Per Minnesota Statute 15.99, the City has until November 22 to take action on the preliminary
plat.
Analysis
Target Corporation proposes to create a 24.73-acre parcel in the southwest corner of Elk Path
Business Center. The parcel is located east of Pinewood Golf Course and in the northeast
corner of the intersection of Waco Street and County Road 30.
The preliminary plat is comprised of a single lot with the remainder of the property being platted
as an oudot. The proposed lot exceeds the minimum standards of the Business Park District for
lot area and lot width.
Grading. Drainage and Utilities
The grading, drainage and utility issues are oudined in the City Engineer's memo dated August
16, 2005. Of specific note is the need for a large storm pond, as there is no storm sewer that
oudets from the development. The storm ponding will need to be large enough to meet the
City's drainage requirements.
Access
The preliminary plat indicates that a short portion of 182nd Avenue east of Waco Street will be
plat. The Council will note that in the final plat, this section of street has been eliminated due to
the uncertainty of the Pinewood 2nd Addition Plat. Since the Technology Center will have only
10-20 employees and receive very few deliveries, staff believes that a private driveway from
Waco Street will be sufficient to serve the Center. If, in the future, the building is converted to a
more intensive use, access to an internal street system will be explored.
The City Engineer and the County note that limited access will be required adjacent to County
Road 30.
Park Dedication
The Parks and Recreation Commission reviewed this plat and have requested a 15 foot trail
easement along the County road right of way in order to have adequate space for construction of
an off-street trail. The applicant will be required to provide cash to meet park dedication
purposes.
Planning Commission Action
The Planning Commission conducted a public hearing regarding this request at its August 23
meeting. No one spoke for or against the preliminary plat. The Commission voted
unanimously to recommend to the City Council that the preliminary plat be approved.

Recommendation
Staff and the Planning Commission recommend that the City Council approve the preliminary
plat of Elk Path Business Center Third Addition with the following conditions:
1. ALL COMMENTS OF THE CITY ENGINEER BE ADDRESSED.
2. ALL COMMENTS OF SHERBURNE COUNTY BE ADDRESSED.
3. THE APPLICANT SHALL PAY SURFACE WATER MANAGEMENT FEES FOR 24.73
ACRES.
4. THE APPLICANT SHALL PAY FOR PARK DEDICATION IN CASH FOR 24.73 ACRES
AND PROVIDE A 15 FOOT TRAIL EASEMENT ADJACENT TO COUNTY ROAD 30
RIGHT-OF-WAY.
5. THE APPLICANT SHALL ENTER INTO A DEVELOPER AGREEMENT WITH THE
CITY TO ENSURE INSTALLATION OF THE PUBLIC IMPROVEMENTS.
Staff also recommends that the City Council approve the resolution for final plat approval for

PRELIMINARY PLAT
Dear Ms. McPherson:
As requested, we have reviewed the preliminary plat for Elk Path Business Center Third
Addition as prepared by Ryan Companies U.S., Inc. The proposed preliminary plat replats
Outlot A of the Second Addition into Lot 1, Block 1 with the remnant being an outlot. Lot 1 is
approximately 30-acres in size and is the site of the proposed Target Technology Center. Based
upon our review, comments received at the staff review meeting, and meetings with
representatives of Ryan Companies, we would offer the following comments:
1. The preliminary plat provides right-of-way for 182nd Avenue. It is important that 182nd
Avenue on the east side of Waco Street line up with existing 182nd Avenue in the
Pinewood Addition. Currently, the Pinewood Addition is going through a platting
process which may move 182nd Avenue on their side of the road a little farther north.
This tinallocation will not be determined for at least 60 days. It will be important that
the two plats be flexible enough to coordinate the meeting point of 182nd Avenue with
Waco Street.
2. According to a letter from Sherburne County dated August 3, 2005, there should be no
access from the site, and none is proposed, to County Road 30. The plat must provide
restricted access along the entire south boundary of Lot 1, Block 1 and Outlot A.
3. Twenty-foot wide utility easements are provided for looping of watermain around the
perimeter of the building. A 20-foot wide utility easement needs to be provided from the
southeast comer of the building site to the south lot line to allow for the looping of the
watermain system to the east.
4. Since there is no storm sewer system that outlets from this development, there is a large
easement on the south side of Lot 1, adjacent to the County road where a storm water
pond will be built to take all the drainage from the site.

