An amendment to this Conditional Use Permit will be required for future expansions/additions not shown on the site plan dated May 16, 2022. 9. A wetland delineation shall be completed and approved by the state. The updated boundary must be included on the final plat of Aggregate Commercial 61h Addition. 10. Staff approval of the Safety and Crisis Communication Plan. a. This plan shall be reviewed annually by all parties prior to May 1. 11. Staff approval of an on -site traffic/distribution plan that demonstrates: a. Logical on -site distribution of participants, spectators, and public safety. b. Adequate on -site stacking for admission and egress. c. Adequate off -site stacking for access and egress without impacting U.S. Highway 169. 12. The Aggregate Commercial 6th Addition plat (Case File PE 22-01) shall be recorded. Noise generated on the property via the Conditional Use Permit shall comply with those outlined in the MPCA Guide to Noise Control. 14. The changeable copy sign shall not exceed 70 square feet and must comply with the standards set forth in Sec. 30-864 (e). A sign permit is required. 15. A Minnesota Department of Natural Resources (DNR) Appropriation Permit shall be required for any water use that is above 10,000 gallons a day or totaling 1 million gallons or more within a year. This includes snow -making applications and spraying for dust control and other construction needs. 16. Conditional Use Permit (CU 18-10) will become void upon the recording of this permit. Background/Discussion The subject property is east of Highway 169 between the 213Ih and 221" Avenue alignments. The property is zoned Extreme Commercial Recreation (XCR) where Off -Road Racing Facilities require a Conditional Use Permit (CUP). The applicant requests an amendment to the previously approved CUP to permit their track expansion completed about two years ago, construct two roofed viewing structures, and install a changeable copy sign (approximately 70 sq. ft.) along Hwy 169. Overall, the current functions/activities on site will continue as they have, but with the addition of a few structures. The conditions from the 2018 CUP have been incorporated into this amendment. To bring the track expansion into compliance the applicant has also applied for a Platted Exemption (PE 22-01) to plat a portion of the property to include the expanded track. Planning Commission Meeting The Planning Commission reviewed all standards required for approval of a CUP and made comments and recommendations on the following topics. Figure V CR 33 - 3 RR Transportation/Circulation The site has three access points to and from Highway 169. The submitted site plan shows two access points to be used for spectators and one for participants/riders. A future third access is shown directly across from 213th Avenue. By the end of 2024, the 169 Redefine project will be complete and the conversion of US Highway 169 to a freeway will greatly impact traffic patterns. Spectators/visitors to this property will see a lack of openings in traffic and minimal opportunities to safely enter/cross US Highway 169. Staff recommended to the Planning Commission that all ingress/egress functions related to the subject parcel/CUP shall occur at Brook Road and all access points be removed on US Highway 169 by August 2024, or at a future CUP, whichever occurs first. The recommended condition should also limit the excessive slowing down/stopping traffic occurring on Highway 169. The applicant owns the necessary properties to establish a primary connection to Brook Road. During the commission meeting, the applicant indicated they may not always own the properties, which would depend on their long-term goals. The applicant objected to this condition, and the Planning Commission did not support the recommendation stating MnDOT will address these concerns in the future. Since the commission meeting, MnDOT has finalized their review and provided additional comments. MnDOT supports the ingress/egress condition and has also expressed concerns with past snow -making activities that have created hazardous conditions to the highway system. State statute §160.2715 - Right -Of - Way Use; Misdemeanors states it shall be unlawful to obstruct any highway or deposit snow or ice thereon. Changeable Copy Sign The applicant is proposing a 30-foot-tall sign with approximately 70 sq. ft. of changeable copy. The City Council review is only for the changeable copy portion of the sign and the overall sign will require a building permit. The Planning Commission agreed with the standards set forth in Sec. 30-864 (e), the use should not endanger, injure or detrimentally affect the use and enjoyment of other property in the immediate vicinity or the public health, safety, morals, comfort, convenience or general welfare of the neighborhood or the city. They supported the 70 sq. ft. of changeable copy. Hours of Operation The most common complaint the city receives about ERX is noise, with traffic being second. Generally, the complaints are with vehicles getting too close to the property line. To maintain the general welfare of residents in the area, specific hours of operation need to be in place. Staff recommended the current hours of operation continue as follows: a. Sunday through Wednesday 7:00 a.m. — 9:00 p.m. b. Thursday 7:00 a.m. — 10:00 p.m. c. Friday and Saturday 7:00 a.m. —11:00 p.m. d. Five (5) three (3) day events per year, by special event permit, will be granted for extended hours to midnight. The applicant is requesting the hours of operation for all Fridays and Saturdays be extended by one hour from 7:00 a.m. —12:00 a.m. The Planning Commission indicated they had no concerns with the extra hour. In reaction to public comments, the hours of operation were discussed at length by both the Planning Commission and City Council in 2018. Based on the history of complaints and previous discussions regarding the operation, staff continues to recommend the currently approved hours of operation end at 11:00 p.m. on Fridays and Saturdays. The main uses on the campus are racing in nature where varying levels of noise are expected. With reasonable hours of operation, and the recommended condition of noise generated on the property complying with those outlined in the MPCA Guide to Noise Control, this should reduce unacceptable excessive noise. The setbacks condition for motor vehicle activities (Snowmobiles, ATVs, and motorcycles) is to help address the complaints with vehicles getting too close to the property line. While there is no distance that will completely alleviate noise, the recommended distances follow those outlined in Section 74-157 - Operation within the city limits, ATVs. Orderly Development Staff recommended no motorized events shall occur within 1,000 feet of any residence, livestock shelter, and/or arena, regardless of when they are erected. It is understood this