1. The meeting was called to order at 7:00 p.m. by Chairman Wilson.
2. Consideration of 2/24/87 Planning Commission Agenda
Commissioner Kropuenske mentioned the possibility of setting a meeting
deadline time and possibly holding more than one meeting a month. It was
decided that this would be added to the agenda as item #17.5.

Consideration of Zone Change by Standard Lumber
Tom Wise was present to represent Standard Lumber of 728 Railroad Drive.
Elk River. Minnesota. Standard Lumber made a request to change Lot 4.
Block 10 Village of Elk River. currently zoned C-4/service commercial. to
I-1/light industrial. Mr. Wise stated that Standard Lumber agreed to put
up a cedar fence to enclose the area or build a building for storing
materials. The building would be painted steel or other type if
requested by City.

6. Consideration of Variance Request by Standard Lumber
Tom Wise was present on behalf of Standard Lumber to request a variance
be granted on Lot 4, Block 10, Village of Elk River to provide a 45 foot
encroachment on the 50 foot front yard setback requirement in a light
industrial zone on the north lot line along 4th street and a 10 foot
encroachment on the 25 foot setback along the east line of Lot 4, Block
10, Village of Elk River.
Wise explained that his would put the new steel structure in line with
others on the block and would enable Standard Lumber to utilize the back
portion of the lot to load and unload trucks. Mr. Wise also stated that
Standard Lumber would continue with a chain link fence on the north line
and would put up a cedar fence on the east line.

Consideration of Conditional Use Permit by Ann Bergstrom
Mrs. Ann Bergstrom of 19263 Lowell Street. Elk River, Minesota. was
present to request expanding her current conditional use permit (Home
Occupation--Beauty Shop) to add more square footage by removing an
interior wall. and to add an additional sytling station and one employee.
Chairman Wilson opened the public hearing. No one appeared for or
against the expansion of the conditional use permit. Chairman Wilson
closed the public hearing.
Stephen Rohlf stated that the only concern of the staff would be the

Consideration of Conditional Use Permit by Scott Mitchell (Dairy Queen)
Scott Mitchell of 10075 175th Avenue NW. Elk River. Minnesota was
present to request a 640 square foot addition to the Elk River Dairy
Queen located on Lots 1 and 2. Block 2. Houlton's Addition and also to
make the entire use a conditional use instead of a grand fathered or non-
conforming use. The Dairy Queen is currently in a C-3A Highway
Commercial District. Restaurants are a conditional use within a C-3A
district.
Mr. Mitchell's intent of the addition is to add handicap restrooms and
approximately enough seating for 28 customers. The addition would extend
out from the Dairy Queen toward 4th Street.
Chairman Wilson opened the public hearing. Stephen Rohlf. City Building
and Zoning Adminisntrator. read a letter on behalf of Patti Scharber.
Ms. Scharber's main concern of the addition is the parking.
A1 Brummer. neighboring property owner of the Elk River Dairy Queen on
the West side. felt that the parking at the Dairy Queen would be improved
with the expansion because the employees would be able to get customers
in and out faster.
Dale Lang of 19134 Twin Lakes Road. Elk River. Minnesota. stated that he
had lived in the house in which Patti Scharber is currently living and he
never noticed a problem with the Dairy Queen parking.

Stephen Rohlf suggested having one parking spot for each 75 square feet
of building size or one spot for each 4 seats plus 5 additional parking
spaces. Mr. Mitchell is to meet with the Staff to come up with a way to
maximize parking facilities.
Chairman Wilson suggested that once a plan was made for parking. stripes
should be painted in for the convenience of the customers.
Commissioner Fuchs began a discussion on the square footage of the
addition. He noted that the numbers on the sketch plan attached to the
memo did not match the numbers in the memo.
Commissioner Barrett mentioned the maintenance of the driveway around the
building. Chairman Wilson stated that such maintenance could be done by
painting arrows for directional purposes.

