Call Meeting to Order Pursuant to due call and notice thereof, the meeting of the Elk River Planning Commission was called to order at 7:00 p.m. by Chairman Nadeau. 2. Consider 10/27/92 Planning Commission Agenda Commissioner Spotts added discussion on the Regional Conference held in st. Paul to Item 15 on the agenda. Planning ~ COMMISSIONER SPOTTS MOVED TO APPROVE THE 10/27/92 PLANNING COMMISSION AGENDA AS AMENDED. COMMISSIONER EBERLEY SECONDED THE MOTION. THE MOTION CARRIED 6-0. 3. Consider 9/22/92 Planning Commission Minutes COMMISSIONER MINTON MOVED TO APPROVE THE 9/22/92 MINUTES. JOHNSON SECONDED THE MOTION. THE MOTION CARRIED 4-0-2. Consider Conditional Use Permit Request by Jeff Mastley/Public Hearing Janelle Szklarski, Zoning Assistant, stated that the applicant is requesting a Conditional Use Permit to excavate 6,200 cubic yards of fill from a lowland grass area. Furthermore, as this area falls within County Ditch 28 thus, County approval of this excavation is required in addition to City approval. Ms. Szklarski noted that the County Board will be discussing this issue at their November 18, 1992 meeting. staff is recommending that this item be tabled until the November 24, 1992 Planning Commission meeting so that the County's concerns can be addressed by the City. Chairman Nadeau opened the public hearing. COMMISSIONER SPOTTS MOVED TO CONTINUE THE PUBLIC HEARING ON THIS REQUEST TO THE NOVEMBER 24, 1992 PLANNING COMMISSION MEETING IN ORDER TO RECEIVE COMMENTS FROM THE COUNTY. COMMISSIONER EBERLEY SECONDED THE MOTION. THE MOTION CARRIED 7-0. 7. Consider Conditional Use Permit Request by Julie Schulze and Teresa Lawson/Public Hearing . Janelle Szklarski, Zoning Assistant, commented that the applicant's are requesting a Conditional Use Permit to operate a retail craft sales home occupation at 22822 Baldwin NW, Elk River. The request would involve remodeling a chicken coop into a craft store and that this remodeling would be subject to several building codes. Staff is recommending that no off-premise signage be allowed for this request. In addition, Ms. Szklarski felt the ordinance was unclear in regards to retail uses as a home occupation and that if retail uses are allowed as a home occupation, the Planning Commission needs to review the proposed use with regard to population density. The proposed home occupation would be fairly small and is in a relatively secluded area. Staff did not have major concerns with traffic generated from this use and was recommending approval with several stipulations. Julie Schulze announced that she would like to have signage to advertise her business along Highway 169. Ms. Szklarski responded that although the Schulze's own property along Highway 169 it is a separate parcel from that on which the use is located, therefore, it would be an off-premise sign. The applicant could combine these two parcels to eliminate the off-premise status. Chairman Nadeau opened the public hearing. Ernest Toth, 22191 Highway 169, commented that he is an adjoining property owner has no objections to the proposed use. . There being no further comments from the public, Chairman Nadeau closed the public hearing. Commissioner Spotts expressed issues not yet resolved. Commissioner Minton asked why staff had recommended that the hours of operation be different from that which the ordinance allowed. Ms. Szklarski remarked that the ordinance spells out hours of operations for permitted home occupations which typically do not involve customer traffic. She feels the limited hours should be enforced due to customer traffic. It was a consensus of the Planning Commission that due to the proposed location of the business, traffic would not be a major concern, therefore, the hours of operation outlined in the code (7:00 a.m. to 10:00 p.m.) should be allowed with this use. COMMISSIONER JOHNSON MOVED TO RECOMMEND APPROVAL OF THE CONDITIONAL USE PERMIT REQUEST BY JULIE SCHULZE AND TERESA LAWSON CITING STAFF'S MEMO AS WELL AS THE SEVEN STANDARDS FOR A CONDITIONAL USE PERMIT SUBJECT TO THE FOLLOWING STIPULATIONS: 1. THAT THE APPLICANT PROVIDE AT LEAST 3 PARKING STALLS. 