04-25-1989 PC MIN . . . MINUTES OF THE ELK RIVER PLANNING COMMISSION HELD AT THE ELK RIVER PUBLIC LIBRARY APRIL 25. 1989 Members Present: Chairman Kimball. Commissioners Johnson. Olsen. Schroeder. Eber1ey. Morton and Fuchs Members Absent: None Staff Present: Stephen Rohlf. Building & Zoning Administrator; Steven Bjork. Zoning Assistant 1. Pursuant to due call and notice thereof. the meeting of the Elk River Planning Commission was called to order at 7:00 p.m. 2. Consider 4/25/89 Planning Commission Agenda Commissioner Fuchs requested that Item 7.5 - "Accuracy of Information Received" be added to the agenda. COMMISSIONER FUCHS MOVED TO APPROVE THE 4/25/89 PLANNING COMMISSION MINUTES AS AMENDED. COMMI SSIONER EBERLEY SECONDED THE MOTION. THE MOTION CARRIED 7~0. 3. Consider 3/28/89 Planning Commission Mintues COMMISSIONER FUCHS MOVED TO MINUTES. COMMISSIONER OLSEN 7-0. THE THE 3/28/89 PLANNING COMMISSION MOTION. THE MOTION CARRIED APPROVE SECONDED 4. Consideration of Variance Request by Dennis Peterson/P.H. This item was withdrawn at petitioner's request. 5. Variance Request by Security Financia1/P.H. Steve Rohlf. Building and Zoning Administrator suggested moving this item to the end of the agenda as the petitioners were not present for this item. 6. Conditional Use Permit by Northstar Service Center/P.H. Chairman Kimball read the seven standards for granting a conditional use permit. Chairman Kimball explained that the seven standards have to be met in order for a conditional use permit to be approved. Steve Bjork explained that the applicant is requesting a conditional use permit to operate a used car sales operation and truck terminal. Basically, this is the same request that was before the Planning Commission before with a few minor changes. The major change is that Northstar will be discontinuing the sale of gasoline. The applicant has submitted a letter explaining the changes they have made to the site. Chairman Kimball opened the public hearing. There being no one for or against the matter, Chairman Kimball closed the public hearing. Planning Commission Minutes April 25. 1989 . Mr. Rick Wooten was present and briefly explained his request. Mr. Wooten indicated that in order to get the bank to finance their operation. the bank is requesting that the tanks be removed. Mr. Wooten further indicated that the Trademark sign had been removed and the pillars would also be removed. Mr. Wooten further noted that the agricultural easement across their property was originally put in for Erwin Specht to reach his agricultural property on the west. Mr. Wooten stated that they would not obstruct this easement. The area in front we intend to seed with grass and a few shrubs. This area then would no longer be used for the parking of vehicles. Also. this would be similar to what we would be doing on 165th. the 10 ft. area that we have to stay away from the curb. Discussion was held regarding the parking of semi-trailers. Steve Rohlf. Building and Zoning Administrator felt that bituminous would be a mistake as semi-trailers tend to sink in on hot days. Staff's concern is that the truck terminal be surfaced with a material to control dust. Steve explained that what has been done with other truck terminals is either crushed bituminous or some sort of rock to hold down the dust. This would be consistent with what was done with Metropolitan Gravel. Steve questioned Mr. Wooten whether he would be opposed to