Mr. Bjork further indicated that he had discussed with the applicant
splitting of the two parcels. If the parcels were split they would not
meet the dimensional regulations required for the C-3. Since this
property is located within a PUD, you can establish different dimensional
regulations and if it is the concensus of the Planning Commission that
this is allowable, then setbacks and lot frontage requirements should be
established. Mr. Bjork indicated that PUD standards allow for smaller
lots than what is required by City code.
Mr. Bjork explained that we do not have a definition for gas service
stations. We do have a definition for Motor Vehicle Service Stations.
Staff made the interpretation that a Gas Service Station would be
classified as a Motor Vehicle Service Station. The applicant is
proposing to locate a "Quick Lube" operation within the 1,000 sq. ft.
structure. If its determined that a "Quick Lube" may be appropriate for

that site certain conditions can be placed on it. Steve Bjork further
indicated that the Planning Commission will have to act on the two
issues; amendment for multiple structures to allow motor vehicle service
stations on that site.

indicated that "Quick Lubes" are relatively new and felt that this would
be compatible with the existing car wash.
Merle Artac of Penz Oil (future supplier for "Quick Lube) was present
and indicated that they were very interested in the aesthetics of the
building. Mr. Artac indicated that they felt it was important to develop
a building that attracts people. We feel that this type of business will
fit in well with the car wash next door. Mr. Artac explained that Penz
Oil has a lot of experience developing lube centers as they are the major
supplier of all these types of outlets.

At this time, Steve Rohlf, Building and Zoning Administrator gave a brief
history regarding the two drives on the lot . Mr. Rohlf indicated that
this was originally proposed as a furniture store. There were originally
three drives proposed. Mr. Rohlf further noted, that as far as
additional accesses on Freeport, it was the City that would not allow
additional entrances. A reciprocal parking and drive agreement for all
three lots was entered into.
Steve Rohlf further indicated that all the traffic flow has been reviewed
by staff and they have no problem with this.

much better than a lot of other Quick Lubes he had patronized.
Commissioner Schroeder did not feel there was a problem with the lot size
and traffic flow. Commissioner Schroeder noted that the Quick Lubes in
the Twin Cities have a much smaller piece of property than what is
located here. He felt the "Car Wash" and "Quick Lube" go together.
Mr. Artac indicated that traffic should not be a problem. Mr. Artac
explained that the Car Wash has eight times as many cars per day as the
"Quick Lube" He stated that we are selling time and convenience. This
type of service will be completed in about 10 minutes.

Commissioner Fuchs felt that this business would better fit another piece
of property and would like to see the structure moved further back as
this business will be setting out front in the shopping center. Steve
Bjork indicated that there are constraints from building farther back
because of the storm water sewer there. If this wasn't there they would
be able to move the building back off Freeport. Mr Bjork further
explained that you can control the building with setbacks and also can
place limitation on the building.
Commissioner Eberley indicated she would like to see more green space.

Commission requires that.

this time to clarify the issues. He further indicated that the
underlying land use is Highway Commercial. Typically we require one
acre for that zoning designation per structure. The petitioner is
short on acreage for two structures. Staff felt that the parking and

Don Schroeder explained that they had a revised site plan from Penz Oil
showing a 40 ft. by 30 ft. building. Mr. Schroeder indicated that the
reason they wanted the additional 10 ft. was to expand the waiting area.
The new plan shows a bigger waiting area. This would put us within 11
ft. from the property line with the building. Mr. Schroeder further
indicated that if the future expansion was a problem they would eliminate
this.
Mr. Artac indicated that they had reviewed a number of sites in town and
demographically this site ties in the best with the car wash to run a
successful operation. Mr. Artac indicated that they would like to rework
their plan to accommodate the Commission's concerns rather than look for
a new site. Mr. Artac further indicated that this corner of the mall was
a very popular site as this is going to be servicing a lot of people from
the community. This seems to be a favorite site and if at all possible
we would like to rework our plans.
COMMISSIONER EBERLEY MOVED TO RECOMMEND TO THE CITY COUNCIL THAT THIS
ISSUE BE TABLED UNITL THE FOLLOWING MONTH TO ALLOW THE PETITIONERS TO
WORK ON AN ALTERNATIVE PLAN. COMMISSIONER FUCHS SECONDED THE MOTION.