could impact future uses on the subject parcels, but this condition was included to ensure that normal and orderly development of surrounding properties will not be impacted. Preserving the ability for adjacent properties to develop is an ordinance standard for issuance of a CUP. These requirements, as outlined in Section 74-157, are what all properties in the city need to follow. The applicant requested additional information regarding how this condition/requirement might affect their property. Since the meeting, staff has supplied them with an exhibit showing how neighboring development could affect the placement of tracks/trails. The commission had no concern with this recommendation. Environmental The subject parcels included in the CUP request have a significant number of wetlands throughout. The applicant is completing a wetland delineation on the parcels shown on the exhibit labeled "Wetland Delineations". Section 30-1852 of the ordinance outlines setbacks from wetlands. While the site plan dated May 16, 2022, shows the approximate locations of existing and future trails, staff will continually work with the applicant on the location of future trials to ensure they are not impacting wetlands and/or required buffers/setbacks. Other development/structures not shown on the site plan dated May 16, 2022, will require an amendment to the CUP. The Planning Commission recommended approval of the CUP by a 4-1 vote with Commissioner Beise opposing. Other than the applicant and the commission, no one spoke at the June 26, 2022, meeting. Since the commission meeting, several residents have reached out to staff and the council objecting to expansion of the track, citing continued noise, traffic, and using land that was not included in the 2018 CUP. Financial Impact None Council Meeting If acted on, this item will go to the May 15, 2022, City Council meeting. We also have recently discussed the review items with our District 3 Development Review Committee. Through these emails and the DRC discussion a few issues have been brought forth surrounding the ERX CUP application. The related discussion and comments surround the current operations of ERX and its impact on US 169 and how future expansion of ERX, particularly entrance accesses to US 169 may need to be addressed. Our comments are structured into two parts. The first part pertains to our official review and comments of the CUP that is required pursuant to the provisions of Minnesota Statutes 505.03, Plats and Surveys. The second part of our review consists of general comments pertaining to access to US 169 as ERX expands and adds entrance access points to the highway from its various parcels. Formal CUP Comments: 1. MnDOT District 3 staff have reviewed the CUP materials provided by the City and this review has triggered discussion of future growth of ERX and access needs to serve the facility and their seven parcels. 2. There can be no encroachments to US 169 from the ERX parcels. 3. Recommend no net gain in access to US 169 as ERX operations expand to the north and parcels added to this operation. Any new access requests would require the removal of one or more of the existing entrances. 4. Any CUP development proposed for the ERX property bordering US 169, shall have no net increase in storm water runoff to the highway right of way. 5. Since the property abuts MnDOT right of way, a permit is required to perform any work that may be performed within the State owned right of way. Contact Mark Renn, District 3 Permits Supervisor, at 320/223-6522 for permit information. General Comments: 1. US 169 is a heavily travelled principal arterial expressway. Access should be limited to preserve the mobility of the highway and ensure safety. Discussion that ERX currently has 3 direct accesses to US 169. There are additional access openings to the north. Originally, there was a plan to require all access to the property via Brook Road to the east. An equal opportunity employer ERX CUP Review May 6, 2022 Page 2 2. ERX makes its own snow which has, on occasion, resulted in snow blowing over onto the highway. Statute 160.175 allows State to mitigate impacts caused by development. MnDOT reserves the right to ticket them for snow removal created by ERX impacting the highway. It's a concern of the Minnesota State Patrol also. The planning commission recommended removing that condition stating MnDOT can work with the ERX in the future to solve access issues. Because of this recommendation, District 3 would offer that: 1. MnDOT concurs with your April 28, 2022 email regarding the previous Tuesday's Planning Commission meeting recommendations that: "All ingress/egress functions related to the subject parcel/CUP shall occur at Brook Road and all access points be removed on US 169 by August 2024, or at a future CUP, whichever occurs first." We would add that the need exists for a longer -term vision for this portion of US 169 and for developing a plan for future access and local street network to support the City's future growth and development in this area. 2. We also concur that recommendations that move forward from the "169 Redefine project in 2024 will be complete and the conversion of US Highway 169 to a freeway will greatly affect traffic patterns, primarily overserved with a lack of openings in traffic and providing minimal opportunities to safely enter/cross US 169." 3. Any changes or modification or removal of any current entrances to the ERC would need to be coordinated with District 3 and would need to be at no cost to the State. 4. Development of a Traffic Impact Study may be necessary for facilities like ERX that generate large amounts of episodic event traffic on an arterial highway. ERX is using as a race track off 121. 1 can visually see the trails along 121, also on property previously owned by the Lemmons. (Isn't this a violation of the trail roads of conditional use permit?) I will be informing neighbors to come to meeting and I will try to get signatures on a petition of people that can't attend and bring to meeting. I also have some questions I want answered. 1. What are consequences of violating rules ? 2. How many special events are there in a year ? 3. What are hours of operation days of week/weekends when not a special event ? 