putting some type of rock down. Mr. Wooten indicated that parking trailers on cement would be very expensive and would go along with staff's request. . Commissioner Johnson was concerned about the LP tanks and what was being done about this. Mr. Wooten indicated that the tanks would be removed by the end of the week. Discussion was held regarding lighting. It was the consensus of the Commission that they would like the lighting directed away from the right-of-way. Mr. Wooten indicated they would be replacing the lighting as the old lighting was not economical. Mr. Wooten was in agreement with staff and felt that lighting would not be a problem. COMMISSIONER FUCHS MOVED TO APPROVE THE CONDITIONAL USE PERMIT FOR THE USED CAR SALES OPERATION FOR NORTH STAR SERVICE CENTER BASED UPON THE FINDINGS OF FACT WITH THE STIPULATIONS AS OUTLINED IN NORTH STAR SERVICE CENTER'S LETTER WITH ADJUSTMENTS TO NO.1. 2. AND 4. AND THE FOLLOWING RECOMMENDATIONS BY THE PLANNING COMMISSION: 1. SET-BACK AREA ALONG SMOOTH ROCK. WITH BARRIER IS TO BE 165TH AVENUE N.W. TO BE GRADED. COVERED WITH SHRUBS PLANTED AT APPROPRIATE INTERVALS. A. ERECTED BETWEEN THIS AREA AND CAR DISPLAY AREA. 2. ASPHALT PAVING ON EAST END OF LOT IN CAR DISPLAY AREA TO BE ADDED. 3. GARBAGE RECEPTACLE TO BE INSTALLED BEHIND BUILDING AND SURROUNDED FOR PRIVACY. 4. FUEL PUMPS AND. ISLANDS. AND TANKS TO BE REMOVED. . 5. FREE-STANDING PRODUCT SIGN AND BASE TO BE REMOVED. 2. . . . ALL TENANTS HAVE BEEN ADVISED TO REMOVE UNNECESSARY VEHICLES AND ANY OTHER JUNK. 10. THAT NORTH STAR BE IN COMPLIANCE WITH ALL THESE STIPULATIONS PRIOR TO THE 6 MONTH REVIEW. 11. THAT THE 10 FT. SETBACK FROM THE CURB BE CHANGED TO 10 FT. FROM THE PROPERTY LINE. 12. ANY PROPOSED LIGHTING SHALL BE DIRECTED AWAY FROM THE RIGHT-OF-WAY. TOWARDS THE SALES AREA. 13. INSTALL A 6 FT. OPAQUE FENCE ON THE WEST SIDE OF THE BUILDING FOR ANY OUTSIDE STORAGE. 14. SIGNAGE FOR THE USED CAR SALES OPERATION SHALL BE LIMITED TO WALL SIGNAGE ONLY. 15. DISPLAY OF VEHICLES SHALL NOT BE PERMITTED WITHIN THE PUBLIC-RIGHT- OF-WAY. 16. IN THE EVENT THAT PARKING BECOMES A PROBLEM AT THIS SITE. THE APPLICANT MUST STRIPE THE REQUIRED NUMBER OF OFF STREET PARKING STALLS FOR THIS SITE (TWENTY-ONE) STALLS ARE REQUIRED.) 17. THE 25 FT. EASEMENT ADJACENT TO HIGHWAY 10 SHALL BE UNOBSTRUCTED AT ALL TIMES. - 18. THAT THE TRUCK TERMINAL BE SURFACED WITH CRUSHED BITUMINOUS. 19. THE FINAL DRAINAGE PLAN SHALL BE ACCEPTABLE TO THE CITY ENGINEER. COMMISSIONER SCHROEDER SECONDED THE MOTION. THE MOTION CARRIED 7-0. COMMISSIONER SCHROEDER MOVED TO RECOMMEND TO THE CITY COUNCIL APPROVAL FOR A CONDITIONAL USE PERMIT REQUEST BY NORTH STAR SERVICE CENTER FOR A TRUCK TERMINAL WITH THE SAME STIPULATIONS AS OUTLINED FOR THE USED CAR SALES. COMMISSIONER JOHNSON SECONDED THE MOTION. THE MOTION CARRIED 7-0. 7. Conditional Use Permit/Pro Motors/P.H. Zoning Assistant. Steve Bjork indicated that Pro Motors is requesting a conditional use permit to operate an RV sales lot at 11044 167th Ave. NW. The applicant is also proposing an auto detailing area located to the west of the existing building. Staff does have some concerns with this regarding the drainage. 3. . . . Planning Commission Minutes April 25. 