07-26-1988 PC MIN . . . MINUTES OF THE ELK RIVER PLANNING COMMISSION HELD AT THE ELK RIVER PUBLIC LIBRARY JULY 26. 1988 MEMBERS PRESENT: Chairman Kropuenske. Commissioner's Johnson. Olsen. Kimball and Fuchs MEMBERS ABSENT: Commissioner Morton and Barrett STAFF PRESENT: Stephen Rohlf. Building and Zoning Administrator; and Steve Bjork. Zoning Assistant 1. Pursuant to due call and notice thereof. the meeting of the Elk River Planning Commission was called to order at 7:00 p.m. 2. Consider 7/26/88 Planning Commission Agenda Item 12.5 - follow up review of stipulations set on conditional use permit was added to the agenda. 3. Consider 6/28/88 Planning Commission Minutes Commissioner Fuchs noted that on page 3. paragraph 10. it should say "agreeable" instead of "agreedable." Also on page 4. the motion should read 5-0 with one abstension. On page 6. the motion to have Staff pursue the moving of the powerline above Ken Beaudry's property should be moved to page 5 following the motion for item #10. COMMISSIONER FUCHS MOVED TO APPROVED COMMISSIONER KIMBALL SECONDED THE MOTION. THE 6/28/88 MINUTES AS AMENDED. THE MOTION PASSED 5-0. 4. Consider Variance Request by Ross and Shelly Stark/Public Hearing Chairman Kropuenske read the five standards for granting a variance. Steve Bjork introduced the item by stating that Ross and Shelly Stark are requesting a 17 foot encroachment on the required 20 foot side yard setback in a R-IA zone. The building permit was issued in October of 1986 to Mr. Michael DeMars. At that time. the survey showed the structure having the necessary setbacks. When construction began. the the structure was inadvertantly moved to the south. The garage was also moved to the south side of the structure. The house was constructed at a 3 foot side yard seback instead of the required 20 foot setback. The applicants were not the owners at the time of construction. Chairman Kropuenske opened the public hearing. Since no one appeared for or against the item. Chairman Kropuenske closed the public hearing. COMMISSIONER OLSEN MOVED TO RECOMMEND TO THE CITY COUNCIL APPROVAL OF THE VARIANCE REQUEST BY ROSS AND SHELLY STARK FOR A 17 FOOT ENCROACHMENT ON THB RIQUIRBD 20 rOOT SIDE YARD SETBACK. Consider Variance Request and Multiple Principal Buildings by St. Andrew Church/Public Hearing Mr. Steve Shurt from St. Andrew Church stated why they felt that they met the standards for their request: 1. If the structure were not aligned as requested. the doors of the temporary building and the existing building would not align. This could be a hazard in an emergency. 2. The temporary structure does not have rest rooms. It would allow for better flow of traffic if it could be located as requested. 3. The temporary structure when be in the way of the permanent it were at the required setback. structure may constructed if Chairman Kropuenske opened the public hearing. There being no one for or against the item. Chairman Kropuenske closed the public hearing. COMMISSION KIMBALL MOVED TO RECOMMEND TO THE CITY COUNCIL APPROVAL OF THE VARIANCE REQUEST BY ST. ANDREWS CHURCH FOR A 17 FOOT ENCROACHMENT ON THE 30 FOOT FRONT YARD SETBACK REQUIREMENT AND A SECOND PRINCIPAL BUILDING ON THE LOT. COMMISSIONER JOHNSON SECONDED THE MOTION. THE MOTION PASSED 5-0. 6. Signage Information/Barrington Place PUD Staff felt it appropriate to inform the Planning Commission that several new signs will be installed at 592 Dodge Avenue. Building "A." The new signs are of a similar design as Domino's and Bates Video signs. Signs B. C. and D will be single lettering attached to the building. The signs are consistent with previous signage approval for this building. 