RESOLUTION 05-
A RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION AUTHORIZING EMERGENCY REPLACEMENT OR REPAIR OF THE ICE
ARENA ROOF DAMAGED BY HAIL WITHOUT COMPETETIVE NOTICE OR
COMPETITIVE BIDS
WHEREAS Minnesota Statute 365.37, Subdivision 4 allows the city to contract without notice or
competitive bidding if a special emergency situation requires immediate action essential to
the health, safety, or welfare of the city; and
WHEREAS the Elk River Ice Arena has received damage from a hail storm that will result in continued
and serious loss to the property if the situation is not corrected immediately; and
WHEREAS ! the situation creates a serious threat to the health and safety of the people using the Ice
Arena; and,
WHEREAS the situation meets the criteria as an emergency situation given that it affects the health,
safety, or welfare of the community requiring immediate action, it occurred suddenly, and
the conditions of the building have worsened considerably as a result of the situation.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota that
the Ice Arena roof severely damaged by hail be replaced without notice and without competitive bids as
authorized by Minnesota Statutes in order to minimize additional damage to the structure and to minimize
the health and safety threats to its users.
Passed and adopted by the City Council of the City of Elk River, Minnesota, this 19th day of September,
2005.
