COMMISSIONER JOHNSON MOVED TO APPROVE THE ELK RIVER PLANNING COMMISSION MINUTES OF THE ANNUAL MEETING HELD JANUARY 13, 1990 AT PEBBLE CREEK. COMMISSIONER EBERLEY SECONDED THE MOTION. THE MOTION CARRIED 7-0. 5. C~llditional Use P~smit Ren~~al by Northern State~-Power/P.H. Steve Rohlf, Building and Zoning Administrator, introduced this item indicating that every two years Northern States Power (NSP) and United Power Association (lJPA) are required to renew both their licenses and conditional use permits with the City of Elk River for the ir waste facilities. Mr. Rohlf explained the history of NSP's and UPA's zone change, conditional use permit and license renewal. Steve Rohlf, Building and Zoning Administrator, discussed with the Commission this issue. He indicated that UPA does not have all of the results from Planning Commission Minutes January 23, 1990 Page 2 . their air emissions testing at this time. He further idicated that they should have the results by the beginning of March. The Planning Commission felt, as staff did, that air emissions at UPA was a critical part of their permit. Staff indicated that the City should have the benefit of those test results prior to renewing UPA' s permits for two years. The Planning Commission was in agreement with staff and is recommending to the City Council a temporary extension to both NSP's and UPA' s license and conditional use permit to be granted until the end of April, 1990. It was the consensus of staff and Planning Commission that NSP' s facility should be acted on at the same time as UPA's, since the two facilities were so interrelated. Chairman Kimball opened the public hearing. Darlene Solberg of 9912 NE Parrish questioned whether the noise problem would be further addressed at the April meeting. e Rita Schmall from the Cargill Research Farm was concerned with the lack of control of garbage on the roads and in their fields. Ms. Schmall questioned whether NSP could put up some type of fencing to control the paper problem. Glen Kass, plant superintendent, addressed this concern indicating that they have a regular maintenance program that does a policing of the building and area once every two weeks. Mr. Kass stated that they are looking at better containment on their property to help control the problem. Staff indicated that they will follow up with these concerns and hopefully have some answer by the April meeting. Mr. Kass further indicated that they are requesting a modification of their original permit to be able to haul residue on Sundays which is currently prohibited. Mr. Kaas explained that NSP has found that the inability to haul residue on Sunday has somewhat restricted operations. Chairman Kimball indicated that the public hearing would be continued to allow for additional testimony at the April meeting. Steve Rohlf, Building and Zoning Administrator indicated the applicants are requesting a zone change on a parcel of property from R-Ic/Single Family Residential which would accommodate single family houses with Ci ty sewer and water to R-2b/Townhouse Multifamily Residential. Mr. Rohlf cautioned the Planning Commission to not consider what uses are proposed by the petitioner (townhouses) but what uses could take place under the proposed zoning designation. He explained the three reasons when a zone change should be approved and when it is legal to approve a request. Commissioner Kimball opened the public hearing. Norman Schamber of 551 Tipton was concerned wi.,th apartment buildings being allowed in this area. Steve Rohlf, B & Z Administrator indicated that apartments would be allowed in an R-2b zone. but still would only contain up to four units per building. Chairman Kimball closed the public hearing. Commissioner Kimball asked staff that if it wasn't for the three unit townhouse then we wouldn't have to go through the zone change. Mr. Rohlf indicated that we would have to go through he zone change but the developers would be asking for a R-2a instead of the R-2b. Chairman Kimball indicated that it was his understanding that the DNR was looking at eliminating one of the units. Steve Rohlf indicated that the DNR was looking at whether they will approve 6 or 7 units fronting the lake (a matter of density). Dennis Anderson indicated that the DNR, without any problem, will allow 6.9 units. Mr. Anderson indicated that for the .1 unit we will have to make concessions such as setbacks etc. to satisfy the DNR. After discussing this issue, it was the consensus of the Planning Commission that they would like to go with R-2a zoning because of the density, as this would be more restrictive. Steve Rohlf, Building and Zoning Administrator, indicated that the petitioners have asked that the R-2b be acted on. He indicated that the applicant would have to agree to the R-2a zoning to be acted on at this time. At this time a short recess was taken giving the applicants time to consider the R-2a zoning. Rick Foster and Dennis Anderson of Rand D development agreed to have R-2a zoning also be considered. COMMISSIONER FUCHS MOVED THAT THE PLANNING COMMISSION RECOMMENDS TO THE CITY COUNCIL APPROVAL OF REZONING OF BLOCK 2 OF BAILEY/BECK ADDITION TO R-2A AS THE PROPOSED ZONE CHANGE WOULD BE MORE CONSISTENT WITH THE COMPREHENSIVE PLAN AND LAND USE. COMMISSIONER EBERLEY SECONDED THE MOTION. THE MOTION CARRIED 7-0 7. Pr~1iminarx Plat Review by R & D Devel.Qpmentjp.H. Steve Rohlf, Building and