MEETING OF THE ELK RIVER PLANNING COMMISSION t/EI II
HELD AT ELK RIVER CITY HALL
TUESDAY, JANUARY 25, 1994 .
Members Present:
Chairman Tveite, Commissioners Eberley, Kreger, Kuester, Minton,
and Tacheny.
Members Absent:
Commissioner Kuester arrived at 8: 15 p.m.

1. Call Meetina To Order
Pursuant to due call and notice thereof, the meeting of the Elk River Planning
Commission was called to order at 7 p.m. by Chairman Tveite.

COMMISSIONER EBERLEY MOVED TO APPROVE THE 1/26/94 PLANNING
COMMISSION AGENDA. COMMISSIONER KREGER SECONDED THE MOTION. THE
MOTION CARRIED 5-0.

Consider Plannina Commission Minutes
Commissioner Eberley noted that on Page 3, Item 7 of the December 28, 1994,
Planning Commission minutes, the motion should contain "THIS IS AN ACCESSORY
FACILITY TO THE GOLF COURSE AND THE GOLF COURSE (AS A WHOLE) MEETS THE
CURRENT LANDSCAPING REQUIREMENTS PER CITY CODE."
Commissioner Minton noted that Item 11 should contain a change reflecting that
overhead doors can be placed in the front and/or side yard setbacks.
COMMISSIONER MINTON MOVED TO APPROVE THE 12/28/93 PLANNING
COMMISSION MINUTES. COMMISSIONER EBERLEY SECONDED THE MOTION. THE
MOTION CARRIED 4-0, CHAIRMAN TVEITE ABSTAINED AS HE WAS NOT PRESENT AT
THE DECEMBER PLANNING COMMISSION MEETING.
4. Plannina Commission Representative to Attend City Council Meetina
It was indicated Commissioner Minton would attend the February 17, 1994, City
Council meeting to be held at Elk River City Hall.

Consider Conditional Use Permit by Schmitz-Kornovich/Public Hearing. Case No.
CU 93-41

Staff report presented by Steve Ach. The applicant, Schmitz-Kornovich,
requested a conditional use permit to develop a 68 unit apartment project as a
Planned Unit Development (PUD).

Chairman Tveite opened the public hearing. There being no comments from the
public, Chairman Tveite closed the public hearing.
There was discussion among the Commissioners relating to: parking and garage
stalls, grading and drainage issues, traffic circulation regarding emergency
vehicles, ground water concerns, driveway access, possible bituminous drive,
brick or landscaping on the back of the project, and improvements. Staff and
the applicant responded to the above issues.
COMMISSIONER MINTON MOVED TO RECOMMEND APPROVAL OF THE
CONDITIONAL USE PERMIT BY SCHMITZ-KORNOVICH, CASE NO. CU 93-41, TO
DEVELOP A 68 UNIT APARTMENT PROJECT, BASED ON INFORMATION PROVIDED TO
THE PLANNING COMMISSION AND CITING STAFF'S MEMO DATED JANUARY 25, 1994.
THE REQUEST MEETS THE SEVEN STANDARDS FOR GRANTING A CONDITIONAL USE
PERMIT AND IS CONSISTENT WITH THE COMPREHENSIVE PLAN. APPROVAL IS
RECOMMENDED WITH THE FOLLOWING CONDITIONS:
1. PLANS BE REVISED IN ACCORDANCE WITH TERRY MAURER'S MEMO DATED
JANUARY 12, 1994.
2. ENTIRE PARKING AREA BE BOUNDED WITH B612 CONCRETE CURB AND GUTTER.

