1. The Meeting was called to order at 7:10 p.m. by Chairman Wilson.
2. Consideration of 1/27/87 Agenda
Jerry Hagen was present and requested to be added to the agenda for
consideration of a sign for County Market.
Chairman Wilson added Jerry Hagen to the agenda as item #13.5.

Peter Beck. City Attorney indicated that Northern States Power does not
have to go through the Conditonal Use Permit process for the Refuse
Derived Fuel Facility to be located in Elk River because of the fact that
that this item has already been considered. approved. granted and issued.

5. Consideration of Zone Change Request by Northern States Power Company
Public Hearing
City Attorney. Peter Beck. stated that NSP is requesting a zone change
for the RDF facility. He noted this request if for a solid waste overlay
district which would incorporate this solid waste overlay zone into the
existing industrial zone.
Chairman Wilson opened the public hearing. No one appeared for or
against the matter. Chairman Wilson closed the public hearing.
COMMISSIONER MORTON MOVED TO RECOMMEND TO THE CITY COUNCIL APPROVAL OF
THE RESOLUTION RECOMMENDING REZONING OF NORTHERN STATES POWER COMPANY
SOLID WASTE PROCESSING FACILITY SITE INTO THE SOLID WASTE FACILI'lY
OVERLAY DISTRICT. COMMISSIONER BARRETT SECONDED THE MOTION. THE MOTION
PASSED 5-0.
6. Consideration of Conditional Use Permit by United Power Association
Public Hearing
.
The Building and Zoning Administrator noted that the City's solid waste
ordinance requires United Power Association to go through a conditional
use permit. He noted it is required for UPA to present final plans and
specifications to the City before a conditional use permit can be
granted. Mr. Rohlf indicated the City has not. as of this time. received
final plans and specifications.
Mr. Dan MaConnon of United Power Association indicated the reason they
have no final plans and specifications is because Anoka County will not
give a release for the project until they have all the permits for the
project. which includes the conditional use permit. Mr. MaConnon stated
he cannot receive the Conditional Use Permit from the City until he has
final plans and specifications. and therefore is in a Catch 22 situation.
He further stated he is proposing to submit final engineering documents
as generated after the release of the project by Anoka County and further
that these documents would be released for review before construction
begins. Mr. MaConnon stated that he does have the preliminary plans and
specifications ready at this time.
Mr. Dan MaConnon reviewed the preliminary plans and specifications with
the Planning Commission. Mr. MaConnon explained they are proposing to
access UPA with the trucks from Highway #10 to Main Street to UPA Drive.
He noted there would be a new road created to Highway 169 with a right
turn in and right hand turn out to exit the site.
Commissioner Temple questioned whether the access by the train tracks
would pose a stacking problem. Mr. John K10vning indicated this would
not cause a stacking problem unless there were a train.

Mr. MaConnon indicated there would be no wash down in the receiving
building.

Mr. John K10vning of Cedar Corporation reviewed the performance standards
of the ROF facility. Mr. K10vning stated that UPA has certified that
all performance standards will meet MPCA specifications. Mr. K10vning
stated that the City should request total engineering drawings before the
building permit is issued. He indicated he is comfortable with the plans
and specifications assuming all performance standards do meet MPCA
regulations.
Commissioner Morton questioned whether there has been a written
commitment received from Burlington Northern for the crossing. Mr. Dan
MaConnon stated they have received no written commitment but they have
received a verbal commitment.
Commissioner Morton stated he was opposed to the trucks accessing the
plant via Highway 10 to Main Street and then to UPA. He indicated he
would prefer to see the trucks use Highway 10 and go directly to the UPA
Driveway. Mr. Steve Shurts stated he felt this was not a viable solution
as there were too many pedestrians using the access.
Chairman Wilson suggested using UPA's access just for the ash trucks in
order to keep these ash trucks off of East Main Street.
Commissioner Kimball stated he would rather see the traffic directed
through UPA with educated pedestrians and further that he would rather
see UPA take the brunt of the traffic.
Commissioner Barrett commented that Main Street would very likely be
changing in the next few years. He noted there could very well be a
restaurant or other type of business on the corner of Main Street and
Highway 10 as City Hall will be leaving the site.
Commissioner Morton questioned whether there were any plans to avoid rush
hour traffic. Mr. Dan MaConnon stated that this could be arranged in
order to alleviate traffic problems on major holidays.
Peter Beck reviewed the conditional use permit at this time.
Chairman Wilson opened the public hearing.
Mr. Tom Hartman of 18675 Macon Street questioned what type of trucks
would be hauling the ROF material. Mr. Glen Haas of NSP answered that
the ROF trucks would be hauling the material in an enclosed container and
further stated that the ash would be hauled in a covered trailer.
Mr. Gerald Schroeder of 13757 Is1andview Drive questioned whether MnDOT
has granted access onto Highway 169. Mr. Dan MaConnon stated that they
have received verbal confirmation only. Mr. Schroeder further stated
that he was not in favor of ROF trucks using the Main Street to UPA route
because of the fact that City Hall will be moving out and another type of
business would be in that area.