4. The applicant is in ownership of the necessary properties to establish a connection to Brook Road. Changeable Copy Sign Section 30-880 states the subject parcel is allowed one freestanding sign, not to exceed 150 square feet with a maximum height of 30 feet. One freestanding sign may be permitted for every 1,000 feet of street frontage measured along a single street. Additional sign(s) shall be subject to the size and height limitations of the first allowed freestanding or monument sign and may be placed no closer than 500 feet to any other freestanding or monument sign. The applicant is proposing a 30-foot-tall sign with approximately 70 sq. ft. of changeable copy. They are exploring two overall square footages. The Planning Commission review is only for the changeable copy and the overall sign will require a building permit. Applicable Regulation In approving a Conditional Use Permit, the council may impose such specific conditions with regard to the development or operation of the proposed use as it considers necessary to satisfy the seven standards set forth in section 30-654 and the requirements contained in this article and to promote compatibility with and minimize any potentially adverse effects upon adjacent properties, the neighborhood or the city. The property has a land use designation of Highway Business. The Highway Business category primarily consists of a mix of auto -oriented retail and service businesses, restaurants, and community and regional scale shopping centers. Highway Business uses are located along Highway 169 and Highway 10 and have high visibility from these corridors. The proposed use is consistent with the Comprehensive Plan. While all the properties abutting the subject parcel on the east side have homes and other structures on them, they are larger parcels (16-70 acres) and could be subdivided in the future. As stated before, by the end of 2024, the 169 Redefine project will be complete and with the conversion of US Highway 169 to a freeway, this will greatly affect traffic patterns in the area. Staff recommends that all ingress/egress functions related to the subject parcel/CUP occur at Brook Road and all access points be removed on US Highway 169 by August 2024, or at a future CUP, whichever occurs first. Staff will work with the applicant on the location of this Brook Road access. Portions of the subject parcels are now located in the Future Urban Service District. Although the current project does not require city services, some of the permitted and conditional uses in the XCR district will require city services and this will have to be addressed in the future. MnDOT has expressed concerns with past snow -making activities that have created hazardous conditions to the highway system. State statute �160.2715 - Right -Of -Way Use; Misdemeanors states it shall be unlawful to obstruct any highway or deposit snow or ice thereon. 5. mill not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons or property because of excessive traffic, noise, smoke, fumes, glare, odors, dust or vibrations. Again, the main uses on the campus are racing in nature where varying levels of noise are expected. With hours of operation and the recommended condition of noise generated on the property via the Conditional Use Permit shall comply with those outlined in the MPCA Guide to Noise Control, this should regulate excessive noise. As for excessive traffic, the recommend condition of an alternate access point should limit excessive slowing down/stopping traffic on Highway 169. 6. Vill not result in the destruction, loss or damage of a natural, scenic or historic feature of major importance. The subject parcels that are a part of the CUP have a significant number of wetlands throughout. The applicant is having a wetland delineation completed on the parcels shown on the exhibit labeled "Wetland Delineations". Section 30-1852 of the ordinance outlines setbacks from wetlands. While the site plan dated 3/24/2022 shows the approximate locations of existing and future trails, staff will continually work with the applicant on the location of future trials to ensure they are not impacting wetlands and/or required buffers/setbacks. Other development/structures not shown on the site plan dated 3/24/2022 will require an amendment to the CUP. 7. mill fully comply nvith all other requirements of this Code, including any applicable requirements and standards for the issuance of a license orpermit to establish and operate the proposed use in the city. There are numerous structures on the parcels and staff is working with the applicant to determine which structures have received building permits. If denial of such a permit should occur, it shall accompany recommendations or determinations by findings or a report stating how the proposed use does not comply with the standards set forth in Section 30-654. NARRATIVE - 21591 US HWY 169 NW Background ERX was launched in the winter of 2008 and is recognized today as one of the fastest -growing motorsports facilities in the Midwest. With a focus on family -friendly events and grassroots motorsports activities, ERX has been quickly embraced by motorsports enthusiasts of all kinds. ERX was created by Todd Plaisted and Chris Carlson, two Elk River businessmen who are long- time Powersports enthusiasts. Plaisted and Carlson both enjoy participating in Powersports activities with their families. They saw an opportunity to create a facility that would address their love for racing and provide value for the Elk River community. Their original intent was to provide a facility for snocross racing and training. Today, ERX is a year-round complex hosting both snowmobile events in the winter and off -road truck and SxS racing, concerts and extreme 5k's in the summer months. ERX hosts events for local and regional organizations and non- profits such as Day of the Dozers, Children's Minnesota fundraiser and the 'Livin Country Music Festival, whose mission is to promote a positive outlook on life, reduce the stigma associated with depression/mental illness, and ultimately prevent suicide through various activities, events, and outreach. Future uses of the facility may include additional concerts, festivals, product demonstrations and endurance events such as "Tough Mudders" or "Running with the Bulls." ERX has a long history of growth in the City of Elk River dating back to June of 2008 when we received our first IUP to operate. We've built a great relationship with city staff and look forward to our new development opportunity. Plat Update ERX would is proposing an update to a small triangle area on the northeast side of the off -road track (PID: 75-878-0105) to include a track adjustment and put up a viewing deck with a roof to increase seating capacity. ERX has been working with the Minnesota Department of Health for the past six years to develop a strategy for camping at ERX. Discussions have centered around the possible need for ERX to develop an on -site campground, or if there is a way to provide the space on a rental basis to to groups hosting events at ERX, in which they would apply for their own permits. It was determined that any organization can apply for the Special Event Camping Area License (SECA) and that the SECA license is not land specific. This means that ERX Motor Park can utilize their two camping events twice per year. However, if ERX choose to rent out the facility, the company renting the facility would be able to apply for and obtain a camping permit following all guidelines that it would be allowed. In 2018, the City of Elk River approved this, and this would be a condition that we would like to keep. ERX Motor Park would also like to utilize land on property owned by Plaisted Companies (PID: 75-110-1105) for a SECA License during large events. The process for applying for a SECA license is very specific in nature. Each company, ERX included, needs to submit a site plan review, and pay for the plan review and the license for their specific event days. Upon obtaining a license, the Minnesota Department of Health comes out to inspect the property for each license. Because of the incredible success of the events ERX has hosted thus far, we applied and obtained a CUP that would combine all track elements (off -road and snocross) on a single plat. During our meeting with City staff on September 14, 2016, it was indicated once approved, this would eliminate the need to apply for a special event permits in the future for our larger events that stay within land boundaries and use of Outlot A and Plaisted Property. On April 16, 2018, ERX and City Staff brought to the City Council Work Session a Concept Review for an Ordinance Amendment and CUP Amendment that showed where the future of ERX was headed. Council found no issues with moving forward. Detailed Descrintion From the very beginning, Mr. Plaisted and Mr. Carlson have implemented a few fundamental principles which have been consistently used to guide the organization through the years: • ERX will be family and community focused. o It will be a facility that will provide safe, family -friendly activities, with the goal of creating value within the local communities and the powersports industry. • ERX will utilize an operating philosophy grounded in integrity, and benevolence and charitable activities will be a key part of the operation. o Free admission has been, and will continue to be offered to charities, ministries, schools, and non -profits. ERX is proud to have partnered with several outstanding non-profit organizations through the years, including but not limited to Big Brothers and Big Sisters, MN Adult and Teen Challenge, Boys and Girls Club of MN and the Fellowship of Christian Athletes (FCA) Three River's Community Foundation and Children's Hospitals of MN. Most recently, ERX has donated the use of their property to the YMCA of MN for their summer youth motorcycle training program, the "National Youth Project Using Minibikes (NYPUM)." • ERX will encourage development. Page 2 o Since the beginning, ERX has hosted events designed to promote improved skills and safety. These events have included the ERX Learn2Ride Clinics (Snocross), Motocross Clinics, YMCA Youth Motorcycle training, Avalanche Awareness Classes, Youth Snowmobile Safety Training and Day of the Dozers. Brief overview of the vision ERX is recognized as the top testing and development facility in the country for amateur and professional Snocross and Off -Road racers. As a direct result, the large manufacturers supporting this industry, such as Polaris, Arctic Cat, Honda and BRP, are investing in the Elk River area as well as ERX through corporate events and leased shop space for their factory teams. At least two of the manufacturers have expressed interest in moving part of their corporate racing operations to Elk River to gain improved access to ERX. ERX has built a national caliber off -road truck track that professional drivers have quoted as being the "most fun they have had racing, ever." ERX strives to become the number one track of this nature in the nation. During our meeting with city staff on July 28, 2016, ERX indicated that we would like to offer overnight parking and camping to spectators for these events. City staff indicated it wouldn't be a problem being it was only a couple times a year. Scope of Project/Proposal Currently, six buildings/structures are on the 43.7-acre site that also includes the off -road truck track and regional snocross track (county map attached), including: • A 624 square foot office • A 2,400 square foot shop • A 1,320 square foot storage facility • A 3,250 square foot facility (chalet) • A 240 square foot shed • A 480 square foot shed Future facility expansion plans near the Regional Track include an addition to the existing ERX Chalet which would house bathrooms and concessions, and an additional storage shed. Future improvements near the off -road truck track include a two -level announcing tower which would house an announcing booth on the upper level, and a concession stand on the lower level. A scoring shelter, grandstand bleachers, a two -level viewing structure on the north and west side and a semi -permanent viewing structure on the east and south side of the off -road track will also be added, in addition to a storage shed. In the meantime, we will continue to utilize temporary/portable bleacher units, and portable shipping containers. The 13.29-acre site (housing our regional track) has been operating as ERX since 2008 and has served as a feeder system to ISOC, the national Snocross racing series. Riders who were Page 3 introduced to the sport of snocross at ERX are now winning national championships and are recognized as some of the best emerging racers in the world. As a direct result, ERX is quickly acquiring a reputation as a facility which develops and builds future champions. In the spring of 2016, the ERX team built an off -road truck racing track that has hosted one national race and testing sessions for professional teams. In 2017, ERX hosted two national races and testing sessions. ERX is slated to host one off -road truck race in the summer of 2022. In addition to providing a safe, yet challenging track for testing and training, ERX provides the following events on a regular basis: 1. ERX Grassroots Snocross Series This series is 13 years strong, and is hosted on Thursday nights, focusing on first-time, amateur and youth racers. The largest classes are youth oriented, and the largest specific groups of racers are the 120cc class, which features riders from ages 4 to 12 years old. Competitors follow the six -race series with hopes of capturing the ERX Season Points Championship. We have racers traveling from Ontario, Manitoba, North Dakota, Wisconsin, Michigan, Iowa, and Ohio. Average attendance for this race is approximately 1,000 people; we don't anticipate attendance to ever exceed 1,500 people. 2. ERX Off -Road National Professional and armature off -road truck and SxS racers make their way annually each July to battle on one of the top short course tracks in the country. The ERX Off -Road National is the premier event at ERX Motor Park. This event draws approximately 6,000 racers and fans from across the United States over this three-day event. 