Call Meeting to Order Pursuant to due call and notice thereof, the meeting of the Elk River Planning Commission was called to order at 6:30 p.m. by Chair Larson -Vito. 2. Pledge of Allegiance The Pledge of Allegiance was recited. 3. Consider November 23, 2021, Planning Commission Agenda Moved by Commissioner Johnson and seconded by Commissioner Keisling to approve the November 23, 2021, Planning Commission agenda. Motion carried 6-0. 4. Consider October 26, 2021, Planning Commission Minutes Moved by Commissioner Beise and seconded by Commissioner Booth to approve the October 26, 2021, Planning Commission minutes. Motion carried 6-0. 5.1 City of Elk River ■ Amending Section 30-1024, Highway Commercial District to include Kennel, Commercial, Case No. OA 21-02 Mr. Leeseberg presented the staff report. Chair Larson -Vito opened the public hearing. Planning Commission November 23, 2021 There being no one to speak, Chair Larson -Vito closed the public hearing. Page 2 Moved by Commissioner Beise and seconded by Commissioner Keisling to recommend approval of the request by City of Elk River for an Amendment to Section 30-1024, Highway Commercial District to include Kennel, Commercial, as outlined in the staff report. Motion carried 6-0. 5.2 Doggy Stylez Pet GroominglMouafeng Lo, 920 US Highway 10 Conditional Use Permit for Commercial Kennel, Case No. CU 21-17 Mr. Leeseberg presented the staff report. Chair Larson -Vito opened the public hearing. There being no one else to speak, Chair Larson -Vito closed the public hearing. Moved by Commissioner Rydberg and seconded by Commissioner Booth to recommend approval of the request by Doggy Stylez Pet Grooming and Mouafeng Lo for a Conditional Use Permit for Commercial Kennel with the following conditions: 1. Ordinance Amendment (OA 21-02) shall be approved by the City Council. 2. Prior to recording, the city's Building Official and Fire Marshal shall inspect the building for compliance with all state and local building codes. 3. The authorized Conditional Use Permit shall be recorded, and the use shall not begin prior to recording. 4. Animals shall only be allowed outside under direct supervision. 5. No more than four (4) animals per supervisor shall be allowed outside the fenced area and must be leashed at all times. 6. Outdoor play shall not be used before 7:00 a.m. or after 9:00 p.m. 7. The outdoor play area will be screened by a six-foot opaque fence. Vinyl, or other, slats in chain link fencing shall not be used. 8. Noise shall be mitigated to not create a public nuisance for adjoining properties. If a dog continuously barks, it must be brought inside. 9. A commercial kennel license from the City of Elk River must be obtained. Motion carried 6-0. 5.3 Cargill Animal Nutrition Center, 10383 • Conditional Use Permit for an Agricultural 21-16 Mr. Carlton presented the staff report. 165' Ave. NW Research Facility, Case No. CU VURE Planning Commission Page 3 November 23, 2021 Councilmember Beyer asked for clarification with the tree requirements. Mr. Carlton explained the applicant submitted a landscape plan that includes a new vegetated buffer screening the existing office building and access drive along with detailed landscaping near the new facility and parking area. He stated ordinance requires a total of 63 trees, including a mix of overstory, evergreen, and ornamental varieties as well as allows native grass areas to satisfy up to half of the landscaping requirements. Therefore, the proposed plan will satisfy the city's landscaping requirements. Chair Larson -Vito opened the public hearing. There being no one to speak, Chair Larson -Vito closed the public hearing. Commissioner Rydberg asked about waiving the curb and gutter requirements. He recalled the City Council has waived those requirements in certain cases. Mr. Carlton explained the applicant is requesting to have that requirement waived by the City Council and staff supports the request as this is a large agricultural facility in a rural location. They would maintain/install curbing at vehicular and pedestrian areas such as where sidewalks meeting parking areas. Chair Larson -Vito noted specific conditions for this were not included and asked if they would be presented at the City Council meeting. Mr. Carlton stated those would be reviewed by the City Council. Commissioner Rydberg noted the property is in a private, rural area and there is not much pedestrian traffic. Moved by Commissioner Beise and seconded by Commissioner Keisling to recommend approval of the request by Cargill Animal Nutrition Center for an Agricultural Research Facility with the following condition: 1. All site, civil, and architectural plans are approved by staff. Motion carried 6-0. 5.4 Tall Pines 11, LLC — 18409 Line Ave. NW ' ■ Conditional Use Permit Establishing a Planned Unit Development (P.U.D.), Case No. CU 21-09 ■ Preliminary Plat of Tall Pines P.U.D. Third Addition, Case No. P 21-08 Mr. Carlton presented the staff report. Commissioner Keisling asked about the conditions from the previous project submitted and if there were any differences. l a I E l E l 1 1 NATURE Planning Commission November 23, 2021 Page 4 Mr. Carlton stated the conditions are essentially the same as the previous submitted application. Moved by Commissioner Rydberg and seconded by Commissioner Keisling to recommend approval of the request by Tall Pines 2 LLC for a Conditional Use Permit Establishing a PUD, with the following conditions: 1. A PUD Agreement shall be developed and signed by both parties prior to issuance of a building permit. 2. Streets and access must comply with MN State Fire Code Chapter 5 and Appendix D. 3. Provide detail connections to sewer and water systems and ensure the watermain is looped. 4. Staff approval of all site, utility, engineering, and landscaping plans. 5. Hydrants must be spaced to ensure all portions of a residence are within 250 feet of a hydrant. 6. DNR approval of all wetland permits related to the proposed wetland fill. 7. A homeowner's association must be established, subject to review and approval of the city attorney, and shall be responsible for all landscaping, snow clearing, and regular maintenance of private drives and driveways. 8. Adjacent homes shall not be the same color. 9. No more than two of the same fagade design/details shall be adjacent to one another. 10. Provide a trail connection from the end of the private cul-de-sac to the trail along the west side of Twin Lakes Road or to the development to the north. 11. Mailboxes shall be clustered and located on the private street. 13. Construct a sidewalk from the south side of the entrance to Tall Pines PUD Second Addition to the south side of this project area. Motion carried 6-0. Moved by Commissioner Johnson and seconded by Commissioner Beise to recommend approval of the request by Tall Pines 2 LLC for the Preliminary Plat of Tall Pines Third Addition P.U.D. on the condition that the Council approves the Conditional Use Permit (CU 21-08). Motion carried 6-0. Chair Larson -Vito opened the public hearing. There being no one to speak, Chair Larson -Vito closed the public hearing. Moved by Commissioner Johnson and seconded by Commissioner Booth to recommend approval of the request by the City of Elk River to change the zoning of Natures Edge Business Center Third Addition from AR (Agricultural Reserve) to BP (Business Park). Motion carried 6-0. 6. General Business Mr. Carlton indicated Commissioner Rydberg will attend the December 20, 2021, City Council meeting. Mr. Carlton indicated Commissioner John Jordan has resigned from the Planning Commission effective immediately. 7. Council Liaison Update Councilmember Beyer provided an update to the Planning Commission about recent city council activities. 8.