Steve Bjork indicated that since this is not the site plan you want. you
should problably table the site plan review and PUD Agreement to allow
two structures on this lot. Mr. Bjork further indicated that they could
also consider the "Motor Vehicle Service Station" request. but suggested
tabling this also so staff could have time to come back with new
definitions for "Motor Vehicle Service Station" and "Auto Repair Shops"
to differentiate between the two operations.

Commissioner Eberely would like to see more more relief from asphalt and
concrete.
Steve Rohlf, Building and Zoning Administrator, questioned the
petitioners on whether the internal water and storm sewer was private or
public. Mr. Rohlf further explained that when the petitioners come back
with a new site plan to let staff know if this is private or public as
there were easements to protect. Mr. Rohlf further indicated that he
felt it was vital that the peitioners show all easements on this site.
Mr. Rohlf indicated you could be placing your buildings on top of an
easement.
5. Conditional Use Permit by Elk River Utilities/P.R.
Steve Rohlf, Building and Zoning Administrator, explained that Elk River
Municipal Utilities is requesting a conditional use permit to allow a
Governmental Facility to construct a storage shed for storing
transformers for testing of PCB's. This facility is proposed to be
located at 1705 Main Street. Mr. Rohlf recommended three things that
should be considered if this Government Facility is allowed in this
area:
1.
The design and use of the building done as such to lower potential
of a fire.
2. That there is a solid plan for who is contacted if there is an fire.
What are the procedures and what are the steps to avoid a confusion?
3. On-going inspection to make sure that the dike area is in tack.
Chairman Kimball opened the public hearing. There being on one for or
against the request, Chairman Kimball closed the public hearing.
Bill Birrenkott of Elk River Utilities explained that a portion of the
proposed building would be used for storing of transformers. The
remainder of the facility would be used for other utility equipment and
inventory. Mr. Birrenkott further explained that once you take a
transformer down with the intention of not reusing it again, the law says
they have to assume that they contain PCB's. While you test the
transformers and make the assumptions they contain PCB's, they are stored
in a diked area. Mr. Birrenkott indicated that if a transformer is found
to have PCB's they are removed as as possible.
Commissioner Johnson questioned Mr. Birrenkott on how soon the
transformers would be removed if found to have PCB's. Commissioner
Johnson indicated she was uncomfortable with "as soon as possible."
Mr. Birrenkott indicated that the transporter would come from South
Dakota within a week or two. We are just now becoming aware of the
things we have to do. The parties from South Dakota do not do the
testing. We have just received sample bottles to do the testing. Three
weeks after you draw the samples you will get results back.

Steve Rohlf. Building and Zoning Administrator noted that the impacts of
PCB's has only recently become known. I feel this can be done properly.
but with the possibility of PCB's its prudent for the City to deal with
the transformers as PCB contaminates.
Commissioner Johnson questioned staff on why this was called a
"Governmental Facility" and not an "Accessory Building" and how do we
determine the difference? Steve Rohlf explained that he had talked to the
City Attorney and they agreed that Government Facility was a use by
itself and both staff and the City Attorney felt Governmental Facility is
consistent with the Comprehensive Plan. They also felt this was too
broad of a term that staff should define Governmental Facility more
specifically. Commissioner Johnson felt that this site is an industrial
type use. What would happen if they expand as this is on the river next
to a residential distrtict?
Commissioner Eberley questioned the "Spill Prevention Control and
Countermeasure Plan." as to what it is. where it is. and also who is
responsible to see that this is carried out? Bill Birrenkott explained
that they do have a plan on file which entails notifying both the State
and Federal. rope off the area and take samples to determine whether
there is PCB's in the soils in case of a dangerous spill.

case of a fire in which potential contaminates are stored.
Steve Rohlf suggested separating the transformer storage from the
rest of the building with firewalls. Bill Birrenkott felt this would be
expensive. Mr. Birrenkott felt that if there was that much concern
regarding this issue. maybe they shouldn't even be thinking about it.
Mr. Birrenkott indicated all this really entails is a tin roof and diked
area. Transformers need to be protected from the rain in a diked
area.

concern regarding fire and the toxins given off from PCB's when
burn. which is one of the most toxic things known to man today.
Commissioner Fuchs indicated he would prefer to see the transformer
storage at the Utility Site. He further indicated that the Utility
property on Cty. Road 1 is an unstatisfactory site as it is directly down
wind from the school in case of a fire. Commissioner Fuchs explained
that he could foresee sheet rocking two walls for fire protection for the
building that he is proposing.