3. Midwest Vintage Snowmobile Show: The Midwest Ride -in The Midwest Ride -In event has grown into the largest vintage snowmobile event in the world. The Ride -In is a show full of old -school snowmobile and memorabilia that draws collectors and memory seekers from far and wide. This event is held annually the last weekend in January and draws upwards of 2,500 people from all over the Midwest. 4. Extreme 5k This is the ERX version of the "Tough Mudder." 18 obstacles, automated chip timing and scoring and a lot of fun! 700 runners make their way to ERX in May to test their limits. This event supports a charitable group each year. Future motor events at ERX could include grassroots off -road truck racing, regional off -road truck racing, and motocross racing. Future non -motorized events (Active Recreation and Physical Endurance Events) at ERX could consist of concerts, festivals, dealer demo shows, trade shows, and physical endurance events. Page 4 In 2017 ERX completed the EAW process as required by the city; this was triggered by our anticipation of hosting events in the future which would exceed 5,000 participants. To date, the largest attendance at any of our events was approximately 4,500 at peak attendance. We anticipate future off -road truck races and larger extreme Snocross races to exceed 5,000 participants and spectators. If we were to consider hosting an event on this site that would exceed 19,999 peek participant and spectator attendance, we will work with the city to ensure all necessary requirements are put into place prior to the event. Hours of Operation Current hours of operation are Sunday through Wednesday 7am-8pm, Thursday 7am to 10pm, Friday and Saturday 7am to 11pm. 2022 and beyond Proposed hours of operation: Sunday through Wednesday 7am-8pm, Thursday 7am-10pm, Friday and Saturday 7am-12am. Number of Employees ERX Motor Park is staffed by a dedicated team of 20 employees from Plaisted Companies, Envision Company, and Carlson Motorsports. We also utilize a community of volunteers during our larger events. Traffic Traffic and other key elements have been addressed in further detail in our completed EAW. Based on these findings, ERX will work with MnDOT and City staff to ensure safe entrance and exit with Hwy 169. Number of Parkine Stalls (existine & additional There are 260 parking stalls on the upper paved lot, 200 parking stalls on the bottom lot near the chalet, and another 700 parking stalls in the areas to the south and east of the upper paved lot of ERX. We also have over 500 parking spots located directly adjacent to ERX on property owned by Envision (Carlson Family, PID: 75-833-0105). Over 1,000 additional spots are also available approximately 0.25 miles to the NE on property owned by Plaisted Companies (PID: 75-110-0105). Signage/Outdoor Storage There are two permanent signs on the property The other sign is 15 foot high by 8 foot wide. One of the signs is 14 foot high by 4 foot wide. ERX will have event sponsor signs up during and in between events. ERX will comply with all city codes set forth in the Elk River Zoning Ordinance. In the future, we anticipate constructing a monument sign on ERX Properties that would exceed 30 square feet of changeable copy. We are including a changeable copy sign in this CUP application. We will work with city staff and apply for any applicable sign permit(s). Page 5 Utility Plan This property isn't currently in the Urban Service District therefore we don't require city services currently. Wetland Delineation In 2016, Anderson Engineering performed wetland delineation on the rest of this property. All wetlands have been preserved. ERX is working with Anderson Engineering to perform an updated wetland delineation. Grading Except for the off -road truck track and the special event camping area, there will be no grading changes from the current state, at which time, ERX will apply for necessary permit(s). Camping As part of this CUP, per City staff's request, ERX is including unplatted Outlot A (PID: 75-725- 0010) as a special event camping area. ERX will ensure all codes are met with the Minnesota Department of Health. "Special event recreational camping area" means a recreational camping area which operates no more than two times annually per event planning company and for no more than 14 consecutive days. In 2018, the City Council approved allowing ERX to have two special event camping events and have three other special event camping events available for other organizations as long as they complete the MDH requirements. Impact to the Neighbors of ERX Motor Park The ownership and leadership team at ERX Motor Park realizes that there is a possibility of impacting our neighbors of the facility. To combat this, in the past we have stopped by our neighbors that are the closest to the event site, explained to them what was going on, offered them tickets, and dinner on us. We will continue to go above and beyond to make sure that our neighbors know what events we have coming to the facility. When it comes down to having events that may impact with noise, concerts, races, etc. we will assess the direction of the noise of such events. For concerts for example, we would position the stage so that the sound would have to travel over natural terrain (a hill) and through the woods before reaching the neighbors. Economic Impact for the City of Elk River Athletes, sponsors, business owners, attendees and event planners come to Elk River, MN from all over the US, Canada and several Scandinavian and European countries to ERX Motor Park. As these individuals travel here for ERX, the Elk River area experiences a significant positive financial impact. The impacts are most significant during the winter snocross seasons as teams and athletes continue to call Elk River "home" in their attempts to locate near the ERX track. Teams support local businesses by utilizing local restaurants, hotels, municipal liquor stores, grocery stores and gas stations. During large ERX events, the Elk River community is filled with Page 6 teams, families and spectators as they spend multiple days in the area participating in events at E RX. Since our inception, there's been a handful of families who have purchased land in the Elk River area to be closer to ERX, thus: 1) providing part-time housing for their family and team, 2) operating their respective business(es) and racing team operations 3) leasing available space and 4) patronizing local businesses. The city reserves the right to eliminate this requirement if it deems it impractical. V. The city, at its sole discretion, following the city's master park trail plan, may allow nature trails comprised of natural materials, to be located within the wetland buffer strip. vi. Leisure activities such as hiking, nature studies, canoeing, boating and horseback riding, including facilities such as nature trails and docks which allow for such activities are permitted in the wetland buffer strip. vii. Final plats