1989 Chairman Kimball opened the public hearing. There being no one for or against the matter. Chairman Kimball closed the public hearing. Commissioner Olsen was concerned with RV's entering and exiting the property from their East entrance off of 167th Avenue. The applicant indicated that only customers will be using the east entrance and the west entrance will be used for the accessing of large vehicles. Commissioner Fuchs was also concerned with 167th Avenue and would like the frontage road left. open. Commissioner Fuchs questioned the test driving of RV's. The applicant indicated that all test driving of vehicles will be done only on Highway 10. The applicant further indicated that no test driving will take place in the residential area to the west of the property. COMMISSIONER EBERLEY MOVED TO RECOMMEND TO THE CITY COUNCIL APPROVAL FOR A CONDITIONAL USE PERMIT BY PRO MOTORS BASED UPON THE FINDINGS OF FACT SUBJECT TO THE NINE STIPULATIONS AS OUTLINED IN STAFF'S MEMO WITH ADJUSTMENT TO NO. 4 AND NO. 5 ALSO WITH THE ADDITIONAL SIX STIPULATIONS: 1 . THE SITE SHALL BE DEVELOPED AS PER THE APPROVED SITE PLAN. 2. THE DISPLAY AREA SHALL BE HARDSURFACED AND DUST FREE. 3. THE DISPLAY OF VEHICLES SHALL NOT BE PERMITTED ON ANY AREAS INDICATED AS GREEN AREA ON THE SITE PLAN. 4. SIGNAGE SHALL BE INSTALLED TO DIRECT LARGER VEHICLES TO USE THE WEST ENTRANCE. 5. NO TEST DRIVING OF VEHICLES SHALL BE PERMITTED IN THE RESIDENTIAL AREA LOCATED TO THE WEST OF THIS SITE. 6. FUTURE LIGHTING SHALL BE AS PER CITY CODE. 7. FINAL DRAINAGE TO BE APPROVED BY CITY ENGINEER. 8. THE AUTO DETAILING AREA SHALL BE USED SOLELY BY PRO MOTORS AND NOT BE OPEN TO THE PUBLIC. 9. THE CONDITIONAL USE PERMIT SHALL BE SUBJECT TO A SIX MONTH AND ONE YEAR REVIEW. 10. ANY ADDITIONAL SIGNAGE BE PER CITY CODE. 11. SALES AND DISPLAY SHALL BE LIMITED TO RV'S. TRUCKS AND CARS. 12. TRASH RECEPTACLE SHALL BE SCREENED. 13. ALL IMPROVEMENTS SHALL BE DONE BY THE SIX MONTH REVIEW. 14. MAINTAIN 25 FT. FROM THE END OF ALL STALLS TO ANY DISPLAY AREA. STREET PARKING OFF 4. . . . Planning Commission Minutes April 25. 1989 15. FINAL DRAINAGE PLAN SHALL BE APPROVED BY THE CITY ENGINEER. COMMISSIONER MORTON SECONDED THE MOTION. THE MOTION CARRIED 7-0. 7.5 Accuracy of Information Received Commissioner Fuchs was concerned with the accuracy of plans not drawn to scale. Staff showed that they were. Mr. Fuchs also questioned the park dedication in Deerfie1d 4th. Steve Rohlf. Building and Zoning explained that the plat for Deerfie1d 4th is actually 29.7 acres not 33 acres; therefore. the park dedication land size should be smaller than the 3.3. acres originally requested. Mr. Rohlf further indicated that two of the remaining three sets of plans being questioned are to scale. but do not have very many dimensions and the last set of plans being questioned was accepted by the Planning Commission at their meeting. 5. Variance Request by Security Financial The applicant consensus of recommendation failed to appear for this meeting. Therefore. it was the the Planning Commission to maintain its original to deny the signage variance request. 8. General Discussion Steve Rohlf. Building and Zoning Administrator reviewed his discussion items with the Planning Commission at this time. 9. Planning Commission Representative to Attend Council Meeting on May 1. 1989 and May 15. 1989. It was indicated that Commissioner Fuchs would attend the May 1. 1989 City Council meeting and Commissioner Eber1ey would attend the May 15. 1989 City Council meeting. 10. Adjournment There being no further business. COMMISSIONER OLSEN MOVED TO ADJOURN THE MEETING. COMMISSIONER SCHROEDER SECONDED THE MOTION. THE MOTION CARRIED 7-0.
