Commission was called to order at 7:00 p.m. by Chair Dillon.

Commissioner Kuester will attend the May 20,1996 City Council Meeting.
Staff report by Kendra Lindahl. Diane Bistodeau is requesting a Conditional Use
Permit to operate a hair salon out of the basement of her home located at
20806 York Street NW. The business requires a conditional use permit because it
involves construction features not normally found in a residential dwelling and it
will be serviced by a delivery vehicle on a regular basis. Ms. Bistodeau will be
the only employee. Hours of operation are Monday through Thursday 9:00 a.m.

to 9:00 p.m. and Saturdays from 9:00 a.m. to 1 :00 p.m. by appointment only. The
ordinance allows home businesses to operate between the hours of 7:00 a.m. to
10:00 p.m. No more than two customers will be parking at the salon at one
time. Ms. Bistodeau is proposing to use an existing class five driveway and
parking area in the back of the house and will be wheel chair accessible.
Chair Dillon opened the public hearing. There being no comments from the
public, Chair Dillon closed the public hearing.
Commissioner Minton stated that he is concerned over complaints and
wondered if we would have any recourse.
COMMISSIONER THOMPSON MOVED THE PLANNING COMMISSION RECOMMEND
APPROVE OF THE REQUEST BY DIANE BISTODEAU FOR A CONDITIONAL USE PERMIT
FOR HAIR SALON, PUBLIC HEARING CASE NO. CU 96-4, BASED ON THE FINDINGS IN
THE STAFF REPORT, AND THE FACT THERE WAS NO OPPOSITION DURING THE PUBLIC
HEARING, SUBJECT TO THE FOLLOWING CONDITIONS:
1. HOURS OF OPERATION BE FROM 7:00 A.M. TO 10:00 P.M. AS PER CITY
CODE.
2. NO EXTERIOR STORAGE RELATED TO THIS BUSINESS SHALL BE ALLOWED.
3. SIGN AGE WILL BE LIMITED TO TWO SQUARE FEET AND MOUNTED FLAT ON

Staff report by Scott Harlicker. Kober Excavating Inc. has requested a
conditional use permit for outdoor storage located at 16110 Jarvis Street NW.
The property is zoned 1-2 (Medium Industrial) and the surrounding properties are
also zoned 1-2. The property contains a house, small garage and two storage
sheds. To the rear of the house and garage is a shop facility and outdoor
storage area. The applicant, Kober excavating and the current owner Mr.
Johnson are planning on subdividing the property in the fall of 1996 into two lots
with the intention of the applicant purchasing the shop and outdoor storage
area on one lot and Mr. Johnson retaining ownership of the residence on the
other. A 12 foot wide paved access will be installed and a paved parking area
with four parking spaces on the south side of the shop adjacent to the fenced in

storage area. Mr. Alan Lafontaine, of Kobar Excavating, is proposing to screen
the outdoor storage area with a fence. The zoning code requires the fence to
be 100% opaque and not less than five feet high. Landscaping is also required
and should be used to supplement the screening that the fence provides, 25
trees are required. The applicant wants to delay putting in the driveway and
fence so Mr. Lafontaine can combine it all together in his loan.
Chair Dillon opened the public hearing. There being no comments from the
public, Chair Dillon closed the public hearing.
Commissioner Kuester asked how many employees will be there at one time. Mr.
Lafontaine stated he has 16 employees but only 3 will be there at one time.
Chair Dillon is concerned about 2 vehicles coming in at the same time because
the driveway is only 12 feet wide.
Commissioner Minton asked if Mr. Lafontaine is willing not to have outdoor
storage until the fence is up. Mr. Lafontaine stated he has to have the outside
storage.
Peter Beck, City Attorney stated Mr. Lafontaine should have a letter of credit
stating when the landscaping, fence and asphalt will be done.
COMMISSIONER MINTON MOVED THE PLANNING COMMISSIONER RECOMMEND
APPROVAL OF THE REQUEST BY KOBAR EXCAVATING FOR CONDITIONAL USE
PERMIT FOR OUTSIDE STORAGE, PUBLIC HEARING CASE NO. CU 96-5, BASED ON
THE FINDINGS IN THE STAFF REPORT, AND THE FACT THERE WAS NO OPPOSITION
DURING THE PUBLIC HEARING, SUBJECT TO THE FOLLOWING CONDITIONS:
1. ANY EXPANSION OR UPGRADING OF THE SHOP OR OUTDOOR STORAGE
AREA WILL BE CAUSE TO REVISIT THE SITE TO ENSURE THAT THERE IS
ADEQUATE PARKING AND ACCESS.
2. THE APPLICANT SHALL SUBMIT FENCE DETAILS AND A LANDSCAPE PLAN FOR
APPROVAL PRIOR TO THE ISSUANCE OF THE CONDITIONAL USE PERMIT.
3. THE APPLICANTS SHALL CONSTRUCT THE APPROVED FENCE WITHIN TWO
MONTHS OF SEASONABLE WEATHER AFTER THE SUBDIVISION IS COMPLETED
LANDSCAPING AND PAVING SHALL BE COMPLETED.
4. SHOULD PARKING PROBLEMS OCCUR, THE APPLICANT SHALL INSTALL THE
DEMONSTRATED PARKING AREA AT THE CITY'S REQUEST.