LANDSCAPE MATERIAL HAVE THE MINIMUM SIZES:
OVERSTORY TREES - 2" CAL. BALLED AND BURLAP
CONIFERS - 6 FEET IN HEIGHT BALLED AND BURLAP
ORNAMENTAL TREES - 2" CAL. BALLED AND BURLAP
SHRUBS - AS NOTED ON LANDSCAPE PLAN
4. DEVELOPER MAKE NECESSARY IMPROVEMENTS TO ENTRANCE DRIVE FROM
SCHOOL STREET ASSURING THE INTEGRITY IS NOT DIMINISHED DUE TO APARTMENT
TRAFFIC. THESE IMPROVEMENTS SHOULD CONSIDER CURB AND GUTTER AND BE
APPROVED BY THE CITY ENGINEER.
5. TWO DUMPSTERS BE PROVIDED ON SITE WITH ENCLOSURES CONSISTING OF A
MASONRY MATERIAL MATCHING THE BUILDING.

PARKING AREA ON THE SOUTH END OF THE BUILDING BE REDESIGNED TO IMPROVE
VEHICLE CIRCULATION.
FIFTEEN ADDITIONAL GARAGE STALLS NEED TO BE PROVIDED.
TEN (10) FOOT DRAINAGE AND UTILITY EASEMENT BE PROVIDED AROUND THE ENTIRE
PERIMETER OF THE PROPERTY.
AN ON-SITE FIRE HYDRANT BE PROVIDED AND LOCATION APPROVED BY THE FIRE
CHIEF PRIOR TO ISSUING A BUILDING PERMIT.
REVISED PLANS BE APPROVED BY THE CITY PRIOR TO ISSUING A BUILDING PERMIT.

THE DEVELOPER AGREE TO ENTERING INTO A CROSS ACCESS AGREEMENT WITH THE
ADJACENT PROPERTY TO THE WEST FOR THE EXTENSION OF A DRIVEWAY TO
PROCTOR AVENUE.
12. ALONG THE WEST ELEVATION OF THE BUILDING, EITHER A CONTINUATION OF BRICK
OR THE ADDITION OF FOUNDATION SHRUBS BE PROVIDED.
COMMISSIONER KREGER SECONDED THE MOTION. THE MOTION CARRIED 5-0.
6 & 7. Consider Land Use Amendment Request by Marv Prochaska, Public Hearinq,
Case No. LUA 93-1 , and Land Use Amendment Request by Country Ridqe
Partnerships, Public Hearinq, Case No. LUA 93-2
Staff report presented by Steve Ach. Mr. Ach explained that planning cases
numbers LUA 93-1 and LUA 93-2 would be incorporated into one report and
presented together due to the similar type of request, proximity to one another,
and both sharing the same planning issues. The two applications include a 20
acre parcel and a 24 acre parcel, lying west of Joplin Street alignment and east
of Sherburne County Government Center.
Jay Johnson, 2619 Coon Rapids Boulevard, Coon Rapids, stated that he feels the
proposed use is appropriate for this area.

Gary Colby, Project Manager with Menards, stated that due to the PUD, the City
will have a lot of input in the proposal. Menards would also like to bring in other
users, Le., shopping mall.
Chairman Tveite opened the public hearing.
Spencer Pierce, 13700-182nd Avenue, Elk River, expressed concern regarding the
land use change to Highway Business due to the increase in traffic noise.
David Raymond, 13686 Riverview Drive, Elk River, feels this type of use does not fit
into this area - a residential neighborhood.
Shari Patterson, 18363 Naples, Elk River, opposed to the proposed project due to
increased noise levels, additional lights, etc.
Lynn Endorf. 13747-183rd Avenue, Elk River, stated opposition to the proposed site,
not to having a Menards in Elk River.
Patrick Dwyer, 11960-194th Circle, Elk River, Chairman of the Business Park Task
Force, outlined the history of the Task Force. Mr. Dwyer stated that the Task Force
is not opposed to a Menards, however, there was concern regarding loosing
industrial property sites. In addition, the Task Force is in the process of a grant
proposal (which must be site specific) regarding this site.
Commissioner Kuester arrived at this time, approximately 8: 15 p.m.

Jay Johnson discussed offering the Business Park 20 acres south of the east parcel
and a restaurant along the highway.

