Overview
The applicant is requesting the easement vacation to be able to construct an approximately
23,660 square foot Tractor Supply Store. The easement was created to protect a wetland.
Planning Department Mission: the orderly development of a livable and sustainable Elk River community.

The amount of area of wetland that the easement protected is within the de minimis amount
which can be filled. Therefore, there is no need for a drainage and utility easement in this
area. The City Engineer's memo addresses this issue in more detail.
There are two portions of easement that exist on Lot 2, Block 1 of this plat that cannot be
vacated with this request, as they are on a separate property.
Recommendation
Staff recommends that the City Council approve the request with the following condition:
1. All comments of the City Engineer shall be addressed.
2. A legal description of the easement vacation shall be provided prior to
recording the request at the County.

Dear Ms. McPherson:
As requested, we have reviewed the submittal package for the proposed Tractor Supply
Store to be located on Lot 1, Block 2 of Elk River Crossing Sixth Addition. The submitt~
package was prepared by John Oliver & Associates and consisted of a preliminary site plan,
preliminary grading plan, preliminary utility plan, preliminary landscape plan, preliminary
Storm Water Pollution Prevention Plan, and two pages of details. Based upon our review
and comments received at the staff review meeting, we would offer the following comments:
1. There is a fairly large drainage and, utility easement on this site from the original plat
of Elk River Business Park. One of the requests of Tractor Supply Company is the
vacation of this easement. On September 9,2004, the Technical Evaluation Panel
(YEP) made a site visit to review for potential wetlands in this area. It was the
determination of the TEP that any wetlands that still existed within this easement
were only approximately 2,000 square feet in area, which is within the de minimis
amount which can be filled. In other words, there is no need for the drainage and
utility easement to protect a wetland area. Therefore, I would recommend approval
of the request to vacate the easement with the following two conditions:
· A ten-foot drainage and utility easement be left along the perimeter lot lines of
Elk River Crossing Sixth Addition and a five-foot drainage and utility easement
be left along both sides of the internal lot line between Lots 1 and 2.
· Unless Maxsun Furniture, the owner of Lot 2, Block 1 join this request for an
easement vacation, only the portion of the easement within Lot 1, Block 1
(Tractor Supply Company site) be vacated.

RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION FOR VACATING STREET, DRAINAGE AND UTILITY
EASEMENTS
Case No. EV 05-07
WHEREAS, the property owner abutting the street, drainage, and utility easements has
requested the City Council in a petition dated September 19, 2005 to vacate
such easements according to law; and,
WHEREAS, a public hearing was held on September 19, 2005, before the City Council at
the Elk River City Hall on such petition after due published and posted
notice had been given as well as personal notice to affected property owners
on September 8, 2005 and all persons interested were given an opportunity
to be heard; and,
WHEREAS, it appears that it will be in the best interest of the City to approve such
petition.
NOW, THEREFORE, BE IT RESOLVED that such petition is hereby granted and
the street, drainage, and utility easements described as follows is hereby
vacated:
