Meetin~ .
It was indicated that Chairman Kimball and Commissioner Bischoff would
attend the 9/17/90 City Council meeting.
COMMISSIONER EBERLEY MOVED TO ACCEPT THE CALENDAR FOR THE 9/17/90 CITY
COUNCIL MEETING. COMMISSIONER VANVALKENBURG SECONDED THE MOTION. THE
MOTION CARRIED 5-0.
At this time Chairman Kimball welcomed the two new commissioners, Rob
VanValkenburg and Robert Bischoff. Chairman Kimball explained that the
meeting procedure would be video taped.
5. Consider Conditional Use Permit (Temporary Trailer) by Richard

Janelle Szklarski, Zoning Assistant, explained that Richard Vagley is
requesting a condi tional use permi t to allow a temporary trailer as a
residential dwelling. The 40 ft. fifth wheel trailer will accommodate
two people. Staff is recommending approval of this request for 6
months. Mr. Vagley was present to answer any concerns the commission
had.
Chairman Kimball reviewed the requirements for a conditional use permit
and the procedure for a public hearing.
Chairman Kimball opened the public hearing. There being no one for or
against the request, Chairman Kimball closed the public hearing.
COMMISSIONER EBERLEY MOVED TO RECOMMEND TO THE CITY COUNCIL APPROVAL OF
THE CONDITIONAL USE PERMIT TO ALLOW A TEMPORARY TRAILER AS A
RESIDENTIAL DWELLING BASED ON THE SEVEN STANDARDS FOR A CONDITIONAL USE
PERMIT. ALSO, THAT THE CONDITIONAL USE PERMIT SHALL BE SUBJECT TO THE
STIPULATIONS AS OUTLINED IN STAFF'S MEMO DATED 8/17/90. COMMISSIONER
VANVALKENBURG SECONDED THE MOTION. THE MOTION CARRIED 5-0.
6.
Consider Conditional Use Permit (New Clubhouse and Remodelin~ Pro
ShOD) by Elk River Country Club/P.H.
Gary Schmitz, Zoning Assistant, stated that the applicant is requesting
a conditional use permit and site plan review for a new clubhouse and
remodeling addition of the existing pro shop. Mr. Schmitz indicated
that the existing clubhouse will be demolished to make room for the
new one. He explained that the City Council on 11/20/89, made an
interpretation that this type of activity would constitute an expansion
of a conditional use, and that locker rooms, showers, and dining
facili ties. could be considered as an accessory use to a golf course
clubhouse. Mr. Schmitz reviewed the considerations relating to the
proposed operation as stated in his memo.
Chairman Kimball opened the public hearing.
Doug Moe was present and showed a site plan of their request. Mr. Moe
was requesting that they have the option to pave the road at a later
date if they should be over budget. Tim Keane, City Attorney, stated
that the Planning Commission should consider precedence if they waive
the pavement request completely. Commissioner Schroeder asked if it was
appropriate for the commission to grant them a time extension. Chairman
Kimball stated that under the terms of a conditional use permit the
applicant would have two years from the issuance of a permit to get the
road blacktopped, and with that in mind, he would ask the Council not
to grant an extension of time. Ms. Szklarski stated that the
commission might add that the permit be reviewed in two years as one of
the stipulations. Commissioner Eberley stated that she was not opposed
to an extension, but would be against changing the standards that have
been set forth for the City.