occurred. The Building and Zoning Administrator noted that this is
covered in the conditional use permit and also the solid waste ordinance.

Marilyn Schroeder of 13575 Is1andview Drive stated she is in favor of the
RDF trucks going from Highway 10 directly to UPA Drive and further stated
that an overwa1k could be provided to protect the UPA employees.
Marilyn Schroeder further suggested tha NSP provide some type of
recycling center. Mr. Pete Vanderpool stated he would be willing to work
with anyone regarding recycling.
Dave Sipe questioned who would be responsible for the testing of the
site. how frequently the site would be tested and how extensive. Mr.
Peter Beck. City Attorney stated that the City can use MPCA's testing
results or the City can hire their own expert to analyze the results.
which they have already done.
Mr. Dave Sipe stated he would like to know where the ash would be
located.
Mr. Tom Woods of 544 5th Street questioned how the CUP could be approved
without elaborate plans and specifications.
Dr. Bob Swan of 223 Morton Avenue stated that he feels. if the traffic is
routed from Highway 10 to Main Street to UPA Drive. this would affect the
aesthetics and beauty of Elk River.
Mr. Doug Wa1etzko of 19668 Ulysses Street stated that he has not heard
any complaints regarding th garbage trucks using Highway 169 to get to
the landfill nor has he heard any type of complaints regarding the 18
wheelers hauling gravel from our City.
Chairman Wilson closed the public hearing.
Commissioner Barrett noted he would like to keep the traffic away from
Highway 10 and the Main Street Intersection.

Commissioner Morton stated he would like the following wordage added to
the CUP: "All RDF and truck traffic must enter or exit the facility
directly from Highway 10 or Highway 169."
Chairman Wilson stated that all other people in the community have full
use of the City Streets and further stated that he did not feel this full
burden should be placed on UPA.
Commissioner Morton stated he would like to see something included in the
CUP regarding the operation of truck traffic during peak traffic hours.
Chairman Wilson noted that he was concerned regarding the transportation
of residue and what type of container would be used to haul this residue.
It was noted that the following wording be added to the conditional use
permit: "Final plans and secifications will be reviewed and approved by
City Staff prior to building permit issuance.

City Attorney, Peter Beck, explained the zone change request.

Mr. Sipe questioned if the zone change is fully for the benefit of the
general public. He further stated that he felt this was a poor location
for this type of zone.

Preliminary Plat Review for Oak Knoll/Public Hearing
Steve Rohlf. Building and Zoning Administrator. noted that Mr. & Mrs.
Robert Harris are subdividing their property of approximately 52.8 acres

Marian Foss questioned Mr. Harris as to whether the parcels could be
split into larger lots. She indicated this may eliminate the sewer
hazards with surrounding wells.

COMMISSIONER BARRETT MOVED TO RECOMMEND TO THE CITY COUNCIL APPROVAL OF
THE PRELIMINARY PLAT FOR OAK KNOLL WITH THE FOLLOWING STIPULATIONS:
1) THAT A 25 FOOT TEMPORARY EASEMENT BE INCLUDED ON COUNTY ROAD 35.
2) THAT LOTS 18 & 19 AND 20 & 21 HAVE SHARED DRIVEWAYS.