2. THAT THE APPLICANT MEET ALL APPLICABLE BUILDING CODE CONCERNS. 3. THAT ONE NONRESIDENT EMPLOYEE, THE CO-APPLICANT, BE ALLOWED. 4. THAT SIGNAGE FOR THE PROPOSED USE BE ON PREMISE. THAT SIGNAGE ALSO ALLOW A WALL SIGN AS WELL AS A FREE STANDING SIGN THE ENTRANCE OF THE SITE. THE WALL SIGNAGE SHOULD BE LIMITED TWO SQUARE FEET AND THE FREE STANDING SIGN SHOULD BE LIMITED TEN SQUARE FEET. THIS AT TO TO . 5. THAT THIS USE BE REVIEWED ON AN ANNUAL BASIS BY STAFF AND THAT THE PLANNING COMMISSION REVIEW THE REQUEST EVERY 3 YEARS TO DETERMINE THE EFFECT ON THE SURROUNDING PROPERTIES. COMMISSIONER EBERLEY SECONDED THE MOTION. THE MOTION CARRIED 7-0. Commissioner Minton indicated the need to review/amend the ordinance to clarify the issue of retail home occupations being allowed as a conditional use. 8. Consider a Variance Request on Maximum Length of a Dead-end Road by David Gow/public Hearing . stephen Rohlf, Building and Zoning Administrator, stated that Mr. Gow is requesting a 600 foot variance to the 500 foot maximum length for a dead-end road. The request would allow an 1,100 foot dead-end road to be constructed. Further, the applicant proposes to develop a 40 acre parcel thus, a longer dead-end road was needed. Mr. Gow chose to apply for a variance prior to platting the property to avoid costly platting procedures that would be useless if the variance was not approved. Mr. Rohlf reviewed this request with the City Attorney and staff is recommending that this request be tabled until the plat and variance requests are in front of the City Council so the two requests can be considered together. Commissioner Johnson informed the Planning Commission that she would abstain from voting and discussion on this item as Mr. Gow is a family friend. Chairman Nadeau opened the public hearing. Paul Juenemann, 20633 Meadowvale Road, advised the Planning Commission that he owns property on two sides of Mr. Gow and is not interested in developing his property at this time. The drive leading into Mr. Gow's property (205th Avenue) is a private drive. stephen Rohlf responded that 205th Avenue actually has an easement dedicated to the City for roadway purposes. Marilyn VanPatten, 20455 Meadowvale Road, commented that she had no objections to the variance request. Cathy Juenemann, 20633 Meadowvale Road, questioned how an easement which is on their property could be used to develop Mr. Gow's property without their permission. While the surrounding property did not have immediate plans for developing, how long would this temporary cul-de-sac would be in existence? Mr. Rohlf replied that this issue regarding the easement for 205th Avenue will need to be resolved at the time of the plat approval. . Jeff Mastley, 19857 Zebulon street NW, inquired about the effect the proposed development would have on the St. Louis Park Sportsman Club property. Mr. Rohlf answered that during the platting of Mr. Gow's property the City would obtain easements to make logical future extensions of road to the Sportsman Club. Mr. Gow emphasized the inevitability of surrounding property developing and that he is incurring the expense being the first owner to develop. There being no further comments, Chairman Nadeau closed the public hearing. Commissioner Minton called attention to the location of the existing house as well as the trees on the property. Mr. Gow stated that the house would have to be relocated as it is in the path of the proposed road. Furthermore, he would like to live on one of the lots after the property is developed and is planning to leave as many trees as possible. Commissioner Eberley referred to the safety factor in allowing an 1,100 foot dead-end road. She also suggested that the Planning Commission make its recommendation contingent on a plat approval. Mr. Rohlf replied that there are concerns that need to be addressed