for all subdivisions shall provide an easement over all wetlands and wetland buffer strips for the purposes of identification and protection. viii. Properties platted prior to June 19, 2006, shall be exempt from the vegetation management requirements described in subsections ii—iv above. (b) Wetland buffer strip setback. A minimum 20-foot setback from wetland buffer strips is hereby established by the city. i. No principle or accessory structures, patios, paving, or other impervious surface shall be located within this setback. ii. Nature trails, at the city's approval, may be located within the wetland buffer strip setback. iii. On property that was platted prior to June 19, 2006, uncovered decks and permeable pavement can be located within this setback. (c) Exceptions. Properties platted prior to adoption of the wetland buffer strip and wetland buffer strip setback performance standards set forth in this section may not be configured to accommodate the required performance standards. Children's Minnesota has been fortunate to have been the beneficiary of Day of the Dozers for the last 10 years. In doing so, I am patronizing local restaurants, hotels, and shops. I know for a fact that I am not the only "ERX regular" who travels great distances. (Racers, families and fans from Sweden, Norway, Finland, Japan, South Africa, Canada, etc.) The economic impact that ERX provides should not be overlooked. I encourage anyone reading this to reference the studies that have been conducted. I work in the motorsports industry and attend hundreds of events annually across the US, Canada, and New Zealand and spanning many different racing disciplines. You would be hard pressed to find another family -oriented facility such as ERX. When my family is there, I know that we can expect a world -class experience with entertainment for all ages at any of their events. They always have the best and cleanest facility for their fans with top-notch security and customer service to assist their attendees. Truly world class. Myself, being in the Motorsports industry I value the professional operation that ERX has become. Nowhere in the US or Canada is there such a complex for winter and summer motorsports events and recreation. My family and I personally participate 4-6 times per year at ERX. We stay in hotels, buy food, gas and shop in Elk River. We travel 5 hrs. to enjoy the events. With my background in the Motorsports industry, 36 year employee with Arctic Cat, I understand the concerns in regards to "Noise". Great strides have been over the years in terms of sound level regulations and reductions. We can work together on this as technology keeps progressing. Totally shutting down an operation is not the answer. Congestion and traffic, that is something the Metro area has seen and will keep seeing. It is related to the 3 million people that live the MSP and surrounding area. Again, closing down a business is definitely not the answer. The solution is working together and making it better. As you can see from my address I am not a resident of Elk River but I would like to point out a few things to help you understand why ERX is so important to so many people. They events that are held there are family oriented, this isn't drop your kid off at the door for practice and pick them up a hour later. These are families that bonding and learning valuable life lessons together. The time that I have spent there with my kids are some of the greatest memories we have together. I have no exact way to come up with a dollar amount but the the economic impact from the events that are held at ERX has to be huge. I know when we come down for a weekend of racing between the hotel room, a stop at Menard's, pick up a few things from Cub and a couple dinners, usually Hajime, we will easily spend $1,000 at your businesses and that is multiplied by every racer that comes to an event. I understand there is noise and traffic that is a result of these events but the pros definitely out weight the cons. I grew up in Vermont and had never traveled to any of the Midwest prior to attending college in Duluth, I knew very little about the state, however as a snowmobile racer, I knew about Elk River because of ERX. Many would make the argument that the sport of snocross would not be where it is today without ERX and all their support. Bringing more families out, introducing them to snowmobiles and snowmobile racing, this has had a major impact not only on snocross, but the snowmobile industry as a whole. More riders means more sleds, more sleds means more shifts at the OEM's, more shifts means more jobs, etc. To this day I still participate in events at ERX almost on a monthly basis and I know there are many more like me, people who will travel from all over the world for events at this world class facility. If nothing else, I'd ask you to try and calculate the economic impact to the city of Elk River that ERX has had since it's creation. As powersports enthusiasts, people will report us for riding on a dirt road, a sand pit, or even an official facility like ERX, it's nothing new to us. In 2019 Dirt City Motorplex was created in Lena. I'm sure there was a few complaints at first, but now the town has embraced it like a holiday. EXR park serves an important roll in many family oriented events throughout the year. Complexes like these are few and far between and are greatly needed to keep a large part of these sports available to competitors and fans. EXR goes way above to provide a safe and family atmosphere that is greatly needed in today's world. Our childnern enjoy the EXR Park in the winter for snocross. When we are in the area, we stay in hotels, go to restaurants and shop at stores.These outdoor sports are completely dependent on complexes like these. EXR seems plenty far out of heavily populated areas, but close enough to frequent the stores, hotels and restaurants in the nearby towns. It is a great location as a competitor and fan to attend. We have been to EXR for several events. As far as noise of the events, it is an outdoor event, personally the highway along the park is as noisy as any event, it is just a constant noise and people become accustom to that kind of noise. The entrance to and from the park is a little strange but that is something that the highway dept should be working with the park on, not making it more difficult. As a community you are lucky to have such a competitor and fan base draw in your area. You should be embracing the opportunity to have such a great economical draw to your area.Shutting down EXR would be a great disservice to the surrounding retailers and the sports that are supported by ERX. That being said, it has been brought to my attention that there are some concerns within the community regarding the ERX Motor Park track. While I understand there are always complications that come with having a large facility like this in your community, the benefits are much greater. As a race team, we are spending our money at many local hotels, restaurants, grocery stores, gas stations, etc. This Motor Park attracts many racers, spectators, and athletes of many different sports, therefore boosting local revenue in various ways. Throughout the various seasons, ERX is always attracting positive growth to the city of Elk River. The loss of this facility and its events would cause a large disruption to the growth of this city, it's local business and it's growing popularity with the public. I ask you to please reconsider the issue being presented today. ERX is a safe, positive place for families and friends to gather and create memories. Couple of observations from my perspective as to why this is a positive thing. 