7.
Site Plan Review (Permanent Slab for Green House) by Pamida
Janelle Szklarski, Zoning Assistant, stated that the applicant (Dennis
Burkstrand) is requesting site plan review for Pamida to allow
expansion of their greenhouse area. Pamida lies within a PUD therefore
any modification to the site needs to go through a site plan review by
the Planning Commission and City Council. Staff is recommending
approval of the request.
Mr. Burkstrand explained their reason for the request is to pick up
additional parking spaces. He indicated that they would use this
concrete slab to construct a 24' by 50' greenhouse addition for 6 weeks
of the year. The construction of this greenhouse would be more of a
convenience for the customers and also provide security for the store.
COMMISSIONER EBERELY MOVED TO RECOMMEND TO THE CITY COUNCIL APPROVAL OF
THE SITE PLAN REVIEW AS PRESENTED BY PAMIDA INC. BASED ON THE FINDINGS
THAT THE OPERATION WOULD IMPROVE THE TRAFFIC, SAFETY AND SECURITY THAT
IS NEEDED FOR THE OPERATION OF THE BUSINESS WITH THE FOLLOWING
STIPULATIONS:
1.
THAT PAMIDA OBTAIN BUILDING PERMITS EACH TIME THE GREEN HOUSE IS
TO BE ERECTED.
2. THAT THE GATES ON THE FENCES ARE TO REMAIN OPEN DURING BUSINESS
HOURS.
3. THAT THE GREENHOUSE KEEP THE SAME HOURS AS THE STORE.
COMMISSIONER VANVALKENBURG SECONDED THE MOTION. THE MOTION CARRIED 5-0.
Commissioner Eberley indicated that every effort should be made to
replace damaged foliage in keeping with spirit of the new landscape
ordinance.
8.
Consider Variance (11 ft. Encroachment on 20 ft. Side Yard Setback to
Accommodate a House) by SDrin~er Construction/P.H.
Janelle Szklarski, Zoning Assistant, stated that Springer Construction
is requesting a variance for a house which has already been
constructed. She indicated that at the time the building permit was
pulled, the site plan that was submitted to staff showed the proper
setbacks, however, Springer Construction inadvertently located a pin
(iron) that was used to mark the curve of Gary Street instead of the
pin that marked the southeast corner of Lot 7. Staff is recommending
approval of this request as staff feels they meet the five standards
for granting a variance.

Dave Harmonick - 21146 York Street NW (owner of Lot 8) questioned the
location of the driveway. Mr. Harmonick felt that the portion of the
driveway which encroaches on his property should be removed. Ms.
Szklarski stated that the driveway does encroach slightly on Mr.
Harmonick's property. She questioned if the City could require that
portion of the driveway to be removed. Mr. Harmonick further requested
that there be an additional stipulation that no permanent or temporary
structures be erected along the south side of the structure other than
landscaping. This would require the removal of two kennels that are on
the south side.
Tim Keane, City Attorney stated that it should be clearly stated that
this variance does not constitute the City's blessing of the driveway
encroachment on Lot 8. This would be a private matter between the two
lot owners which is not covered by this variance.
Ms. Sue Springer stated that the survey that was done for the new home
on the property shows that the driveway is encroaching .08 feet on Lot
8. They had confronted the builder and he did not think this would be
a problem. She further indicated that the two dog kennels on the south
side are being removed.
Chairman Kimball closed the public hearing.

COMMISSIONER SCHROEDER MOVED TO RECOMMEND TO THE CITY COUNCIL APPROVAL
OF THE VARIANCE BY SPRINGER CONSTRUCTION TO ALLOW, AN 11 FT.
ENCROACHMENT ON THE 20 FT. SIDE YARD SETBACK TO ACCOMMODATE A HOUSE
SITING THE FIVE STANDARDS AS OUTLINED IN STAFF'S MEMO TO INCLUDE THE
STATEMENT GIVEN BY THE CITY ATTORNEY THAT THE CITY DOESN'T GIVE
APPROVAL AS FAR AS THE DRIVEWAY IS CONCERNED REGARDING THIS VARIANCE.
ALSO, THAT THE HOUSE ON LOT 7 SHOULD NOT HAVE PERMANENT OR TEMPORARY
STRUCTURES BUILT ON THE SOUTH SIDE OF THE LOT. COMMISSIONER BISCHOFF
SECONDED THE MOTION. THE MOTION CARRIED 5-0.
9.
Consider Conditional Use Permit (Home Occupation - Phone Answering
Service) by Gemini Communications/P.H.
Janelle Szklarski, Zoning Assistant, stated that Paul Ouellette of
19741 Ulysses Street NW is requesting a condi tional use permit to
operate a home occupation. The conditional use permit would allow the
applicant to operate a telephone answering service from his home. Ms.
Szklarski stated that Mr. Ouellette is currently operating the business
out of his garage. Ms. Szklarski stated one of the concerns staff has
with this proposal is the number of employees. In the past, it has been
the Planning Commission and City Council's tendency to allow few if any
outside employees.
Chairman Kimball opened the public hearing.