7. Site Plan Review/Barrington Place PUD Steve Bjork introduced the item by stating that Gary Santwire is requesting a site plan approval for Lot 3. Block 6. Barrington Place. The proposed plan calls for the construction of a 8.530 square foot retail shopping center. Staffs only major concern is that he construct a spillway of concrete to eliminate the potential of erosion. Commissioner Fuchs questioned if the shopping center was going to be built on the parking lot of Goodyear Tire. Mr. Santwire noted that Goodyear's parking lot is three feet from the property line. Mr. Santwire stated that the building elevation would be equal to or 1 foot above Goodyear Tire. He also noted that the holding pond was private property and calculations have been made for its capacity taking into account Lot 3. Block 6. as developed. Commissioner Olsen asked what materials are to be used in construction. Mr. Santwire said it would be a stucco finish with color treatment on the awnings along the entire building. Page 3 . Commissioner Fuchs brought up screening around the dumpster. They will be putting timbers up around the area because of the rear elevation rising quite quickly. COMMISSIONER FUCHS MOVED TO RECOMMEND TO THE CITY COUNCIL APPROVAL OF THE SITE PLAN FOR BARRINGTON' PLACE PUD. LOT. 3. BLOCK 6. BARRINGTON PLACE. WITH THE FOLLOWING STIPULATIONS: THAT PARKING BE AS PRESENTED IN MEMO THAT THERE BE LANDSCAPING DONE INCLUDING A LAWN DUMPSTERS BE SCREENED AS PRESENTED THAT THE SPILLWAY BE CONSTRUCTED OF CONCRETE TO ELIMINATE FUTURE EROSION THAT SIGNAGE BE APPROVED AT A FUTURE DATE THAT THE ELEVATION BE EQUAL TO OR 1 FOOT ABOVE GOODYEAR TIRE THAT RUSS ANDERSON APPROVES THE PLANS FOR FIRE FIGHTING COMMISSIONER KIMBALL SECONDED THE MOTION. THE MOTION PASSED 5-0. 8. Multiple Principal Buildings Per Lot/Jerry Minor/P.H. Parking stall 117 was a concern. Perhaps it should be eliminated to avoid accidents and put up barricades there. Commissioner Fuchs questioned parking stall 14. It too could be a possible hazard. It would be in the way for getting to stalls 1, 2, and 3. Commissioner Kropuenske opened and closed the public hearing. Commissioner Fuchs suggested putting a fence or curb stop near stalls 13 & 14. Mr. Minor stated that the elevation drops severely at that point and there were big trees present. He thought it would be better to put a fence at the back of the building to the property line. Steve Rohlf said parking stall 14 could be eliminated and stalls I 1, 2, & 3 could be shifted over to the lot line. All parking drives would be hard surfaced. Discussion was held on exiting the lot. In the future a left turn lane could be put in on Highway 169. . THE MOTION CARRIED 5-0. 9. Consider Conditional Use Permit (Expansion of Parking Area) by Elk River Ford/P.H. Elk River Ford is requesting a conditional use permit to expand the parking lot to accommodate more new and used car displays at 17219 Highway 10. Discussion was held on screening between the subject area and the single family residence located to the south. Mr. Powell stated that he would do what was recommended when the time comes in regards to fencing. Commissioner Kimball questioned the signage. It was noted that there is a large free-standing sign that is grandfathered-in. Chairman Kropuenske opended the public hearing. There being no one for or against the item. Chairman Kropuenske closed the public hearing. COMMISSIONER KIMBALL MOVED TO RECOMMEND TO THE CITY COUNCIL APPROVAL OF THE CONDITIONAL USE PERMIT (EXPANSION OF A PARKING AREA) BY ELK RIVER FORD WITH THE FOLLOWING STIPULATIONS: 1. THAT THE DRAINAGE PLAN BE ACCEPTABLE TO THE CITY ENGINEER 2. THAT THE CAR WASH BE USED SOLELY BY ELK RIVER FORD FOR CAR DETAILING. 3. THAT LIGHTING FOR THE LOT BE DIRECTED AWAY FROM ADJACENT USES. COMMISSIONER FUCHS SECONDED THE MOTION. THE MOTION CARRIED 5-0. He further stated that there were a lot of unknowns in regards to the reliability of the liner. A discussion was held on ash. Elk River Landfill was not requesting an ash permit yet. Mr. Kreger liner is it. stated that the liner went through a series of tests. The used extensively across the country and he is very confident of Steve Rohlf noted that he spent several hours watching the installation of the liner and was impressed by the care in installation. Chairman Kropuenske opened the floor to the Commissioners and the public at this time. Brad Grabowski of 11631 219th Avenue NW was concerned about who did the testing of the wells. A lab certfied by the MPCA did the testing.
