RESOLUTION NO. 05-92
A RESOLUTION DENYING AN AMENDMENT TO THE COMPREHENSIVE PLAN
TO CHANGE THE LAND USE FROM OS (OPEN SPACE) TO UR (URBAN
RESIDENTIAL)
Case No. LU 05-04
WHEREAS, :Minnesota Statutes, Chapter 462.355, Subdivision 2, prescribes the procedure
for amending the Comprehensive Plan, and
WHEREAS, the Planning Commission held a public hearing on Tuesday, August 9, 2005
and recommended denial regarding the Comprehensive Plan amendment request for the property
generally described as:
Outlot A and Outlot B, Pinewood Estates,
Sherburne County, Minnesota
and,
WHEREAS, the City Council has reviewed the Comprehensive Plan amendment request
and finds the following:
1. The OS land use designation is consistent with the R1c zoning district in that the
golf courses is an open space land use and is allowed as a conditional use in the R1c
zoning district.
2. The OS land use is consistent with the current use of the property. The applicant has
not presented information to show that the OS land use is not appropriate for this
parcel.
3. The applicant did not show evidence the golf course was not economically viable.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City denies the
request to amend the Land Use Plan to change the property as described above from OS (Open
Space) to UR (Urban Residential).
PASSED by the City Council of the City of Elk River this 15th day of August, 2005.