David Raymond, 13686 Riverview Drive, Elk River, asked if this project would be
the same sizE? as the Golden Valley project. Gary Colby responded: it would be
similar in size, approximately 145, 000 square feet in size.
Steve Stewart, 18290 Ogden, Elk River, stated he is opposed to the proposed
project.
Gary Colby, Project Manager with Menards, explained to the Planning
Commission the size of property needed for this request and stated that no other
site along Highway 169 would be appropriate.
Ross Berglove, 13117-182 Avenue, Elk River, believes this proposal would be better
than some industrial projects in this area and urged the Planning Commission to
look closely at this type of use.
Steve Ach commented on the intended use for Business Park and that Highway
Commercial was designed to support the Business Park. This area was not
intended for Highway Business.
There being no further comments from the public, Chairman Tveite closed the
public hearing.

Commissioner Eberley commented on the Focus Area Study and the need to
focus on "balance" within the community and the need to plan for the future,
not just the present needs.
Commissioner Minton stated that he was surprised that there is not a site along
Highway 1 69 that Menards could consider and that he is not inclined to change
the land use to Highway Business.
A discussion among the Commissioners ensued.
COMMISSIONER KREGER RECOMMENDED DENIAL OF THE LAND USE AMENDMENT BY
MARV PROCHASKA, PUBLIC HEARING, CASE NO. LUA 93-1, NOTING SIGNIFICANT
PUBLIC OPPOSITION, CITING STAFF'S MEMO, AND STATING THE REQUEST IS NOT
CONSISTENT WITH THE COMPREHENSIVE PLAN. COMMISSIONER EBERLEY ADDED
THAT INFORMATION FROM MR. DWYER SHOULD BE CONSIDERED AS PART OF THE
FINDINGS OF FACT. COMMISSIONER MINTON SECONDED THE MOTION. THE
MOTION CARRIED 5-0.
COMMISSIONER KREGER RECOMMENDED DENIAL OF THE LAND USE AMENDMENT BY
COUNTRY RIDGE PARTNERSHIP, PUBLIC HEARING, CASE NO. LUA 93-2 , NOTING
SIGNIFICANT PUBLIC OPPOSITION, CITING STAFF'S MEMO, MR. DWYER'S TESTIMONY,
AND STATING THE REQUEST IS NOT CONSISTENT WITH THE COMPREHENSIVE PLAN.
COMMISSIONER TACHENY SECONDED THE MOTION. THE MOTION CARRIED 5-0.
8.
Consider an Ordinance Amendment to Amend Various Sections of the Zonina
Ordinance Relatinq to Accessory structures, Public Hearinq, Case No. OA 94-1
.
Staff report presented by Gary Schmitz, for the City of Elk River, to amend Section
900.20, Section 900.12, and Section 900.18 of the City Code related to accessory
structures.

Chairman Tveite opened the public hearing.
Commissioner Kreger commented on the attractiveness of modern metal skin
buildings and suggested the Planning Commission take the time to view newer
metal skin buildings within the community. Commissioner Kreger also requested
staff research possible architectural standards for metal skin structures.
David Raymond, 13686 Riverview Drive, Elk River, agreed with Commissioner
Kreger and stated he is in favor of allowing metal skin buildings.
Discussion ensued among the Commissioners
COMMISSIONER KREGER MOVED TO CONTINUE THIS ITEM AND THE PUBLIC HEARING
UNTIL THE FEBRUARY 22, 1994, PLANNING COMMISSION MEETING TO ALLOW
FURTHER RESEARCH. COMMISSIONER MINTON SECONDED THE MOTION. THE
MOTION CARRIED 5-0.
9. Other Business
Commissioner Eberley requested an update from staff regarding Custom Motors
at the next Planning Commission meeting.
10.

There being no further business, COMMISSIONER EBERLEY MOVED TO ADJOURN THE
MEETING. COMMISSIONER MINTON SECONDED THE MOTION. THE MOTION
CARRIED 5-0.