AREA BETWEEN THE SHOP AND THE RESIDENTIAL GARAGE PRIOR TO

Staff report by Steve Ach. Sf. Andrews Catholic Church is requesting a
conditional use permit to construct a church addition to its existing facility
located at the northeast corner of Irving Street and 4th Avenue. This area is
zoned Rlc (Single Family Residential) and R2 (Two Family Residential) / MR
(Medium Density Residential). The new church will be approximately 23,000
square feet and initially have 1,000 seats, expandable to 1,500 seats. Along with
the church, a new parking lot facility and upgrading of their current parking
facilities will be included. To complete construction of the new church and
parking lot, THE existing house on site will need to be removed. The existing
school, rectory, youth center and church will remain on site.
The church is bordered on the west and south by residential streets. Proper
buffering along the north edge of the property will be recommended as part of
the site improvements.
The zoning ordinance requires one parking space per three seats of the main
seating area. Based on 1,000 seats proposed at this time, 333 on site parking
spaces would be required. However, the church will not be able to provide the
required number of stalls on-site; therefore will have to utilize the on street
parking on Irving and 4th Street. The church also has parking spots located at
the Mork Clinic.
Steve Ach summarized some of the outstanding issues relating to the site plan.
. In order to define primary drive aisles and provide for some landscaping
opportunities within the parking area, it is recommended that some
landscape/traffic control islands be installed within the parking area.
. Based on the number of parking stalls on site, two additional handicap
stalls may be required.
. The eastern-most entrance onto 4th Avenue would be best located to
align with Holt A venue immediately to the south. This will avoid any
minimal offsets and improve traffic circulation. This may require
relocating a street light and street sign.
. The new entrance onto Gates A venue is wide enough to accommodate
one lane entering the site and two exiting. This certainly will improve the
ability for vehicles leaving the site; therefore, staff would recommend
extending the widened section a little bit further west to improve the
stacking distance for both the left and right hand turn move leaving the
church onto Gates A venue.

The angled parking along 4th Avenue includes a couple of stalls at each
end of the row that should probably be removed and striped for no
parking. Removing these stalls will improve visibility as vehicles are

traveling in and out of the angled parking area, as well as along the
other drive aisles and on adjacent public streets.

Concrete curb and gutter is proposed throughout a majority of the
parking lot. The one exception to this is the eastern edge of the new
parking facility which is planned to be expanded at some future date.
Therefore, this section will be constructed with a bituminous curb that
can be easily removed along with the expansion plans. Otherwise, all
parking areas which would not change with any future expansion plans
will be completed with curb and gutter.

Additional improvements are also proposed along 4th Avenue where at
this time, the church utilizes a portion of public right-of-way for parking
and there is no clear definition, (Le. curb, landscaping) between the on
site parking area and 4th A venue. The proposed improvements would
include a landscaped median with curb and gutter to separate the
angled parking from the traffic on 4th A venue.