Steve Rohlf indicated that the main concerns are keeping PCB's from the
ground water. the river and from burning. Mr. Rohlf indicated that
sheet rocking two walls would be inexpensive and gives a comfort level if
fire breaks out in other parts of the building that it would not affect
the transformers prior to the Fire Department getting there. Mr. Rohlf
indicated for a fairly inexpensive condition you CQuld alleviate a major
concern.

COMMISSIONER FUCHS MOVED TO RECOMMEND TO THE CITY COUNCIL APPORVAL OF THE
CONDITIONAL USE PERMIT BY ELK RIVER MUNICIPAL UTILITIES TO CONSTRUCT A
STORAGE SHED FOR STORING TRANSFORMERS FOR TESTING OF PCB'S WITH THE
FOLLOWING CONDITIONS:
1. THAT THE DIKED STORAGE AREA FOR THE TRANSFORMERS HAS ENOUGH CAPACITY
TO MEET THE FEDERAL REGULATIONS. FURTHER. ALL OTHER DESIGN CRITERIA
FOR THAT DIKED AREA MUST BE MET.
2. THAT THE UTILITIES GET APPROVAL OF A VARIANCE FOR METAL SKINNED
CONSTRUCTION OR CHANGE THEIR DESIGN.
3. THAT SOIL BORINGS ARE REQUIRED TO ASSURE THAT THE DIKED AREA WILL
NOT SETTLE AND CRACK.
4. THAT THE TRANSFORMER STORAGE AREA BE SEPARATED FROM THE REST OF THE
BUILDING BY SHEETROCK FIREWALLS
5. THAT THE UTILITIES "SPILL AND PREVENTION CONTROL AND COUNTERMEASURE
PLAN" BE APPROVED BY JOHN LICHNER OF LIESCH AND ASSOCIATES AND COpy
SENT TO RUSS ANDERSON. FIRE CHIEF.
6.
THAT THE TRANSFORMER STORAGE AREA BE INSPECTED ANNUALLY BY THE
BUILDING AND ZONING DEPARTMENT.
7. THAT THE FIRE CHIEF AND EMERGENCY PREPARDNESS OFFICER REVIEW
CONDITIONS AND PRESENT EMERGENCY PLANS.
COMMISSIONER EBERLEY SECONDED THE MOTION. THE MOTION CARRIED 4-1.
This recommendation was based upon the findings of fact that Governmental
Facilities have been identified in our ordinance as being consistent with
the Comprehensive Plan. Since we amended our ordinance they are allowed
in residential areas and that development of this proposal is properly
done as it will not affect adjacent property owners.
Commissioner Johnson was opposed to this request as she felt this was an
expansion of an industrial use in a residential area.
The next topic discussed was the variance request.
Steve Rohlf explained that Tim Keane's interpretation is that this is not
a use variance. it is a variance on a standard. The Planning Commission
must weigh out the metal skin exterior question by the five standards
for a variance. Steve further explained that if the Utilities wish to
pursue the metal skin exterior. they must apply for a variance. In order
to not delay Mr. Birrenkott's request. I am asking for a recommendation
from the Planning Commission. This will be advertised as a variance
prior to the City Council meeting. The public will also be notified prior
to the City Council meeting.

STRUCTURE ON THE LOT.
COMMISSIONER EBERLEY SECONDED THE MOTION. THE MOTION CARRIED 2-3.
The motion was defeated 2-3. Commissioner Kimball, Johnson and Schroeder
disagree~; with the findings of fact as they did not consider this a
hardship.
6.
Variance Request by Bill Klemz/P.H.
Steve Rohlf, Building and Zoning Administrator, indicated that Mr. & Mrs.
William Klemz are requesting a variance for a 32 ft. encroachment on the
75 ft. setback required from Lake Orono to accommodate an addition to his
house located at 12897 Orono Road.
Chairman Kimball opened the public hearing. There being no one for or
against the matter, Chairman Kimball closed the public hearing.
COMMISSIONER JOHNSON MOVED TO RECOMMEND TO THE CITY COUNCIL APPROVAL OF
THE VARIANCE REQUEST FOR A 32 FT. ENCROACHMENT ON THE 75 FT. SETBACK TO
ACCOMMODATE AN ADDITION REQUESTED BY MR. & MRS. WILLIAM KLEMZ OF 12897
ORONO ROAD BASED UPON THE FACT THAT THE KLEMZ MET THE FIVE STANDARDS AS
OUTLINED IN STAFF'S MEMO. COMMISSIONER SCHROEDER SECONDED THE MOTION.
THE MOTION CARRIED 5-0.
7. Past Approvals by Gary Santwire
Steve Rohlf, Building and Zoning Administrator, updated the Commission on
this issue as outlined in his memo dated July 25, 1989.
Mr. Santwire explained the changes on the site plans from what was
originally approved by the Planning Commission. Mr. Santwire indicated
that the former Building Inspector authorized these changes.