1) Kids. Since the first time I have raced at ERX, I noticed the enthusiasm that families have about the snowmobile racing environment, their kids having FUN outside in the winter, the bonding that kids have with their machines both on the track and off in the pits and in the clubhouse sharing their stories about the fun they are having, how to become better riders etc. The cell phones are down and these kids are energized with the adrenaline of racing. 2) Location. Loosing this centrally located facility will only harm the sport and impact your community provides the sport of Snowmobiling. Committing to be a snowmobile racing family is a commitment which involves travel and lots of work both on and off the track. Kids practice and racing locations near the Twin Cities is hard to find. ERX provides a family orientated location for grandma and grandpa to easily come watch the grand kids race and practice several times throughout the year. Moving this farther away from where the families can enjoy this will hinder the sport and enthusiasm kids will have for this. 3) Community Impact. Every time I have traveled to watch, participate and help at ERX, my truck needs a fill, I need to eat something, and I oftentimes need parts from somewhere in Elk River. have spent money at Sammy's Pizza numerous times for my family before, after and during events, I head to Menards when I need a part, purchased HUNDREDS of gallons of fuel at the Speedway, my wife will go get a Starbucks while she is there... The list goes on! Loosing the traffic and enthusiasm to go to Elk River will absolutely impact the community. The countless events they host does impact your community positively. I understand that every person has a different perception of what Motorsports is, some of these perceptions are negative because of things like noise, traffic inconveniences, dust, and maybe some lights in the evening. If they truly are a problems, then they need to be addressed, however irritating the locals is not what this facility is about. Do we close soccer and football fields because people park on the city streets? or because the fans make to much noise cheering? This facility is about families having fun, teaching kids about sportsmanship, competition, integrity and character. Getting families outside to see racing competition on the highest level. I truly believe that if you have not attended a snow -cross race at ERX and watched the interaction between the kids in the 200 class, then you should not be voting on the conditional use permit needed for ERX to be operational. If you attended a race, what would you see? Well, you would see young kids giving each others fist pumps on the starting line before the race starts. You would see high fives given to each other after the race is over. You would see parents taking pictures of each other with there kids on the podium after the race. You would see a young kid, that can't get his snowmobile started, you would see a stranger walking by help start it, because the child is not strong enough to pull the rope. You would see parents teaching children life lessons, such as "you can not win every race". You would see kids learning how to fix and repair snowmobile, and family bonding. You would see kids learning how to improve themselves and set goals to make themselves better as a racer. You would see a community of people sharing in an activity that brings them enjoyment. The modern world likes to talk about diversity and working together to solve problems. Learning how to work with people of different opinions, and formulating solutions that work for everybody. They provide Grassroots racing that is meant for beginners and amateurs to gain confidence before moving up in the sport, they provide the Learn2Ride clinic which helps beginners learn from the pros and once again gain confidence to maybe even race for the first time ever. The events that ERX Motor Park put on go way beyond the traffic and noise that are brought with them. It is a place that is unlike any other. The acreage, race tracks, camping spots, the entire facility is unmatched and allows thousands of people to gather and do what they love. I understand the frustration that the people living near ERX Motor Park may be having but I hope you look at the side of the people who love ERX and spend many weekends there throughout the year. First of all, this park is in close proximity to many equivalent sources of environmental noise. From the local mining and landfill activity, to highway 169 itself, and especially the explosives testing at Northrop Grumman. (This is a private military contractor I might add, not the military itself doing testing) Second, and more importantly, shutting down this park is a direct condemnation of motorsports as an activity itself. If a motorsports park cannot exist here, there is no commercially viable location for it. Anywhere. In all other areas, multiple park projects have been, and consistently are being, denied permission to construct parks within literally hours of any metropolitan area. This is a de -facto ban on motorsports being implemented. And it not only goes against American values of liberty, but it goes against the opinion of the federal congress that racing is recognized as a legitimate and respectable American activity. In fact, next week I will be working my first job with Formula 3 in Road American, a legendary race track in Wisconsin. Because the people at Envision were kind enough to allow me to show up that one day in Spring of 2021, 1 have been able to continue to pursue my dreams and live a happier life doing what I love to do. In times like these you are really hurting people by taking away another thing they love! 7.2c Support for ERX Conditional Use Permit Dear Council Members, I am writing this letter in support of ERX obtaining their conditional use permit. I have been involved with various events at ERX over the years and these events I feel are beneficial for the community and neighboring communities. The event I have been involved with the longest is