The new driveway along the north property line that extends from the
new parking lot to Gates A venue will at some point intersect with an
existing residential driveway from a house at the northeast corner of the
property. Based on the plans that have been submitted, it is uncertain
how this driveway intersects with the proposed driveway and how those
two driveways will compliment one another. Further detail will need to
be submitted identifying any adjustments that may be necessary as part
of this project.
. Throughout St. Andrews' campus are a variety of existing trees. The plan
identifies approximately 31 existing trees and approximately 27 being
proposed along with the expansion plans. Based on these numbers, the
City's landscaping requirements are being satisfied.
. It is not mentioned on the plans how high the light pole will be
throughout the parking area. The one area of primary concern are the
light poles along the north edge of the parking lot which again, may
cause some conflict with the overhead power lines.
. Bruce West, Fire Chief stated in his memo to the Commission that there
shall be two additional hydrants located within the church complex.
Chair Dillon opened the public hearing.
Dennis Murray, 524 4th Street, stated he would like to see hedging and fencing.
Mr. Murray would also like to see the pond sprayed for mosquitoes. Mr. Murray
also would like to make sure the parking lot lights are facing the parking lot.
Commissioner Minton stated the lights usually shine down to the parking lot and
is in favor of landscaping.

Carry Lyons, VanMan Construction stated the light standards are 30 feet high
and lights are usually directed down towards the parking lot. St. Andrews
Church stated they would spray the pond if necessary and put in the
landscaping for Mr. Murray.
Commissioner Minton asked how they will expand on the 1,500 seating. Mr.
Lyons, VanMan Construction stated the seating will be added within the
proposed building.
Commissioner Minton asked if there would be a problem regarding the driveway
on 4th Street to align with Holt Ave. Mr. Lyons stated that would not be a
problem and that 2 to 3 parking spots would be lost.
Commissioner Sullivan asked if the property owner with the merging driveway
has any idea about merging their driveway with the church. A representative
from St. Andrews Church stated the resident does not know we need to do this.

Staff report by Kendra Lindahl. Stephen Rohlf is requesting a 5 foot variance on
the required 10 foot side yard setback and a 2 foot variance on the required 30
foot front yard setback. The variance is requested in order to expand the
existing deck located at 12821-188th Avenue NW. The applicant is now
proposing to add an 8' x 9' addition to the existing deck. This addition will
require him to encroach 5 feet into the side yard setback and 2 feet into the
front yard setback. Mr. Rohlf stated the variance is considered a hardship and
the deck will allow the applicant to see his children in the play area on the
opposite side of the house. The applicant also believes that this additional 2
feet will allow him a usable deck area without cutting down the tree in the front

yard. The tree will be made part of the deck expansion. There is an
underground stream running through the property which required that the
home crowd the west lot line.
Chair Dillon opened the public hearing. There being no comments for the
public, Chair Dillon closed the public hearing.
Commissioner Minton is not impressed with extending the deck 2 feet just to see
the children on the other side. Commissioner Thompson does not like the idea.
Commissioner Thompson does not think this request is a hardship. Commissioner
Dillon would like to see the tree kept in the plans.

Commissioner Minton stated the City of Elk River is looking for the best way to let
Cargill do operations the way it has been done. We want a balanced growth
for the community.
Tim Thomas, Attorney for Cargill, stated Cargill has no intentions of every leaving
Elk River.
staff report by Scott Harlicker. The City of Elk River is requesting to amend
Section 900.12, Section 900.18 and Section 908.06 of the City of Elk River Code of
Ordinances relating to permitted and conditional uses in the agricultural and
single family residential zones, dimensional regulations for accessory uses and
setbacks for stables, barns, and agricultural fences.

At the March 26,1996 Planning Commission meeting, the Commission discussed
a variance application to the required 300 foot setback and a conditional use
permit to have a horse. As a result of this application the following issues were
raised: the difficulty of complying with setbacks from something over which they
have not control, the size of the setback and the issue of differentiating between
platted and unplatted property when determining if a conditional use permit is
needed.
Commissioner Kuester had questioned whether a horse is a hobby or an
agricultural animal. Steve Ach, City Planner stated according to the State of
Minnesota a horse is considered an agricultural animal.
Scott Harlicker stated the current method of measuring the setback of an
agricultural building from an adjacent residential structure can cause problems.
It does not allow a property owner to plan out or phase development of their
property regarding placement of an agricultural building and fence. Their plans
hinge on where their neighbor places their house or constructs an addition. By
measuring the setback from a fixed point, like principle structures and other
accessory structure are, the uncertainty of not knowing if they will be able to
complete their plans is removed. The current setback requirements are 300 feet
for agricultural structures and 200 feet for livestock fences.