Zoning Administrator, introduced the location of the property to the Commission. He indicated that the Bailey/Beck addition consists of 16 single family lots with city sewer and water. He explained that it was originally proposed with 11 townhouse units, but I assume it will be cut down to 10 units if the zone change is approved as R-2a. Mr. Rohlf indicated that the City Engineer would be designing the sewer, water, drainage plan and streets for this plat. Chairman Kimball opened the public hearing. Norman Schamber of 551 Tipton questioned if there would be any restrictions that would apply to single family residences. Steve explained that the City Code of Ordinances sets certain standard on houses and we will not be enforcing anything beyond our standards. It is not City responsibility to enforce restrictive covenants. Chairman Kimball closed the public hearing. Commissioner Johnson indicated that she was concerned with the extra amount of traffic this would create. Commissioner Johnson felt this would put an addi tional amount of pressure on the surrounding area especially on the Upland and Highway 10 intersection. Commissioner Johnson indicated that she had talked to Mr. Rohlf in length regarding this problem. Staff suggested asking Council to put a street light on the south side, staff felt it would help that intersection. Planning Commission Minutes January 23, 1990 Page 5 e COMMISSIONER EBERLEY MOVED TO RECOMMEND TO THE CITY COUNCIL APPROVAL OF THE PLAT OF BAILEY BECK ADDITION WITH THE FOLLOWING STIPULATIONS: 1. THAT FINAL APPROVAL OF STREETS, SEWER, WATER, GRADING AND DRAINAGE BE AS PER TERRY MAURER, CITY ENGINEER, THAT THE APPROVAL IS PRIOR TO FINAL PLAT APPROVAL OF THE PLAT. THIS SHOULD INCLUDE THE FINAL PLAT REFLECTING ALL THE NECESSARY EASEMENTS TO ACCOMPLISH UTILITIES. 2. THAT STREET LIGHTS ARE PROVIDED ON THE CORNER OF UPLAND AND FIFTH, TIPTON AND UPLAND, AND AT THE END OF THE CUL-DE-SAC ON TIPTON. THAT A TOWNHOUSE ASSOCIATION AGREEMENT IS PROVIDED BY THE DEVELOPER AND APPROVED BY THE CITY ATTORNEY PRIOR TO COUNCIL FINAL PLAT APPROVAL. THIS IS TO GUARANTEE THE MAINTENANCE OF THE PRIVATE DRIVE TO ACCESS THOSE TOWNHOUSES AND THE COMMON LOT SURROUNDING THEM. 14. THAT THE TOWNHOUSE UNITS ARE PROVIDED 'fWO GARAGE S1'ALLS EACH AND PARKING AS SHOWN ON THE PRELIMINARY PLAT AND THAT THE PRIVATE ROAD AND PARKING IS HARDSURFACED. 15. Chairman Kimball opened the public hearing r""" e Julie Croteau of 19201 Meadowvale Road indicated they would like a buffer of trees on the west side of the lot to shield them from the parking lot. Planning Commission Minutes January 23, 1990 Page 7 e John Gracik questioned whether the church would be included within the sewer and water district. Stephen Rohlf indicated that when sewer becomes available to the site, they will be required to hook up. Chairman Kimball closed the public hearing. General discussion took place regarding the drainage on this site. Staff indicated that prior to a building permit being issued, a drainage plan meeting the approval of the City Engineer needs to be addressed. Staff indicated that the church access would be off of 193rd Avenue and is recommending that this road be upgraded because of the additional traffic. The Planning Commission was in agreement with this request. Discussion at this time centered on landscaping and signage. It was indicated that the site plan lacked detail as far as the landscaping was concerned. Staff suggested evergreens on the west side of the church property to help minimize the visual effect of the church property on surrounding vacant properties. The Commission was in agreement with this request. e COMMISSIONER FUCHS MOVED TO RECOMMEND APPROVAL TO THE CITY COUNCIL FOR A CONDITIONAL USE PERMIT TO ALLOW AN INSTITUTIONAL USE (CHURCH) FOR ABIDING SAVIOR EVANGELICAL LUTHERAN CHURCH LOCATED ON 193RD AVENUE BASED ON THE FINDINGS OF FACT AS STATED IN STAFF'S MEMO WITH THE FOLLOWING STIPULATIONS: 1. THAT THE PARKING AND DRIVE BE HARDSURFACED AND STRIPED. THAT THE DRIVE BE MADE THREE LANES, ONE ENTRANCE, TWO EXITS: THE LEFT EXIT LANE BEING A LEFT HAND TURN LANE AND THE RIGHT EXIT BEING A RIGHT HAND TURN LANE. 2. THAT SIGNAGE FOR THE CHURCH BE AS PER CITY CODE WITH THE FREESTANDING SIGN PROPOSED HAVING ITS PILLARS CONSTRUCTED OF BRICK AS PROPOSED. 9. THAT PRIOR TO BUILDING PERMIT ISSUANCE, A GRADING PLAN WITH DRAINAGE ELEVATIONS BE APPROVED BY THE CITY ENGINEER. FURTHER THAT THE CHURCH GAIN THE APPROPRIATE. Fish) PJmliQ_._He!!.rl!l~ Stephen Rohlf, Building and Zoning Administrator, stated that Elk River Printing is requesting a conditional use permit for light manufacturing (printing) in Barrington Place PUD. He indicated Elk River Printing is proposing to use the north half of the building located at 596 Dodge Avenue. After discussing this issue, there was some concern with the exhaust fan regarding noise and odor. Gary Santwire indicated if the fan becomes a problem it can go out the roof. He explained the fan will be about 5 times the size of a bathroom fan and should not be a problem. COMMISSIONER JOHNSON MOVED TO RECOMMEND TO THE CITY COUNCIL APPROVAL OF THE CONDITIONAL USE PERMIT FOR LIGHT MANUFACTURING (PRINTING) IN BARRINGTON PLACE PUD WITH THE FOLLOWING STIPULATIONS: ,........ e 1. THAT THE CONDITIONAL USE PERMIT FOR LIGHT MANUFACTURING IN THIS LOCATION IS SPECIFICALLY FOR "PRINTING" AS DEFINED BY ELK RIVER PRINTING'S CURRENT OPERATION.