Mr. Ouellette explained his request indicating that they have a total
of eight outside employees, four of which are family. He indicated two
of the family members live across the street and the other two live in
Anoka. Mr. Ouellette was requesting that the hours of operation be
expanded to better accommodate his business.

Mr. Neil Moody - 10113 213th Avenue NW asked about the location of Mr.
Ouellette proposal and the lot sizes.
Chairman Kimball reviewed a letter from Ronald Harrington of 19728
Ulysses Avenue opposing the request because of the additional traffic,
noise and the size of the business in a residential zone. Chairman
Kimball asked that Mr. Harrington's letter be made part of the public
record. Chairman Kimball stated that he had visited the site earlier,
and had talked to Mr. Harrington.
Chairman Kimball closed the public hearing.
Chairman Kimball indicated that he was concerned about setting a
precedence with this request. He also stated that about three years
ago Ann's Beauty Shop was before the commission requesting addi tional
employees to help her with her business. The concern at that time was
that a residential neighborhood is for residences and not for
commerical business. Chairman Kimball stated that normally eleven
people would be too many for a home occupation such as the case of
Ann's Beauty Shop, as she also has customers that come in. Mr.
Ouellette however, doesn't have any customer traffic. He indicated that
if he were to approve this request it would be for the following
reasons: outside employees consist mostly of family members, and the
business does not generate a lot of outside traffic.

Commissioner Bischoff stated that he had visited the site earlier. He
would like to see outside employees restricted.
Tim Keane, City Attorney, stated that this is a business that probably
10 years ago would not have been technically feasible. Mr. Keane
indicated that consideration should be given to encourage home
occupations in which people are able to be in a working relationship
with their families. He stated that the Planning Commission should
balance all the issues here as far as traffic, outside customers, hours
of operation etc.
Commissioner Eberley felt it was time to review the standards for home
occupation, as to whether they can fit within the neighborhood. She
stated that everything we read about the future indicates that more and
more people will work out of their homes because of transportation
costs and technology capabilities.
Commissioner Schroeder stated that he felt this request was a totally
different request than that of the beauty operation. He was in
agreement with Commissioner Eberley that the Commission should look at
this request as part of the future growth. Commissioner Schroeder
stated that he would be in favor of the request but would like to see a
one year time frame limitation as one of the stipulations, so Mr.
Ouellette could stay in business.

Mr. Keane stated that if the Planning Commission were to come to the
conclusion that the standards are met, the Commission may put a
reasonable stipulation as far as the time frame.

Commissioner VanValkenburg stated that he was also concerned about
setting a precedence. He asked at what point does a home occupation
switch from residential to commerical. Commissioner VanValkenburg felt
that some sort of time frame limit should be set.
Chairman Kimball requested that home occupations be added to the agenda
for discussion at the joint meeting of the City Council and Planning
Commission on September 13, 1990.
COMMISSIONER EBERLEY MOVED TO RECOMMEND TO THE CITY APPROVAL OF THE
CONDITIONAL USE PERMIT REQUEST BY PAUL OUELLETTE (GEMINI
COMMUNICATIONS) SITING STAFF'S COMMENTS ON THE FIVE STANDARDS FOR A
HOME OCCUPATION AND SITING THE SEVEN STANDARDS FOR A CONDITIONAL USE
PERMIT.
Chairman Kimball stated that he would like to see the following
findings of fact added to the motion: the business is predominantly
staffed with family members with very few outside members; the business
does not generate any more traffic and noise than what is generated in
a normal residential neighborhood; that the business is run in an
extremely efficient manner and that the signage is kept to a minimal.
Commissioner Eberley was in disagreement with Chairman Kimball's
finding that family members should be supported as a finding of fact as
the seven standards for a conditional use permit do not address family
versus non-family, but rather they address resident versus non-resident
employees. Chairman Kimball felt that this finding was supported by
staff's memo.
COMMISSIONER EBERLEY CONTINUED HER MOTION TO RECOMMEND THAT THE
APPROVAL OF THE REQUEST INCLUDE THE FOLLOWING STIPULATIONS:
1. THE GARAGE SHALL MAINTAIN ONE PARKING STALL FOR THE SOLE USE OF A
VEHICLE.
2. THAT ALL MATERIALS AND EQUIPMENT ASSOCIATED TO THE BUSINESS BE
KEPT IN THE CONFINES OF THE HOUSE AND/OR GARAGE.
3. THAT THE APPLICANT IS PERMITTED ONE SIGN NOT TO EXCEED 2 SQ. FT.
IN AREA AND SHALL BE MOUNTED FLAT ON THE OUTSIDE WALL OF THE
BUILDING.
4. THAT THE HOURS OF OPERATION BE ALLOWED TO CONTINUE AT 24 HOURS A
DAY, BUT THAT THE NON-RESIDENTIAL EMPLOYEES BE RESTRICTED TO HOURS
THAT ARE BETWEEN 7:00 A.M. AND 8:00 P.M.
5. THAT ANY STRUCTURAL ALTERATIONS TO THE HOUSE OR. THE GARAGE TO
ACCOMMODATE THIS BUSINESS SHALL REQUIRE A BUILDING PERMIT.
6. THAT THE CONDITIONAL USE PERMIT SHALL BE VALID FOR ONE YEAR. AT
THAT TIME THE APPLICANT MUST RENEW HIS PERMIT.
COMMISSIONER SCHROEDER SECONDED THE MOTION. THE MOTION CARRIED 5-0.