9. Consider Variance Request by New Creations/Public Hearing

stated that he felt that between the wrong survey and the topography
change towards the rear of the lot that his lot would meet the five
standards for a variance and; therefore. had allowed the builder to

Addition and stated he felt with the topography of the land he would
need a variance in order to build a house. He further stated he felt

10. Consider Variance Request by Standard Lumber/Public Hearing
The Building and Zoning Administrator noted that Standard Lumber Company
located at 728 Railroad Drive. is requsting a 48 foot variance to the
required 50 foot front yard setback to add an addition to their office.
Mr. Weiss of Standard Lumber explained to the Planning Commission that he
is proposing to add a 30 by 36 foot addition for an office and display
area. He further stated he would be adding a new front on the existing
building and stated these changes will be an improvement to the
appearance of the neighborhood. He further stated that the building at
the present time already encroaches within 3 feet of the lot line.

Mrs. Waletzko stated they own 4.6 acres of land with their existing home
on this land. She noted that they would like to split their land and
sell their home and also build another home on 2.5 acres of land. She
also indicated they have been paying taxes on 5.1 acres of land.

variance. Commissioner Temple stated she felt the Woletzko's were in
compliance with all five standards and therefore, would be in favor of
granting a variance.

THE .4 ACRE LOT SIZE VARIANCE REQUESTED BY DOUGLAS AND SHARON WALETZKO
NOT TO EXCEED 10% BY SPLITTING THE LAND IN HALF AND THAT THE PLANNING
COMMISSION BASE THEIR RECOMMENDATION FOR A VARIANCE ON THE ECONOMIC
SITUATION INVOLVED WITH THE LOT IN REGARDS TO ROADS, THE HISTORY OF THE
LAND AND ALSO THE RELATIONSHIP TO OTHER HOUSING IN THE AREA, AND FURTHER
THAT THE VARIANCE MEETS THE FIVE STANDARDS STIPULATED IN THE CITY

12. Conditional Use Permit Request by Elk River United Methodist Church
Public Hearing
The Building and Zoning Administrator noted that the United Methodist
Church is requesting a conditonal use permit to expand the church parking
lot. Mr. Robert McCartney, representative of the United Methodist
Church, explained that they are requesting to enlarge the parking lot so
as to bring it into compliance, as close as possible, to the City Code.

Amendment to Allow Kennels in Light and Medium Industrial
a Conditional Use Requested by Stoffel & Sandra Reitsma/Public
The Building and Zoning Administrator noted that Stoffel & Sandra Reitsma
of 10860 181st Avenue NW. in Elk River are requesting an ordinance
amendment to allow kennels as a conditional use within light industrial
zoned districts.
Mr. Stoffel stated he would like to start a boarding kennel and training
facility on 181st Avenue on 40 acres of land they own which is located in
a light industrial zone. He stated they would be away from the road and
also away from the property line.
Chairman Wilson opened the public hearing. No one appeared for or
against the matter. Chairman Wilson closed the public hearing.
Commissioner Barrett stated he was not opposed to the request and felt it
would not be a nuisance in an industrial zone.

OF THE ORDINANCE AMENDMENT REQUEST BY STOFFEL & SANDRA REITSMA TO ALLOW

The Building and Zoning Administrator noted that there was an ordinance
amendment before the Planning Commission to add daycares as a conditional
use in the following zones: A-1. R-1. R-2. R-3. R-4. C-1. C-2. C- 3A and
C-4.

John Weicht stated he is considering constructing a building for daycare
purposes on the corner of Proctor and School Street and questioned
whether or not this would be included in the ordinance amendment. The
Building and Zoning Administrator suggested that daycares be allowed on
property which would be called "commercial in nature."
After furter discussion. the Planning Commission concluded that the
property Mr. Weicht was referring to should possibly be rezoned rather
than be considered "commercial in nature" due to the fact this is very
hard to determine.

Discussion was carried on regarding model homes being allowed in R-2.
R-3. R- 4 and PUD zoned districts also. The Building and Zoning
Administrator indicated he would advertise those zones for the Council
meeting. Also. Peter Beck felt the performance standards should be in
Secton 900.20 instead of 900.28.
