Action Requested
Recommend, by motion, approval of the Conditional Use Permit with
the following conditions:
1. A Planned Unit Development Agreement be prepared and
executed prior to releasing the plat for recording and before the
Conditional Use Permit is recorded.
2. The Land Use Amendment (LU 22-02) shall be approved and
then recorder prior to the Conditional Use Permit being
recorded.
3. The property must be platted prior to issuance of any building
permits.
4. The final site plan, landscape plan, and architectural materials
shall be approved by city staff as a permitted use within the
PUD.
Background/Discussion
The property is currently zoned Planned Unit Development (PUD)
and the Comprehensive Plan guides the property for Mixed
Residential. The applicant is requesting a Conditional Use Permit
(CUP) to establish a new PUD allowing construction of four mini -
storage structures as well as Land Use Amendment guiding the
property for Neighborhood Commercial (LU 22-02).

The 2.21-acre site is located at the southeast intersection of Twin Lakes Road NW and 171s` Lane. The
surrounding uses include, mixed residential, a train station, and trucking terminals.

The Planning Commission and City Council were generally supportive of the proposed use (land use change)
during the concept review process which was for a traditional mini -storage facility absent the proposed request for
taller structures within the current proposal, increasing the height of the structures to allow for the storage of
RV's.

The applicant proposes four structures, two at 5,600 sgft, one at 7,700 sgft, and one at 10,000 sgft. To
accommodate RV storage, they will be 17'-18' in height. The proposed building materials are metal wall panels
with the end of one unit having stone wainscoting. taff requests the commission's input on the proposed building
materials and design. During the concept review both the Commission and Council expressed a desire for neutral
colors, upgraded fencing (black rod -iron style), and visual buffering with fencing, vegetation, and berms.
Access to the site will be off 171" Lane through a secured sliding gate and there will be perimeter chain link
fencing.
Parking
Ministorage or self -storage facilities: one parking stall for each 400 square feet of office space or four stalls,
whichever is greater. The proposal shows 445 sgft which requires four stalls.
Applicable Regulations
In approving a Conditional Use Permit, the council may impose such specific conditions with regard to the
development or operation of the proposed use as it considers necessary to satisfy the seven standards set forth in
Section 30-654 and the requirements contained in this article and to promote compatibility with and minimize any
potentially adverse effects upon adjacent properties, the neighborhood or the city.

Additionally, Sec 30-1564 describes the standards for establishment of a PUD district.

a conditional use permit, pursuant to the procedure set forth in this section.

and may author'.Ze a density which it determines to be appropriate under the circumstances. Any permitted density shall
be consistent with the city's comprehensive plan and not adversely affect the public health, safety and welfare.
The proposal will be consistent with densities described in the comprehensive plan, setbacks from
public rights -of -way, and design standards for similar developments within city code.
9. More than one principal building may be constructed on a lot within a PUD if author'.Zed by the council. Unless
otherwise permitted by the council, a PUD shall comply with the schedules of dimensional regulations set forth in this
article, except that individual lots shall have no less than 80 percent of the minimum area for similar uses.
The project will not conflict with standards described in city code.
If denial of such a permit should occur, it shall accompany recommendations or determinations by findings or a
report stating how the proposed use does not comply with the standards set forth in Section 30-654.

Executive Summary
Storage space is in demand and this development responds to fill that need for the area surrounding the City of El
River, Minnesota. The buildings are attractive, well-built and will be a welcomed addition to the City of Elk River.
Overview
Lund Recreational Storage proposes this project for the City of Elk River's consideration. The Project will be located
at 10688 — 171s' Lane NW in Elk River, Minnesota. Building spaces will be leased to private individuals seeking
protected and secure storage for their possessions primarily recreational vehicles, trucks, boats and trailers. Each
rental space has its own entrance, its individual level of interior finishes with power and lighting. Hours of operation
will be between 5am and 10pm daily Sunday through Saturday. This project is consistent with the City of Elk River's
Comprehensive Plan.
This property will be equipped with surveillance equipment to maintain a high level of security for tenants in addition
to perimeter fencing and main access gate.
Programming
Project consists of four (4) separate buildings with individual units available for lease. Buildings are proposed of
wood -framed construction with exterior pre -finished metal wall and roof panels and associated pre -finished metal
trim. Owner Suite located in Building "A" has its own storage bay plus offices, restroom, mechanical and reception
spaces. The Owner Suite is proposed to be heated and will be thermally separated from its adjacent rental unit and
be built in full compliance with the state's energy code.
1) Four Total Structures- development proposes four (4) stand-alone buildings to maximize
development in most efficient manner (identified as Buildings "A" thru "D"); all buildings are non -
sprinkled (NS); occupancy group will be "S-2" low -hazard storage use for all units;
2) Building "A" includes the Owner Suite and 12 additional rental storage units; this building is the
signature unit with covered entry awning and stone accents;
3) Typical Rental Unit
a) Large Warehouse Space- 12' x 14' high overhead door; 50' and 40' depths for large items
b) Electrical Service- each unit is equipped with power and lighting
Site Development
Site access will be from 171st Lane NW and gated with digital access controls. Each tenant will be given access
codes in order to gain entry to the storage facility, but access will be restricted to hours of operation Sunday through
Saturday 5am to 10pm.
Owner Suite is distinct as it houses the Owner's business office. Currently there will be a single employee to operate
and maintain this facility. Support for that employee to conduct business consists of offices, restroom and reception
spaces located in Building "A". A total of three (3) parking spaces are provided, one fully accessible with aisle.
Four separate buildings are served by bituminous paving. Surface storm water will be collected and routed to a storm
water management basin on -site with discharge on -grade. The discharge point is protected with rip -rap to address
erosion. No exterior storage of any kind is allowed on the property.