Minnesota.
Chairman Wilson opened the public hearing. There being no comments for

or kept for travel purposes.
Chairman Wilson opened the public hearing.
Mr. Brandt clarified that the propety is located on 209th Avenue and TWin
Lakes Road.
There being no further comments, Chairman Wilson closed the public
hearing.
A question was brought up by the Commission questioning Stephen Rohlf
about any current difficulties with similar situations. Mr. Rohlf stated
there were none that he knew of.
COMMISSIONER FUCHS MOVED TO RECOMMEND TO THE CITY COUNCIL APPROVAL OF THE
CONDITIONAL USE PERMIT REQUEST BY DALE LANG FOR A TEMPORARY MOBILE HOME
ON HIS PROPERTY DURING CONSTRUCTION OF HIS NEW HOME.
The condition was placed on this permit that the mobile home be
disconnected from the septic system at the time that Dale Lang and his
family move into their new residence.
COMMISSIONER TEMPLE SECONDED THE MOTION. THE MOTION CARRIED 6-0.
11.
Consideration of Zone Change Request by Gerald Smith
A public hearing was held at the request of Gerald Smith of 7815 Shingle
Creek Drive, Brooklyn Park, Minnesota, to request a zone change from R-
la/single family residential to R-1b/single family residential on the
property legally described as the SW 1/4 of the SW 1/4 of Section 26,
Township 33, Range 26, Sherburne County, Minnesota except the South 209
feet of the West 209 feet of the SW 1/4 of the SW 1/4.

In this zone change it would reduce the lot size from the required 1.600
square feet with 80 feet of frontage in the R-1A zone to 1.200 square
feet lot size with 75 feet of frontage for city sewered lots.
It was clarified that this parcel of land would have to be platted before
any number of homes could be built on the property. Questions were also
raised by the Commission regarding City water and sewer.
Chairman Wilson opened the public hearing.
Jerry Brandt showed great concern regarding the notice he received for
the public hearing and inaccuracy of the legal description being
considered for the zone change.
Mr. Smith clarified the error by stating that it was a misunderstanding
with the attorney. The entire piece of property was to be advertised.
but not all the property is to be changed.
Mr. Brandt also shared his concern regarding how far the city sewer will
eventually run. Stephen Rohlf answered this question by stating that it
would be quite some time before the entire city limits became city sewer.
Mr. Brandt also commented on assessments of the property.
Chairman Wilson closed the public hearing.

12. Sign Request by County Market
Jerry Hagen was present to request a 64 square foot reader board for
County Market to be placed on the Highway 169 side of the building. This
would be in addition to the present sign located on the north side of the
building.
Commissioner Fuchs questioned the continuation of the parking of trailers
and vans in the County Market parking lot for advertising. Mr. Hagen
stated that such parking would continue.
Discussion was held regarding the trucks parked in the front lot.
Commissioner Kimball would like a time limit placed on the trucks parked
in this lot for temporary advertisement. Stephen Rohlf stated that the
new sign ordinance would no longer allow vehicles to be used for
advertisement.

Commissioner Temple questioned Jerry Hagen as to the location of the
sign. Mr. Hagen turned the question back to the Commission for their
comments. It was the general consensus of the Commission to have the
sign attached to the side of the building and not the roof.
COMMISSIONER BARRETT MOVED TO RECOMMEND TO THE CITY COUNCIL THAT APPROVAL
BE GIVEN FOR AN ADDITIONAL SIGN ON THE COUNTY MARKET UNDER THE CONDITIONS
THAT THE READER BOARD NOT EXCEED 64 SQUARE FEET AND THAT THE READER BOARD
BE PLACED ON.THE BUILDING. COMMISSIONER TEMPLE SECONDED THE MOTION. THE
MOTION CARRIED 5-1. COMMISSIONER FUCHS OPPOSED.
13. Determination of Use and/or Conditional Use Permit (Army Recruiting
Station) by Barthel Construction
Stephen Rohlf summarized the situation of the Elk River Plaza and the PUD
Agreement. He explained that several uses are excluded from the mall.
one of which being office space.
Discussion took place regarding the office space going in across Highway
169. It was stated that the PUD Agreement on the west side of Highway
169 and that on the East side of the Highway are two separate agreements.
Commissioner Temple explained that. after discussion with the residents
in the area on the east side of 169. it was their request that the area
be made into office space instead of retail.
Chairman Wilson opened the public hearing.
Ed Orwa1 of Jean's Hallmark stated his beliefs that a service type
business does not bring as much traffic to the mall as a retailer.
Ann Rayman of the Paperback Book Exchange strongly objected to the idea
of office space in the mall. Ms. Rayman doesn't want to put businesses
currently not allowed in the PUD agreement in the mall just to fill empty
space.
Scott Ellingson of the Wedding Chapel stated that the service oriented
business in the mall does not benefit the retailers.
Jerry Hagen of County Market shared his agreement with the retailers but
also stated that he doesn't feel rental space should sit empty while
excluding someone with an opportunity.
Mary Fricke stated that the recruiters chose the mall as their first
location. She commented that the PUD across Highway 169 is a mixed
development and questioned how one defines the fine line between office
and ret~il.
Mr. Orwa11 stated that most store owners in the mall are first time
owners and they went with the idea that retail needs traffic. He
continued to say that many businesses in the mall do not require traffic
due to appointments or self providing.