before a plat can be approved and that this variance should be contingent on the plat. . . . Elk River Planning Commission October 27, 1992 Page 5 Commissioner Eberley stated that she would like to review the five standards for a variance and how they relate to this request, specifically standard number 1, which deals with undue hardship. Moreover, she perceives this request to be based primarily on economics. COMMISSIONER MINTON MOVED TO RECOMMEND APPROVAL OF THE VARIANCE REQUEST BY DAVID GOW TO ALLOW AN 1,100 FOOT DEAD-END ROAD CITING STAFF'S MEMO AND THIS APPROVAL BE CONTINGENT ON PLAT APPROVAL. COMMISSIONER TVEITE SECONDED THE MOTION. THE MOTION CARRIED 6-0-1, COMMISSIONER JOHNSON ABSTAINED. 9. Consider a Conditional Use Permit Request by Five star Door and Supply Inc./Public Hearing Janelle Szklarski, Zoning Assistant, reported that the applicant is requesting a Conditional Use Permit to convert a pole shed into a light assembly and storage facility for his garage door business. Ms. Szklarski reviewed her memo dated October 22, 1992. Further, she reported that there are unresolved issues regarding easements on the property which should be addressed through the stipulations for the Conditional Use Permit. Chairman Nadeau opened the public hearing. There being no comments from the public, Chairman Nadeau closed the public hearing. Commissioner Johnson asked what the DNR's response was to this request. Janelle Szklarski responded that she had spoken with Dale Homuth of the DNR and because the request met the Shoreland Standards for Commercial Uses (i.e., increased setback and 25% impervious surface) the DNR did not have any negative comments on this issue. COMMISSIONER EBERLEY MOVED TO RECOMMEND APPROVAL OF THE PERMIT BY FIVE STAR DOOR AND SUPPLY CITING STAFF'S MEMO STANDARDS FOR A CONDITIONAL USE PERMIT SUBJECT STIPULATIONS OUTLINED IN STAFF'S MEMO DATED OCTOBER 22, FOLLOWING ADDITIONAL STIPULATIONS: CONDITIONAL USE AND THE SEVEN TO THE TWELVE 1992, WITH THE 13. THAT THE GARAGE WHICH CROSSES THE LOT LINE IS EITHER MOVED SO IT IS ENTIRELY ON ONE PARCEL OR THE APPLICANT OBTAIN AN ENCROACHMENT EASEMENT FOR THE BUILDING. 14. THAT THE APPLICANT PROVIDE PROOF OF LEGAL ACCESS TO HIGHWAY 10 SUBJECT TO CITY REVIEW. 15. THAT THE APPLICANT COMBINES THE TWO LOTS OR OBTAINS LEGAL ACCESS TO THE NORTHERN PARCEL ALONG WITH SCOUT ISLAND, OR PROVE TO THE CITY THAT A LEGAL ACCESS TO THESE PARCELS EXISTS. 16. THAT THE APPLICANT PROVE WHETHER OR NOT AN EASEMENT EXISTS ALONG THE SOUTHERN 30 FEET OF THE PARCEL. IF IT DOES EXISTS, A DETERMINATION SHOULD BE MADE AS TO WHETHER THE CITY'S NEED FOR A UTILITY EASEMENT WILL INTERFERE WITH THIS DRIVEWAY EASEMENT. IF . . . COMMISSIONER VANVALKENBURG SECONDED THE MOTION. THE MOTION CARRIED 7-0. 10. Consider a Conditional Use Permit Request by Julie Peterson/Public Hearing Janelle Szklarski, Zoning Assistant, explained that Julie Peterson is requesting a Conditional Use Permit to operate a home hair salon at 1723 Tipton Circle. The salon would only involve Ms. Peterson with no outside employees, limited hours of operation, and only one work station, therefore, due to the limited scope of the proposed business, staff is recommending approval of the Conditional Use Permit. Chairman Nadeau opened the public hearing. There being no comments from the public, Chairman closed the public hearing. Commissioner salons. Ms. with Terry codes. spotts questioned what building codes pertain to home hair Szklarski answered that the applicant has been in touch Zajac, Building Inspector, and Mr. Zajac is reviewing these Commissioner Minton discussed staff's recommendation for the limited hours of operation. Commissioner Eberley concurred with Commissioner Minton that the stipulation limiting the hours and days of operation was unnecessary for this type of use. Ms. Szklarski answered that a business such as this which generates customers and traffic, should not be subject to the permitted use hours of operation (7:00 a.m. to 10:00 p.m.). Commissioner Tveitte concurred with Ms. Szklarski considering the density in the Bailey Beck Addition. COMMISSIONER JOHNSON MOVED TO RECOMMEND APPROVAL OF THE CONDITIONAL USE PERMIT FOR JULIE PETERSON CITING STAFF'S MEMO AND THE SEVEN STANDARDS FOR A CONDITIONAL USE PERMIT SUBJECT TO THE FOLLOWING STIPULATIONS: 1. THAT THE HOURS OF OPERATION BE LIMITED TO 10.00 a.m. to 8:00 p.m. 2. THAT NO OTHER EMPLOYEES AND NO ADDITIONAL WORK STATIONS ARE ALLOWED WITH THIS HOME OCCUPATION. 