Park Dedication shall be paid for one dwelling unit at the rate applicable when the subdivision is released for recording. 2. Driveway and home location shall be shown before plat is recorded to ensure all setbacks are met. 3. A 45-foot drainage and utility easement shall be added around all delineated wetlands. Background/Discussion Case Number P 22-02 - The property is 10 acres, zoned R1a and thth located north of 209 Ave east of Hoover St (9987 209 Ave). The proposed plat consists of two lots. Lot 1, Block 1 will contain the existing house and the second lot will be a buildable single-family lot, which is eligible for park dedication. Both lots will be 5-acres. Parks and Recreation Commission The commission recommend park dedication fee for one dwelling unit at the rate applicable when the subdivision is released for recording. Applicable Regulations City ordinance section 30-375 outlines the required findings for approval of a Plat. 1. The proposed subdivision is consistent with the zoning regulations (article VI of this chapter) and conforms in all respects with all requirements of this Code, including the zoning regulations and this article. The proposed subdivision is consistent with all zoning regulations. Lot size and lot width meet the ordinance requirements. 2. The proposed subdivision is consistent with all applicable general and specialized city, county, and regional plans, including, but not limited to, the city's comprehensive development plan. The physical characteristics of the site, including but not limited to topography, soils, vegetation, susceptibility to erosion and siltation, susceptibility to flooding, and drainage are suitable for the type and density of development and uses contemplated. The proposed subdivision makes adequate provision for water supply, storm drainage, sewage transportation, erosion control and all other services, facilities and improvements otherwise required in this article. The subdivision includes infrastructure to meet city requirements. The project is on CSAH 33, which is anticipated to be turned back to the city, so the county has no access spacing concerns. Additional permits required to comply with erosion control standards maybe required and will be secured prior to building permit issuance. 5. The proposed subdivision will not cause substantial environmental damage. Although trees may be removed, the subdivision will not cause substantial environmental damage. The wetland setback and buffer requirements must be met with all future development. A wetland delineation was approved for this site in May of 2021. The drainage and utility easement should be updated to be located at the 45’ wetland setback. Structures and driveway are not permitted within this setback. Applicant should show driveway and home location before plat is recorded to ensure all setbacks are met. 6. The proposed subdivision will not conflict with easements of record or with easements established by judgment of a court. The proposed subdivision will not have an undue and adverse impact on the reasonable development of neighboring land.