10. EXTENSION OF TEMPORARY SUBDIVISION IDENTIFICATION SIGN BY TERRY LEE
REALTY AND HOMES
Janelle Szklarski, Zoning Assistant, stated that Terry Lee Douglas is
requesting an extension to the time period allowed for a temporary
subdivision sign. She further indicated that the applicant has revised
his request to include an extension for a model home as well as the
sign. Ms. Szklarski stated that the applicant was not present for this
issue.
It was the general consensus of the Commission that model home and the
signage request were two separate issues and should be dealt with in
that manner. The Commission indicated they would be acting only on the
one issue (signage). Mr. Douglas would have to come in with a separate
request for the model home extension.
COMMISSIONER BISCHOFF MOVED TO APPROVE THE SIGNAGE EXTENSION FOR TERRY
LEE REALTY AND HOMES FOR A PERIOD OF SIX MONTHS. COMMISSIONER EBERLEY
SECONDED THE MOTION. THE MOTION CARRIED 5-0.
11.
Amendments to City of Elk River Comorehensive Plan by the City of Elk
River/P.H.
A.
PATHWAY PLAN
Pat Klaers, City Administrator stated that the City has discussed the
need for a City wide sidewalk policy for a number of years. Mr. Klaers
stated that the City's insurance agent suggested that something be done
with the sidewalks as to eliminate the liability. He indicated that
the City Engineer, Terry Maurer, has drafted a pathway and sidewalk
plan for the City to review. Mr. Klaers explained the difference
between a pathway and sidewalk; a pathway is considered a major "people
mover" throughout the community; sidewalks would be considered more
residential to serving the surrounding area. Mr. Klaers stated one of
the concerns of the City was how the sidewalks and the pathways would
be financed. He stated that staff has concurred with the
recommendation of the City Engineer that the cost of the sidewalks be
split 50/50 with the City and the property owner. At this time, Mr.
Klaers showed the proposed City sidewalk/pathway plan map drafted by
Terry Maurer, City Engineer. Mr. Klaers explained that the City
Attorney has recommended that in order for the plan and map to be
enforced it should be incorporated into the City's Comprehensive Plan.
He indicated he was seeking Planning Commission and public input on
this request.
Chairman Kimball opened the public hearing.
Cecelia Scheel of 10271 213th Avenue was opposed to the request as she
did not want her property taken away from her for a park. She further
indicated that if a trail system was allowed to go through her property
it would go through her front door.

Jeff Scheel was also concerned with the pathway running through their
property. He questioned if there would be restrictions as to what they
could do with their property because of the park plan.
Tim Keane explained the difference between a Comprehensive Plan and an
official map. He stated that the designation of a land use such as a
park, in the Comprehensive Plan is to be used as a guide and this does
not in any way inhibit a property owner's rights to the use of their
property.
Steve Kreger questioned if his mother decides to sell her property in
the near future, does this plan tell future buyers that the Ci ty has
identified this area for purchase in the distant future? He indicated
this will scare future buyers away which will decrease the value of
her property. He felt that she would not get adequate compensation
from the City for her property. Mr. Kreger stated that for personal
reasons he would not like to see her land designated as a park.
Jeff Scheel stated that he agrees that the City has to plan for the
future of Elk River. There are people like the Kregers who enjoy their
place in the country, who will have to accommodate others because of
the plan that the Planning Commission is considering. Mr. Scheel
questioned what rights the property owners have to stop this process.