3. THAT THE APPLICANT MAINTAIN ENOUGH ROOM IN THE DRIVEWAY FOR TWO CUSTOMER VEHICLES AT ALL TIMES DURING OPERATING HOURS. 4. THAT SIGNAGE BE LIMITED TO TWO SQUARE FEET MOUNTED FLAT ON THE WALL OF THE DWELLING. 5. THAT THE APPLICANT MEET WITH THE BUILDING INSPECTION DEPARTMENT TO ENSURE THAT THE APPROPRIATE BUILDING CODES ARE MET. COMMISSIONER SPOTTS SECONDED THE MOTION. THE MOTION CARRIED 7-0. 11. Consider a Conditional Use Permit Request by Paul Krause (Pinewood Golf Course}/Public Hearing Stephen Rohlf, Building and Zoning Administrator, reviewed a request for a Conditional Use Permit to add a caretaker's house to the Pinewood Golf course. Golf courses are a conditional use in a residential zone, however, he could not find any record of a conditional use permit being issued for the golf course. Therefore, his request would cover both the caretaker's house and the golf course as a whole. Chairman Nadeau opened the public hearing. Charlie Boerger, 14209-182nd Avenue, requested Mr. size of the proposed caretaker's house as there Pinewood Addition. Pam Krause, applicant, 16394 Klamath Trail, stated that she agreed with Mr. Majkrzak's comments and that they would be willing to do some improvements in this area. Terry Boeger, 14209 182nd Avenue, questioned whether the caretaker's house would be a seasonal or a year 'round home. Pam Krause answered that it would be a year 'round home. There being no further comments from the public, Chairman Nadaeu closed the public hearing. Commissioner Minton expressed his concern regarding the number of trees that would need to be moved to accommodate the home. Mr. Krause indicated that they hoped to avoid all trees in con~truction of the house. Commissioner Minton inquired as to whether the City could add a stipulation that the house conform to covenants. Mr. Rohlf declared that the City should not enforce covenants. COMMISSIONER MINTON MOVED TO RECOMMEND APPROVAL FOR A CONDITIONAL USE PERMIT FOR THE CARETAKER'S HOUSE CITING STAFF'S MEMO AND SUBJECT TO THE FOLLOWING STIPULATIONS: 1. THAT THE CARETAKER'S HOUSE IS SITUATED ON LOT A OF THE PROPOSED SITE PLAN IN SUCH A WAY TO MEET SETBACKS FOR FUTURE LOT LINES. . . . Elk River Planning Commission October 27, 1992 Page 8 2. THAT APPROVAL OF LOCATING THE CARETAKER'S HOUSE IN THIS AREA IS CONTINGENT UPON FINDING A SUITABLE SITE FOR THE PROPER INSTALLATION OF A SEPTIC SYSTEM. 3. THAT THIS DWELLING IS USED ONLY AS A CARETAKER'S HOUSE UNTIL WHICH TIME IT IS POSSIBLE CREATE A SEPARATE LOT. 4. THAT THE CARETAKER'S HOUSE BE ARCHITECTURALLY HARMONIOUS WITH THE OTHER HOMES IN THE SUBDIVISION. 5. THAT THE APPLICANT STABILIZE THE PATHWAY AREA TO PREVENT EROSION AND THAT STOP SIGNS BE INSTALLED ALONG THE PATHWAY TO ENSURE SAFETY OF GOLF CART TRAFFIC. ALSO, THAT THESE IMPROVEMENTS BE MADE WITHIN 1 YEAR. COMMISSIONER SPOTTS SECONDED THE MOTION. Commissioner Eberley stated that the motion should be amended to approve the conditional use permit for the entire golf course, not just the caretaker's house as the golf course doe not currently have a conditional use permit. Commissioner Minton accepted the amendment. THE MOTION CARRIED 7-0. 