03-29-1994 PC MIN . MEETING OF THE ELK RIVER PLANNING COMMISSION HELD AT ELK RIVER CITY HALL TUESDAY, MARCH 29, 1994 Members Present: Chairman Tveite, Commissioners Eberley, Kreger, Minton, and Tacheny. Members Absent: Commissioner Kuester (arrived at 7:05 p.m.), Commissioner Carr Staff Present: Steven B. Ach, City Planner, Terry Maurer, City Engineer, Gary Schmitz, Planning Assistant, Catherine Schmidt, Recording Secretary. 1. Call Meetina To Order Pursuant to due call and notice thereof, the meeting of the Elk River Planning Commission was called to order at 7 p.m. by Chairman Tveite. 2. Consider Plannina Commission Aaenda . COMMISSIONER EBERLEY MOVED TO APPROVE THE 3/29/94 PLANNING COMMISSION AGENDA. COMMISSIONER MINTON SECONDED THE MOTION. THE MOTION CARRIED 5-0. 3. Consider a Reauest for Conditional Use Permit for Elk Park Center, Phase I Staff report presented by Steve Ach. Kraus Anderson of Elk River Inc., requested a conditional use permit for site plan review for Phase I of the Elk Park Center Planned Unit Development. Mr. Ach explained that the proposed site plan is generally consistent with the approved Development Plan however, the two main areas of discrepancy are the traffic control/landscaping islands along the east end of each parking row and signage along Jackson Road. Bert Dahlberg, 523-8 Street, Minneapolis, MN, briefly introduced people that would be making presentations to the Planning Commission: Ron Ankeny (for Michael Shields, Architect), John Bogart (John Oliver & Associates), Margaret Fleck (Target Architect); John Bogert addressed the Planning Commission and summarized drainage issues including the pond at the southeast corner of the project. Chairman Tveite opened the public hearing. Steve Ach reviewed the Development Plan (site plan, landscape plan, drainage plan, etc.) . Commissioner Kreger asked who would be designing the roads. Terry Maurer responded that he would be designing the road and that all road improvements Planning Commission Minutes March 29, 1994 Page 2 . will be decided with this phase (not including the Holt alignment Elk Hills Drive, and Dodge Street). Commissioner Kreger asked staff to update the Commission regarding the landscape plans and trailways. Steve Ach and Terry Maurer responded. Chairman Tveite asked the developers if all conditions listed in staff's memo would be accepted and incorporated into the site plan for Phase I. Ron Ankeny stated he was aware of the conditions however, he has not reviewed all conditions. Mr. Ankeny expressed AKRW Architects desire to work with the City regarding the conditions listed. Chairman Tveite asked Mr. Ankeny his thoughts regarding the landscaping plan. Mr. Ankeny responded that the landscaping would be more concentrated in selected islands but the same quantity would be provided. Also, Mr. Ankeny stated he was aware that a tree preservation plan was needed prior to the City Council meeting. Steve Ach explained that a tree preservation plan will also be addressed in Phase 2 or Phase 3. John Bogert indicated that trees would be preserved but grading in all areas would be done in Phase I. Commissioner Kreger asked for an update regarding the utility easement. John Bogart responded. Commissioner Eberley questioned vehicular movement in the back parking area. Terry Maurer responded that there is sufficient room for emergency vehicles. . Commissioner Minton requested an update regarding the signage. Steve Ach reviewed the signage package and identified the proposed signage. Ron Ankeny stated Target has requested the proposed signage changes. Commissioner Minton believes the proposed signage is in good taste, however, the revisions seemed large. Margaret Fleck (Target