Overview
In August of 2001, tile City Council appro\Ted tlle final plat of Eagles IvIarsh. Tile final plat
created one lot for tlle J olllison Street \vater to\ver. This lot was part of a larger single family
de\reloplnent of 20,000 square foot lots located benveen Park Pointe and I<Jie\Ter Lake
Fields. Since that time, no activity has occurred regarding additional final p1'lts.
Request
Section 30-374 of tile City Code states tllat tlle
"failure of tlle subdi\rider to sublmt tlle final plat witllln one year unless a \vritten
request for extension 11as been sublnitted and for good cause granted by tile council,
shall cause tlle preliminary plat to become null and \Toid. Ho\Ve\Ter, tlle subdivider
lnay continue to final plat a pllase of the approved preliminal;T plat \Vitllln one year
of eacll pl1ase in order to extend \ralid appro'Tal of tlle prefuninary plat. If all of tlle
pllases of tlle appro\Ted preliminary plat are not finalized \vitllln a three-year period

unless the subdivider requests and tlle council grants an extension."

RE: Eagles Marsh Development Project
Dear Council Member,
III 2001 the City of Elk River needed a new water tower site and the liked the one we had
because the elevation of the property allowed them to build it to the "design elevation" and build
50 feet less tower because the land was 50 feet higher then the other site the City was looking at.
We had to do a complete preliminary design with ellgineering for the entire site as the tower was
going to be used to service land to the north (Gold Nugget Project) and land to the south (Park
Point). We also had to plat the street for the water main, and because the sanitary sewer l1eeded
lower than the water main we had to install the sanitary sewer prior to installing the water main.
OUf original intentions were to wait and subdivide the property in 2005 or 2006. OUf sanitary
sewer was to come from the north, but the sewer line was not installed until late 2004. We are
now ready to subdivide tIle property and have found that we have gone past three years from Ollf
illitial approval. We would have to go through the entire preliminary process again unless the
cOllncil grants an extension, which they are authorized to do. Please consider an extel1sion
based on the fact tllat we did tIns work back in 2001 to try and accommodate the needs of the
City.