5. Ten foot drainage and utility easements are provided around the entire perimeter of the
site according to City Ordinance.

A RESOLUTION GRANTING FINAL PLAT APPROVAL FOR:
Elk Path Business Center Third Addition
Case No. P 05-14
WHEREAS, application has been made for final plat approval, pursuant to Section
1008.08 (l)(c) of the Elk River City Code of Ordinances, of the property legally described on
attached Exhibit A and hereinafter referred to as "the Property"; and
WHEREAS, the application for preliminary plat approval has been referred to the
Planning Commission which has given its advice and recommendation to the City Council;
and
WHEREAS, a preliminary plat of the Property was approved by the City Council on
September 6, 2005; and
WHEREAS, the proposed final plat is consistent with the preliminary plat as
approved by the City Council; and
WHEREAS, the proposed final plat complies with each of the conditions set forth
by the City Council in its approval of the preliminary plat of the Property;
NOW, 1HEREFORE, BE IT RESOLVED BY 1HE CITY COUNCIL OF 1HE
CITY OF ELK RIVER, as follows:
1. It is hereby determined by the City Council for the City of Elk River as follows:
A. The proposed subdivision is consistent with the Zoning Ordinance and
conforms with all of its requirements.
B. The proposed subdivision is consistent with all applicable general and
specialized city, county, and regional plans including, but not limited to, the City's
Comprehensive Development Plan.
C. The physical characteristics of the site, including, but not limited to,
topography, soils, vegetation, susceptibility to erosion and siltation, susceptibility to
flooding, and drainage are suitable for the type and density of development and uses
contemplated.
D. The proposed subdivision makes adequate provision for water supply, storm
drainage, sewage transportation, erosion control and all other services, facilities and
improvements otherwise required herein.
E. The proposed subdivision will not cause substantial environmental
damage.
F. The proposed subdivision will not conflict with easements of record or with
easements established by judgment of a court.
G. The proposed subdivision will not have an undue or adverse impact on the
reasonable development of neighboring land.
Z.' Final plat approval is hereby granted for the Property, subject to the conditions set
forth in attached Exhibit B.
3. The officers of the City are hereby authorized, once the conditions set forth in
Exhibit B are met and complied with, to sign the final plat for the Property and to
issue a certified copy of this Resolution giving final approval of the plat.
4. The owner of the Property is authorized to record the final plat as required by law
and shall file proof of said recording with the City. No building permits will be
issued for the Property until the final plat is recorded.
5. This final plat approval shall expire one year from the date of this resolution if the
final plat is not recorded within that time.
The foregoing resolution was introduced by Council Member and
duly seconded by Council Member . The following voted in favor
of the Resolution.

Dear Ms. McPherson;
We have reviewed the proposal for the plat of Target Technology Center located within the
City of Elk River and adjacent to County Highway 30 and submit the following comments.
Mississippi Road or CH 30 is identified as a major urban collector in our transportation plan, as
such direct access to CH 30 will be denied. Sherburne County requires that the limited access
symbol be shown on the drawing for the property adjacent to Mississippi Road/CH 30.
There are two existing field access located along CH 30 that shall be removed; one is
approximately 300' east of Waco Street, the other is near the east boundary. This removal will
require a permit from our office and the excavation must match the existing section. Location
of any utilities within the right of way will require a permit.
We require that 50 feet of right of way along CH 30, be donated to Sherburne County in fee
title. We request our standard 100' setback from the center of the county highway.