Architect) reviewed the signage designs of the Target Stores and the proposed signage for Elk Park Center. In accordance with Resolution 93-81, Commissioner Eberley asked staff to clarify the landscape plan for the entire project. Steve Ach reviewed. Commissioner Kreger stated he feels the proposed signage IS In order but expressed some concern regarding the lighting/illumination from the proposed signs. Some discussion ensued. There being no comments from the public, Chairman Tveite closed the public hearing. Chairman Tveite commended Steve Ach and Terry Maurer on the detail of their reports to the Planning Commission Commissioner Kuester asked the developers to explain traffic circulation on Freeport Avenue. Ron Ankeny responded. . COMMISSIONER KREGER MOVED TO RECOMMEND APPROVAL OF THE CONDITIONAL USE PERMIT BY KRAUS ANDERSON OF ELK RIVER, INC., PUBLIC HEARING, CASE NO. CU 94-08, CITING STAFF'S MEMO, ALL INFORMATION ATTACHED TO STAFF'S REPORT, AND ALL DRAWINGS AND UPDATES PRESENTED TO THE PLANNING COMMISSION AT THIS PUBLIC HEARING AS FINDING OF FACT. APPROVAL IS RECOMMENDED WITH THE FOLLOWING CONDITIONS: FINAL PLAT BE APPROVED BY THE CITY COUNCIL AND RECORDED WITH SHERBURNE COUNTY. ALL CONDITIONS STATED IN RESOLUTION NO. 93-81 BE COMPLETELY SATISFIED. A DEVELOPMENT AGREEMENT AND PUD AGREEMENT FOR ELK PARK CENTER PUD BE APPROVED BY THE CITY COUNCIL. PLANS BE REVISED IN ACCORDANCE WITH LETTERS FROM STEVE ACH DATED MARCH 24,1994, AND TERRY MAURER, DATED MARCH 22, 1994. ALL RETAINING WALLS SHOULD BE CONSTRUCTED OF A DECORATIVE BLOCK THAT IS COMPATIBLE WITH THE SHOPPING CENTER. THE NUMBER OF SEMI TRUCKS PARKING WITHIN THE SERVICE AREA BEHIND THE SHOPPING CENTER SHOULD NOT EXCEED THE NUMBER OF LOADING BERTHS. ALL LANDSCAPED AREAS BE FULLY IRRIGATED WITH UNDERGROUND IRRIGATION. A TEN (10) FOOT WIDE BITUMINOUS TRAIL BE CONSTRUCTED ALONG THE EAST SIDE OF JACKSON ROAD. A SIX (6) FOOT WIDE CONCRETE SIDEWALK BE CONSTRUCTED ALONG BOTH SIDES OF FREEPORT AVENUE. THE SIGN PACKAGE FOR THE FIRST PHASE OF ELK PARK CENTER PUD MAY INCLUDE A DEVELOPMENT SIGN ALONG HIGHWAY 169, A 128 SQUARE FOOT MONUMENT STYLE SIGN AT FREEPORT AVENUE AND JACKSON ROAD, AND A 6 FOOT HIGH BY 4 FOOT WIDE MONUMENT STYLE SIGN IDENTIFYING TARGET AT THE REAR ENTRANCE OFF OF JACKSON ROAD. 11. ALL PLANS BE REVISED IN ACCORDANCE TO THESE CONDITIONS AND PREVIOUS LETTERS, AND SUBMITTED FOR APPROVAL BY STAFF PRIOR TO ISSUANCE OF A BUILDING PERMIT. COMMISSIONER EBERLEY SECONDED THE MOTION. THE MOTION CARRIED 6-0. Commissioner Eberley stated that she wanted it made part of the record that great care should be taken regarding grading and tree preservation. Steve Ach and Terry Maurer reviewed the erosion control plan. Also, Commissioner Eberley stated that the Planning Commission would like more detailed information included in the packets (such as a copy of the PUD Agreement, a copy of the Developers Agreement, etc., whenever applicable) when considering items this complex in nature 4. . Other Business Commissioner Eberley asked staff if the Planning Commission (or a representative of the Commission) could be included in the Site Plan Review process. Chairman Tveite passed on comments from Council member Dietz to the Planning Commission commending their efforts and diligence. Commissioner Minton mentioned similar comments from Council member Holmgren. Steve Ach updated the Commission regarding the Steering Committee. The Chairman is Commissioner Minton, members include Marly Glines and Mary Eberley. One additional member will be announced soon. 5. Adiournment There being no further business, COMMISSIONER EBERLEY MOVED TO ADJOURN THE MEETING. COMMISSIONER MINTON SECONDED THE MOTION. THE MOTION CARRIED 6-0.