Day of the Dozer. ERX is the perfect venue for this event. This event acts as fund raiser for Childrens Hospitals and over the years we have raised over $300,000. This event also does several other things. First, there is an educational factor at Day of the Dozer with the Common Ground Alliance, who are educating people young and old on Call before you Dig, and the risk of damage of underground utilities. The other is introducing the younger generation to the construction industry which is constantly looking for people to join the trades. The other event that we have been a part of is the Minnesota Utility Contractors Association -Trades Show and Tell event there promoting workforce development. The target audience is high school and young adults. This event has local employers from many trades and other businesses showcasing their opportunities for employment. These events along with many other they host bring a great variety of entertainment, fund raising, and educational opportunities to the city of Elk River and surrounding communities. Andrew Carlson was one of the coaches and was amazing with all the kids. Ryan had an incredible day and wanted to try racing. ERX has always been focused on the youth. They have given them a place to start and have been a big part in developing them for more competitive series such as ISOC Regionals and Nationals. Fast forward to 2022, Ryan won 2 National Championships and the entire year was filled with so much quality family time, great memories, new friendships and life lessons that we will always remember. I truly believe this would of never happened if ERX didn't exist. In a world were kids are so into phones, Ipads, video games and ultimately habits that aren't contributing to the healthiest lifestyles, I think saving ERX is more important than ever. When ERX opened in 2008, my son was 3. He attended the very first learn to ride clinic and was the only child that young to attend. Today, this kids 120 class is well over 30 participants of future racers. He raced his first race on a snowmobile in Jan, 2009 at the age of 4 and fell in love. By winter 2010, I was volunteering at ERX for all snocross events. My son and husband raced until 2015 when my son broke his leg in a motocross accident. My husband continued to race and my son started volunteering with me doing scoring for both winter and summer events while he recovered from his leg. He never went back to racing, he continued being a volunteer at every ERX event possible until he turned 15 and was hired by ERX. He continues to run ERX's snocross practices and Thursday night races with help throughout the summer season as time allows. Today, as he finishes his junior year of high school, he is on his 2nd year of owning a track -side support business and has added his own scoring business for motorsports. He also works at a few motocross tracks in MN and many Hare Scramble dirt bike events in MN, WI, MI, and IA. He has also been scoring for snowmobile hill climb events this past winter. My son has excelled not in racing, but in managing, promoting, accounting, and marketing all aspects of motorsports racing. This has only been possible by Heidi Goodin, Chris Carlson, and Todd Plaisted taking a chance on my son and putting too much on his plate and allowing him to run with it. Watching him sometimes fail, but most times shine brightly. I am forever grateful to them for giving him this opportunity. ERX will always continue to hold a very special place in my heart. I will repeat what many have already said in emails. Racing, Motorsports is a very tight knit family. Many people in the room last night are my extended family. I've watched their kids grow up and them mine. I've watched folks in this extended family have cancer diagnosis, death, severe accidents and recoveries and "we" as a family find a way to help each other in any way possible, juggle kids, be present in hospitals and funerals and every aspect of support someone can give. I've made lifelong friends and so has my son. None of this would be possible without ERX. One of my husbands longest friends is a guy he grew up racing dirt bikes with and living 1800 miles away from home hasn't broken the bond they have after 40 years. I'd like to also address noise which seems to be a very big complaint by neighbors. In my history with ERX, Thursday night racing is usually done by 9 pm. There are 5-6 of these per season. There 7.2c is one National race which last race goes off at 915 pm. Racing is complete by 10 pm and it is 2 days on Friday and Saturday night. ERX also holds practice on select nights from December - March. Practice is complete by 8 pm (maybe 25 days). There are 5 Sunday races that may be finished around 5 pm and start around 9 am. Over 120 days, there may be 35 days with snowmobile racing/noise. Also, 169 is part of the snowmobile trail system and the ditch along County Road 21 or Brook Road NW is also a snowmobile trail. These trails are open 24/7 from December 1 - March 31. This doesn't mean every snowmobile sound comes from ERX and could very well be a group trail riding these areas at all hours. In my neighborhood sleds fly up our road off a lake all night long. It's winter in Minnesota. As for the motorcycles on the trails at ERX, they are sound tested very strictly by District 23 who oversees the "hare scramble" series of motorcycles. Motorcycles can not be over 96 decibels or the participant can not race. Many after market exhausts also stay under this level for the reason of disqualification during racing. Harley Davidson after market exhausts can have decibel levels of 135 and are legal on Minnesota roads. This does not mean every motorcycle sound comes from ERX. Another item that was not pointed out last night was an event last summer that had drinking, side by sides, four wheeler, etc which I'm sure angered many residents, but also angered ERX Motorpark. This event will not be held at ERX again. I do not disagree that communication could help both sides understand each others concerns and make a plan to work together; however, I'd like to ask the residents if they have ever visited ERX Motorpark, attended a motorsports event? I heard 2 women say they ran the 5k. That's not enough neighbors visiting and seeing what actually happens at ERX. One of the women moved in 2 years ago. ERX was there long before. I also ask this question .... if there are events that are so hated/loud, why not go away that weekend. I don't mean this in a disrespectful manner. For me, in Isanti, I feel the rodeo is nothing but an obnoxious drunk test, I have attended the event many times and still haven't found a way to enjoy it, so we are usually gone to our boat, or a motocross track on that specific weekend. I'm OK with that. Others enjoy the rodeo and look forward to that weekend and that is OK. We are all allowed to enjoy different things.