12. Consider a Site Plan Approval by Gary Santwire/Public Hearing Stephen Rohlf, Building and Zoning Administrator, stated that the applicant is requesting to rearrange lot lines in Barrington Place PUD and to build storage garages on a portion of the lot associated with 580 Dodge Avenue. Although most of the garage stalls would be used by the proposed buyer, there is a possibility that some of the stalls would be rented out. Staff is recommending approval of this request. Chairman Nadeau opened the public hearing. There being no comments from the public, Chairman Nadeau closed the public hearing. Commissioner Eberley questioned how close these garages were to the apartments behind them. Mr. Rohlf answered that these garages back up to the garages for the apartment building and should not pose any safety concerns. Commissioner spotts asked if the garages would be used to work on vehicles. Gary Santwire, representing the applicant, replied that the garages would be used primarily for storage of vehicles associated with the buyer's business. Furthermore, the garages were not proposed to have plumbing or heating thus, the main use would be storage. COMMISSIONER EBERLEY MOVED TO APPROVE THE SITE PLAN FOR GARY SANTWIRE TO ALLOW STORAGE GARAGES TO BE BUILT AT 580 DODGE AVENUE CITING STAFF'S MEMO AND SUBJECT TO THE FOLLOWING STIPULATIONS: . . . THAT THE REMNANT PARCEL REMOVED FROM THE LOT LOCATED AT 592 DODGE AVENUE, IS COMBINED WITH THE LOT LOCATED AT 580 DODGE AVENUE, FOR ZONING PURPOSES. 3. SIGNAGE: a.) FREE STANDING SIGN: THAT THE FREE STANDING SIGN ADVERTISING 580 DODGE AVENUE BE ALLOWED TO RELOCATE UNDER THE FOLLOWING CRITERIA: 7' MINIMUM HEIGHT TO SIGN FACE, 14' MAXIMUM TOTAL HEIGHT, 10' MINIMUM SETBACK FROM THE RIGHT-OF-WAY OF DODGE AVENUE, AND 50 SQUARE FEET MAXIMUM. b.) Stephen Rohlf noted that this request is not subject to City Council approval. 13. Consider Ordinance Amendment Regulations"/Public Hearing Section 900.22 "Sign to Janelle Szklarski, Zoning Assistant, reported that the Ordinance Amendment dealing with wall signage in the C3 zoning district should reflect the consensus reached by the Planning Commission at the September 22, 1992 meeting. Ms. Szklarski stated that the Council had directed the Planning Commission to look at signage requirements in the C1 district. Commissioner Eberley stated that action on some of the minor issues related to the sign ordinance should be delayed until there are enough small changes to warrant further review of this ordinance. She continued that it seems that the sign ordinance has been reviewed too frequently in the past year. Chairman Nadeau opened the public hearing. Review Tax Increment Financing Plan for Tax Increment Financing District No. 11 Janelle Szklarski, Zoning Assistant, briefly reported that the Planning Commission was consistency with the Growth Management Plan. reviewed this item and to review the plan for COMMISSIONER MINTON MOVED TO APPROVE RESOLUTION 92-103, A RESOLUTION OF THE ELK RIVER PLANNING COMMISSION FINDING THE ECONOMIC DEVELOPMENT AUTHORITY TAX INCREMENT FINANCING PLAN FOR TAX INCREMENT FINANCING DISTRICT NO. 11, LOCATED WITHIN DEVELOPMENT DISTRICT NO. 1 TO BE CONSISTENT WITH THE COMPREHENSIVE PLAN FOR THE CITY OF ELK RIVER. COMMISSIONER TVEITE SECONDED THE MOTION. THE MOTION CARRIED 7-0. 15. Other Business Stephen Rohlf, Building and Zoning Administrator, briefly discussed several topics of interest which included the State Enabling Act currently under review and a book regarding mineral reclamation plans in the State of Minnesota. Mr. Rohlf explained that he had a meeting with Mr. Peter Beck, City Attorney, and Bill Weber, City Planning Consultant, regarding issues such as the creation of a business park zone, the creation of two highway commercial zones, the elimination of the 2 1/2 acre residential zone, the addition of a green space requirement in the city's ordinance, and use of PUD's within the city. Commissioner Eberley mentioned that she was happy to see discussions such as this and felt that these topics should be incorporated into the Planning Commissions review of the Comprehensive Plan for this city when that takes place. Commissioner spotts recounted the upper Conference he attended in st. Paul, MN. experience and a way to compare how other similar issues facing the City of Elk River.
