SR 09-12-2005 **Item 3.4.** MEMORANDUM TO: Mayor and City Council FROM: Lori Johnson, Finance and Administrative Services Director DATE: September 12, 2005 SUBJECT: Consider Resolution Designating the Maximum Household Income level for Qualification for Deferral of Special Assessments Based on Hardship Cllapter 62, Section 1 of the Elk River City Code addresses the deferral of special assessments. Citizens may defer special assessments if they are 65 years of age or older or retired by virtue of permanent and total disability. In order to be eligible for the deferral, the applicant must meet the 11ousellold income le,\Tels as established by resolution annually by the City Council. Action Requested The City Council is asked to adopt the attached resolution designating the maximum housello1d income le\Tel for qualification for the deferral of special assessments based on hardsllip. $: \ Council \Lori \2005 \Sp ecialAsscss De fcrral.doc RESOLUTION 05-_ A RESOLUTION FOR THE CITY OF ELK RIVER A RESOLUTION DESIGNATING THE MAXIMUM HOUSEHOLD INCOME LEVEL FOR QUALIFICATION FOR DEFERRAL OF SPECIAL ASSESSMENTS BASED ON HARDSHIP WHEREAS, Section 62-1, Deferral of Special Assessments, of the Code of Ordinances for the City of Elk River, Minnesota, states that the Council shall annually approve, by resolution, a maximum household income level in order to qualify for deferral; and, WHEREAS, the City Council has determined that the maximum household income allowable in order to qualify for deferral of special assessments based on hardship, assuming that the other qualifications are also met, is as follows for 2005: Household Size I 2 3 4 5 Maximum Annual Gross Income $18,819 $24,609 $30,399 $36, 190 $41,980 NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Elk River, Minnesota, that in order to qualify for deferral of assessments based on hardship in 2005, the above household income requirements must be met.