Tim Keane, City Attorney, addressed his concern stating that there will
be a public hearing with the City Council on September 17 where
interested property owners or affected property owners have an
opportunity to voice their opinion or to offer written correspondence.
He indicated that the plan is putting owners on long term notice that
this is an area that has been intended for purchase in the distant
future.
Mrs. Maria Moody indicated she was opposed to the plan as they moved
out in the country to get away from people. She questioned if the City
would buy their property at real market value.
Tim Keane, City Attorney, stated that eminent domain settlements are
generally acquired for greater than the fair market value.

Jane Kreger was opposed to the plan as she was concerned with people
walking around her property and she thought it would be difficult to
keep people away from her house. She stated that they were not notified
of the public hearing. Pat Klaers, City Administrator, stated that
individual property owners are not notified individually because it is
a City wide plan.

Commissioner Schroeder stated that he understood the public's fears. He
explained that at one time, Sherburne County Wildlife Refuge was all
privately owned. The owners were forced to sell because it was decided
to make that land into a national refuge. He indicated there is no
guarantee that one's property is going to be protected forever.
Pat Klaers, City Administrator stated that by identifying the property
on the map, the City is notifying the public that when the property

owner is willing to sell, the City would like to be considered as a
potential buyer. Mr. Klaers reviewed the goals and objectives of the
master park plan. He indicated that the priorities of the plan follow
the community survey that was conducted in December 1989, by Decision
Resources Ltd. Mr. Klaers stated that the City has the Hillside and
Woodland Trails Park Plans as well as a copy of the Master Park Plan
available at City Hall.

B. MASTER PARK PLAN
Chairman Kimball opened the public hearing. The master park plan was
discussed during the discussion of the Pathway Plan. Chairman Kimball
closed the public hearing.
COMMISSIONER EBERELY MOVED TO RECOMMEND TO THE CITY COUNCIL APPROVAL OF
THE ELK RIVER PARK AND RECREATION PLAN AS PREPARED BY THE ELK RIVER
PARK AND RECREATION COMMISSION AND TO INCORPORATE IT INTO THE GROWTH
MANAGEMENT PLAN. COMMISSIONER BISCHOFF SECONDED THE MOTION. THE
MOTION CARRIED 5-0.
A ten minutes recess was taken at this time.
C. FOCUS AREA STUDIES
Chairman Kimball opened the public hearing.
Janelle Szklarski, Zoning Assistant, stated that the City has just
received the final draft of the focus area studies. Ms. Szklarski
indicated that the text needs to be officially adopted as an addendum
to the City's Growth Management Plan.

definitions in the Elk River Code of Ordinances which either need to
be added or modified. Tim Keane, City Attorney explained the terms for
Governmental Building and Facility and Governmental Offices.

Plannin~ Commission Update
A - MOBILE WORKSHOP (9/18/90) - Chairman Kimball asked the Commission
if they had any additional items to add to the Mobile Workshop agenda.
Chairman Kimball stated that Conteck would be discussed if they were
in operation. He indicated that Sherri Borquist would be present to
identify some weed sites.
B - MODEL WEED ORDINANCE - There was no discussion on the model weed
ordinance.
C - JOINT CITY COUNCIL AND PLANNING COMMISSION MEETING (9/13/90) - It
was the general consensus of the Commission that they would like to
discuss Home Occupations and Hohlan' s Mobile Home Park at the joint
meeting. Arlon Fuchs indicated that he would like to see some tests
done to determine what is being burned in County Market's incinerator.
14. Adjournment
There being no further business, COMMISSIONER EBERLEY MOVED TO ADJOURN
THE MEETING. COMMISSIONER VANVALKENBURG SECONDED THE MOTION. THE
MOTION CARRIED 5-0.
The meeting of the Elk River Planning Commission adjourned at approximately
10:50 p.m.