Mary Fricke stated that the plan is not to change the intention of the
mall or to push over retailers.
Chairman Wilson closed the public hearing.
Chairman Wilson stated that the intent of the mall was to be fully retail
oriented. He would not like to see an amendment where retail and office
space would not compliment each other and feels that it would be a
disappointment if such an amendment were granted.
Commissioner Temple shared her idea of a mall as being a place to go from
shop to shop viewing a variety of items. not to be going past businesses.

AN ARMY RECRUITING STATION IS AN OFFICE AND THEREFORE REQUEST DENIAL FOR
THE LOCATION TO BE IN THE ELK RIVER MALL. COMMISSIONER KIMBALL SECONDED
THE MOTION. THE MOTION CARRIED 6-0.
14. Consideration of Conditional Use Permit (Temporary Real Estate Office)
by Barthel Construction
Barthel Construction was present to request a conditional use permit for
a temporary real estate office of Lot 15. Block 1. Presidential Estates.
City of Elk River.
Stephen Rohlf stated that temporary real estate offices are a conditional
use in Elk River. This matter has been ignored up until now due to the
lack of time by the City Staff. He noted that Ziegler Construction will
be appearing before the Commission in the near future to present a
similar request.
Chairman Wilson stated the main reason for the temporary real estate
office is to allow a builder to sell the homes in a specific development.
Stephen Rohlf clarified the difference between a model home and a
temporary real estate mainly being that the real estate office has full
time employees. Mr. Rohlf also stated that such real estate offices are
not out of the ordinary in new developments.
Chairman Wilson brought up the question of how long is a reasonable
amount of time to consider temporary.
Mr. Rohlf stated that the intent is to have the temporary real estate
office up to 85% completion of the development.

Commissioner Temple then suggested reaching a percentage as a definition
of temporary. Chairman Wilson questioned whether or not temporary would
apply to all real estate offices or just this situation.

15. Consideration of Conditional Use Permit (Covered Walkway) by Barthel
Construction
There was a site plan review by the City and the Commission for the
expansion of the Elk River Plaza Shopping Center. The original agreement
calls for an enclosed link whereas Barthel construction is now requesting
a covered walkway between the Elk River Plaza and the new expansion.
Ken Barthel. representing Barthel Construction of 21370 John Milless
Drive. Rogers. Minnesota. was present and explained the area affected.
The covered walkway would be in front of the buildings and would run from
Ben Franklin to Pamida including the further expansion.
The pros and cons of the covered walkway were discussed as the Commission
questioned Mr. Barthel on such items as far as public protection from
weather. cost and security.
Chairman Wilson opened the public hearing.
Scott Ellingson of the Wedding Chapel gave an example of the Crystal Mall
and stated that they have an enclosed link. He went on to say that a
video store in the mall is open until 11:00 p.m. In order to prevent the
public from going into other parts of the mall at that hour. Ellingson
said this mall has gates which are closed when the various other
businesses close.
Ed Orwall of Jean's Hallmark brought up factors such as weather and
safety. He gave the example of hauling small children from the mall to
Pamida in bad weather. Mr. Orwall stated that the covered walkway would
not be a form of protection from snow and rain. but only sun.
Commissioner Kimball questioed whether or not an enclosed link would
attract juvenile delinquents out to the mall area from downtown.
Scott Ellingson stated that a restaurant in the Crystal Mall is a
considerable traffic draw if it is a "joined" mall.