The current Ordinance has two criteria that are used to determine if an
agricultural use is a permitted use or a conditional use, size of the property and
whether the property is platted or unplatted. In the A-1 and R 1 a zones, the
minimum lot size required to have agricultural activity (Le. horses) as a permitted
use is five acres on unplatted property. If the property is platted, no matter how
large the lot is, agricultural uses require a conditional use. In the other single
family residential zones, agricultural uses are only allowed as a conditional use
on 10 unplatted acres.

This can result is some very unusual situations. In the A-1 zone, where the
minimum lot size is ten acres, a person could have a 10 to 15 acre platted
parcel and still be required to obtain a conditional use to have horses and the
neighbor, with only 5.5 acres of unplatted property, could have horses as a
permitted use. To a lesser extent, the same type of situation could also happen
the R 1 a zone; two neighbors could have similar sized parcels and if one is
platted and the other is not, the unplatted lot could have a horse as a
permitted use and the platted lot would require a conditional use permit.

USES), PUBLIC HEARING CASE NO. OA 96-6 AND REQUEST BY CITY OF ELK RIVER
FOR ORDINANCE AMENDMENT (PLATTED/UNPLATTED RELATED TO AGRICULTURAL
USES), PUBLIC HEARING CASE NO. OA96-5, BASED ON THE FINDINGS IN THE STAFF
REPORT AND THE FACT THERE WAS NO OPPOSITION DURING THE PUBLIC HEARING,
TO APPROVE THE CODE AMENDMENTS AS PRESENTED IN THE ATTACHED
ORDINANCE AND TO AMEND THE 30 FOOT SETBACK TO 5 FEET FROM THE REAR OF

Staff report by Scott Harlicker. The City of Elk River is requesting to amend
Section 900.03 and Section 900.12 of the City Ordinance relating to definitions,
light industrial uses, medium industrial uses and highway commercial uses.
The purpose of the 1-1 District is to serve as a transition between more industrial
uses, residential and other business uses. The district is appropriate for
manufacturing, warehousing and similar industrial uses. The industries should be
compatible with each other and with surrounding land uses. The 1-2 District, on
the other hand, is intended to accommodate more intense manufacturing and
processing than would be allowed in the 1-1 District. These uses may tend to
generate more off-site impacts than those allowed in the 1-1 District.
In an attempt to develop a list of allowable uses that better reflect the stated
purposes of the two industrial districts, staff reviewed other ordinances and
incorporated some of the uses found in those ordinances with uses found in Elk
River's ordinance. The result can be found in the following list of suggested
allowed uses.
Commissioner Minton suggested relabeling 1-2 to heavy manufacturing rather
than medium manufacturing.

staff report by steve Ach, City Planner. The City of Elk River is bringing forward
an ordinance amendment to consider deleting the requirement that
commercial and industrial development within the urban service district be
required to hook up to city water and sewer in order for development. The
primary issue is whether to continue with a fundamental growth management
strategy which controls commercial and industrial development from occurring
unless water and sewer is available. Or, to amend the current ordinance to
provide the opportunity for commercial, industrial and business park
development to occur prior to the availability of city water and sewer.
The Fire Chief has included a memo speaking to the department's concern with
development without adequate fire protection.

The goal of the Fire Department is to lower (improve) the City's rating both in the
urban and rural area. In order for this to occur additional equipment may need
to be purchased to adequately fight fires in the rural area.
If the desire of the Planning Commission is to amend the ordinance, one option
is to require a conditional use permit with certain criteria to allow development
prior to city water and sewer. The City Council is also looking at an appraisal
and public hearing for the East Highway 10 corridor for water and sewer. This
may shed new light on this entire matter; therefore another option is to table this
item until those events are completed.
Commissioner Anderson would like to discuss this issue further.

COMMISSIONER SULLIVAN SECONDED THE MOTION. THE MOTION CARRIED 6-0.

Commissioner Kuester stated the Minnesota Planning Association will be
sponsoring a meeting at the old Otsego City Hall from 6-9 p.m., Thursday, May 9,
1996. The cost is $15.00 per person. The topic is "The World Becoming Urban" .

Steve Ach, City Planner stated the Commission should set up a date for a mobile
tour.
Chair Dillon stated all Commissioners should let steve Ach or Commissioner Dillon
know about any vacations planned on scheduled meeting nights.
There being no further business, COMMISSIONER KUESTER MOVED TO ADJOURN THE
MEETING. COMMISSIONER THOMPSON SECONDED THE MOTION. THE MOTION CARRIED
6-0.