It was eXplained by Steve Rohlf that when a site plan is revised
everything prior to that is void and all stipulations placed on it will
not be referenced back, they will be reinstated. I feel that this pretty
much cleans up the issue. This was a confusing issue for everyone.

Gary Santwire explained his signage request at this time indicating the
signage will consist of 24 inch lettering with a 38 inch white surface
and a 5 inch border all the way across. Mr. Santwire further indicated
that they would like to construct a 10' x 5' off site sign to be located
on Dodge Avenue. This sign would be to direct people back to 580 Dodge.
After substantial discussion regarding signage, the consensus of the
Commissioners was as follows:
The Commissioners were in agreement that Mr. Santwire did not need that
much signage on the building when Mr. Santwire was requesting additional
signage located on Dodge Avenue.
Mr. Santwire indicated that it is a proven fact that when your a certain
distance away, the lettering has to be a certain size to be able to read
it. Mr. Santwire indicated that 12" lettering is not large enough to
read from the service road because of the distance that they are set
back.
Commissioner Johnson indicated she was comfortable with what is allowed
under the C-3 standards. Chairman Kimball and Commissioner Eber1ey were
in agreement with Commissioner Johnson.

Commissioner Fuchs felt they were in excess of 84 sq. ft. with what
would be allowed for the C-3 standards. He indicated that he would like
to see the signage cut down to 25% from what is requested. This would
give Mr. Santwire a total of 168 sq. ft.
Steve Rohlf indicated that staff would like to see them stay with the C-3
standards. However, since this building is in a PUD, signage require-
ments can be altered.

The next topic discussed was the directional signage requested by Gary
Santwire.
Steve Rohlf, Building and Zoning Administrator indicated that the
boulevard sign is not on the property owned by the petitioners.
Therefore, it is not the City's problem but up to the petitioner to get
the owner's permission. Mr. Rohlf suggested this type of sign should be
called a "Permanent Area Identification Sign" for a development not an
advertising sign as there is a moratorium currently on any advertising
structures.

IDENTIFICATION SIGN REQUESTED BY GARY SANTWIRE AS SHOWN ON THE SITE PLAN.

COMMISSIONER FUCHS MOVED TO RECOMMEND THAT THE PARK DEDICATION FOR
COMMERCIAL AND INDUSTRIAL PROPERTY BE CHARGED $2,000 PER UNIT. A UNIT
WILL BE CONSIDERED ONE ACRE. A MINIMUM OF ONE UNIT WILL BE CHARGED.
ANYTHING OVER AN ACRE WILL BE CHARGED PROPORTIONAL TO WHAT THEY ARE OVER
AN ACRE. COMMISSIONER EBERLEY SECONDED THE MOTION. THE MOTION CARRIED 4-

Discussion of Planning Commission Budget
It was agreed after discussing this issue, Commission Johnson would
submit the budget to Pat Klaers, City Adminisrator.

Chairman Kimball would like to see the City budget for a video camera,
VCR and TV monitor for Planning Commission and City Council use.
12. Discussion on City Policies and Future Ordinance Amendments
Stephen Rohlf, Building and Zoning Administrator, suggested tabling this
item until the following Planning Commission meeting due to the lateness
of the meeting.
It was the consensus of the Planning Commission to hold a Planning
Commission workshop on August I, 1989 to be held at City Hall. The hours
would be from 7:00 a.m to 9:00 p.m. The issues to be discussed were as
follows:
1) Performance Standards for Commercial and Industrial Buildings.
2) Landscaping
3) Future Ordinance Amendments for Sign Ordinance.
