinance shall be required to comply
with these requirements. Persons already licensed as a masseur
or masseuse on the effective date of this ordinance shall be required
to comply with these requirements within six months after that date;
provided, however, that persons already licensed who have been

19.10 Masseur or Masseuse License Restrictions and Regulations

(a) Saunas and/or massage parlors shall not discriminate on grounds of race,
creed, color, sex, national origin or ancestry in performing services
offered by the licensed establishment.
(b) Whenever a massage is given it shall be required by the masseur or
masseuse that the person who is receiving the massage shall have his
or her buttocks, anus and genitals covered with an appropriate non-
transparent covering.
(c) Any masseur performing any massage shall at all times have his anus,
buttocks and genitals covered with a non-transparent material.
(d) Any masseuse performing any massage shall at all times have her breasts,
buttocks, anus and genitals covered with a non-transparent material.
(e) No person shall engage ~n providing services as a masseur or masseuse
,
without being licensed by the City Council of the City of Elk River.
(f) No sauna and/or massage parlor for which a license has been granted by
the City shall be open for business unless and until all masseurs or
masseuses employed in the business have first complied with the licensing
requirements of this chapter.
(g) Any person acting as a masseur or masseuse in a sauna or massage parlor
shall have his or her license displayed in a prominent place on the
licensed premises.
(h) Only a licensed masseur shall be allowed to massage male customers and
only a licensed masseuse shall be allowed to massage female customers.
(i) A license for a masseuse or masseur may be denied or rescinded upon any
one of the following grounds:
(1) Fraud or deception in the license application.
(2) Applicant/licensee has a history of violations of laws and ordinances
that apply to health, safety or moral turpitude.

(3) Applicant/licensee is of bad repute.
(4) Applicant/licensee has been convicted of violation of an ordinance
or State statute arising within the business establishment to which
a sauna and/or massage parlor license was granted under this chapter.
(5) Applicant/licensee has been convicted of crimes or offenses involving
sexual misconduct.
19.11 Submission of Plans and Specifications All persons who hereafter construct,
extensively remodel or convert buildings or facilities for use as a massage parlor or
sauna shall conform and comply in their construction, erection or alteration with the
requirements of this chapter. Plans and specifications for such layout, arrangement
and plumbing and construction materials of the sauna and massage areas, and locations,
size and type of equipment and facili ties shall be filed by the owner in the office
of the Chief Building Inspector. A building permit shall not be issued for any such
construction, remodeling, or alteration until such permit shall have the approval of
the Chief Building Inspe9tor.
19.12 License Renewals. An application for a renewal of a business license or masseur
or masseuse license shall be made in the same manner as the initial application. The
license fees for a renewal shall be the same as those contained in Sections 19.05 and
19.09.
19.13 Persons Ineligible for a Business or Masseur or Masseuse License. No license
provided for in this chapter shall be issued to an applicant who is under 18 years of
age, is an alien or has been convicted of prostitution or any other crime or violation
involving moral turpitude.
19.14 Restrictions Involving Minors. )No person under the age of 18 shall be permitted
at any time to be in or on the licensed PFemises as a customer, guest Qr employee, unless
accompanied by his or her parent or guardian.
19.15 Inspection. Any duly authorized law enforcement officer, health officer or

building inspector of the City or any other agency having jurisdiction shall be allowed
to inspect the licensed premises at any times and hours in which any person is present
on the licensed premises to insure compliance with all provisions of this chapter.
19.16 Business Hours. No customers or patrons shall be allowed to enter a licensed
premises after 10:00 o'clock P.M. and before 8:00 o'clock A.M. daily. No customers
or patrons shall be allowed to remain upon the licensed premises after 10:30 P.M; and
before 8:00 o'clock A.M. daily.
19.17 Violations and Penalties. Every person who commits or attempts to commit,
conspires to commit, or aids or abets in the commission of, any act constituting a
violation of this chapter, whether individually or in connection with one or more other
persons or as principal, or agent, or accessory, shall be guilty of a misdemeanor, and

every person who falsely, fraudulently, forcibly or willfully, induces, causes, coerces,
requires, permits or directs another to violate any of the provisions of this chapter
is likewise guilty of a misdemeanor. Upon conviction thereof, said person shall be
punished by a fine not to exceed $500.00 or by imprisonment not to exceed 90 days or
both, together with the costs of prosecution. Each violation of this chapter shall
constitute a separate offense. Conviction of a violation of this chapter shall be
grounds for rescission or revocation of any licenses issued hereunder.
19.18 Existing Businesses. Any sauna or massage parlor regulated by this chapter and
which is conducting business on the effective date of this chapter, and any masseur
or masseuse employed within such premises on such date, may continue to operate until
the Council has acted on its application for a license hereunder, provided that
appropriate applications are filed within 15 days after the effective date, and provided
further, that the operation of such business shall comply with the provisions of Section
19.07. Any person who has not filed an application within the prescirbed time shall
not operate a sauna or massage parlor, nor provide massages until duly licensed.
19.19 Rescission, Revocation or Suspension. The City Council may revoke, rescind or suspend

any license for cause. Prior to such action, the licensee shall be provided with written
notice setting forth the nature of the charges and the date of the hearing before the
Council, which hearing shall be no less than ten nor more than twenty days after the
date of service of such notice upon the licensee by registered or certified mail or
personal service. The licensee shall have the right to appear at the hearing with
counsel and to present such evidence as the Council deems appropriate. The Council
shall have the power and discretion to suspend the license pending the hearing.
Section 2. Separability. If any section, subsection, sentence, clause or phrase of
this ordinance is for any reason held to be invalid by a Court of competent jurisdiction,
such decision shall not affect the validity of the remaining portions of this ordinance.
Section 3. Effective Date. This Ordinance shall take effect and be in force from
and after the date of its publication.