Ed Orwall and Kenny Barthel discussed the advantages and disadvantages of
the location of Pamida.
Bob Getchoff of Getchoff Theatres commented on the Cambridge Mall and the
link to Pamida.
Cindy Handley of Jean's Hallmark questioned the entrances to the mall and
various retail stores.
Wanda Gram of 1st Barber Stylist doesn't feel that this is a modern
shopping center. She is opposed to the idea of people having to go
outside each time they want to enter a different business.
John Basties of Sun Ray feels that "strip malls" are not going very well
in neighboring communities and that there would be a much larger traffic
flow if the mall were adjoining.
Scott Ellingson stated that the main reason he brought his business to
the Elk River Plaza is because it was to become an enclosed mall.
Chairman Wilson closed the public hearing.
Chairman Wilson stated the original intent of the mall is that it would
be fully enclosed. He eXplained that this was the most attractive idea
to the Planning Commission and the City Council.
COMMISSIONER FUCHS MOVED TO RECOMMEND TO THE CITY COUNCIL THE DENIAL OF
THE CONDITIONAL USE PERMIT FOR A COVERED WALKWAY BY BARTHEL
CONSTRUCTION AND THAT FURTHER RESEARCH SHOULD BE DONE ON AN ENCLOSED
LINK. COMMISSIONER KROPUENSKE SECONDED THE MOTION. THE MOTION CARRIED
5-0. COMMISSIONER BARRETT ABSTAINED.
16. Consideration of Ordinance Amendment Regarding Used Cars
Stephen Rohlf stated that this issue was addressed in 1984 but was not
published to make it legal. Mr. Rohlf briefly explained the ordinance
amendment to make used cars a conditional use within a C-3A Highway
Commercial zoned district.

17. Ordinance Amendments Tabled from January 27. 1987. Planning Commission
Meeting
Due to the late hour. these ordinance amendments were tabled again until
the March Planning Commission meeting. See motion under agenda item #8.
17.5.Planning Commission Meeting Cut Off Time
After discussion among the Commissioners. it was decided that it is
necessary to set a cut off time for Planning Commission meetings.
One suggestion was to possibly hold two Planning Commission meetings a
month. Stephen Rohlf stated that he would like to see a 12:00 midnight
cut off time. If there is only one or two agenda items left at this
time. they could finish. But. if there was half the agenda remaining an
additional meeting would be scheduled for the first Tuesday of the
following the meeting to be held at City Hall.
On the agendas. it will now be stated that there is a 12:00 midnight cut
off time to make the public atending aware. If an item should be carried
over to the "back up meeting." it is possible that the City will
renotify those involved.

COMMISSIONER KIMBALL MOVED THAT THE PLANNING COMMISSION MEETINGS HAVE A
12:00 MIDNIGHT DEADLINE AND FURTHER THAT IF THERE ARE ITEMS REMAINING ON
THE AGENDA AT THE DEADLINE TIME. THAT THESE ITEMS BE HEARD BY THE
PLANNING COMMISSION ON THE FOLLOWING TUESDAY. COMMISSIONER FUCHS
SECONDED THE MOTION. THE MOTION PASSED 6-0.

Ordinance Amendment/Sign Ordinance
COMMISSIONER FUCHS MOVED TO TABLE ITEMS 17 AND 18 BOTH IN REGARDS TO
ORDINANCE AMENDMENTS UNTIL STEPHEN ROHLF RETURNS THEM TO THE AGENDA.
COMMISSIONER BARRETT SECONDED THE MOTION. THE MOTION CARRIED 6-0.
19. Planning Commission Representative at 3/16/87 Council Meeting
Chairman Wilson announced that Commissioners Barrett and Kropuenske will
be representing the Planning Commission at the March 16. 1987 Elk River
City Council Meeting.
20. Adjournment
There being no further business. the meeting of the Elk River Planning
Commission adjourned at 12:00 midnight.