Landscape Design
Landscape design is proposed that is reasonable and appropriate for the proposed development.
Tree plantings are proposed with a variety of coniferous and deciduous trees with a quantity that exceeds the city
requirement based on building square footage by code. Tree plantings are proposed along the north, east and west
sides of the site to provide buffer screening from adjacent residential properties. Existing trees along 171s' Lane NW
will be retained with one exception. Its removal is required for site access and is replaced as part of the landscape
design.
Shrub plantings are proposed along select building walls that have primary visibility from adjacent residential
properties. Shrub plantings are proposed along the buildings to provide softened integration and buffer to buildings
and hardscapes.
Building Construction
• Project consists of four (4) wood -framed structures, using pre -finished metal panels for all
exterior walls and wood roof trusses with pre -finished metal roofing, pre -finished metal fascia,
and soffits; sloped roof trusses, pre -finished doors and windows (see attached Drawings);
• Building "A"— Owner Suite plus 12 individual rental units; the signature design feature is finished
with covered entry awning, stone veneer base and stone cap; project signage will be located on
the north wall of Building "A" facing Twin Lakes Road; signage will be flat metal panel with
printed graphics surface mounted to the wall; single 4' x 8' sign will be externally lit by lighting
mounted on the wall above the sign;

• Building "C" —10 individual rental units;
• Building "D" —10 individual rental units;
• Total Individual Rental Units — 43
• No outdoor / exterior storage is allowed at any time.

GENERAL GRADING NOTES:
1. Specifications applicable for this project: Current standard
specifications for City of Elk River, MN, and the latest Minnesota
Department of Transportation Specifications for Highway Construction
and all NPDES requirements except where modified by these contract
documents.
2. OSHA requirements shall be followed for all work on this project.
3. The Contractor shall notify "Gopher State One Call" 48 hours prior to
any excavation (1-800-252-1 1 66.)
4. The Grading Contractor shall verify all locations and elevations of
underground utilities with utility companies prior to any construction,
and immediately notify the Engineer of any conflicts.
5. Erosion Control shall be constructed, as applicable, as sequenced below:
A. Silt Fence.
B. Rock Construction Entrance.
C. Demolition
D. Common excavation (grading).
E. Seed and mulch or sod (See notes on Landscape plan).
6. Final Plat shall govern for easements and lot dimensions.
7. Any erosion control items necessary to protect adjacent properties shall
be constructed by the Grading Contractor.
8. Erosion control maintenance shall be performed by the Grading
Contractor, and removed as per the Contract Documents or as
directed by the Engineer, followed by all necessary restoration of
disturbed area. This work shall be incidental to the grading contract.
9. The Grading Contractor shall schedule the soils engineer to facilitate
certification of all controlled fills in a timely fashion. Density tests
shall meet the following:
A. Within the upper 3' of streets, the Grading Contractor shall
utilize approved soils that are within 1 % of the optimum
moisture content as defined by the Standard Proctor Test-ASTM:
D-698 with compaction meeting 100% Standard Proctor Density
and not exceeding this compaction by more than 1 %. Below
the upper 3', compaction shall meet 95% Standard Proctor
Density, and be within 3% of the optimum moisture content.
Grading tolerances shall be 0.1'.
B. Grading tolerances for the remainder of the site shall be 0.25'.

10. All areas of unsuitable soils found in the pad described above that
cannot be corrected shall be located in the field by the Grading
Contractor. The Grading Contractor shall immediately notify the
Engineer of these areas and provide information as to their size and
location.
11. The Grading contractor shall provide positive drainage on the site at
all times.
12. The Grading Contractor shall keep public streets and travel ways clear
of soil and debris. Daily cleaning at the construction entrance shall be
performed, especially at the end of each day's work.
13. All silt fence shall be removed at project completion.
14. All proposed elevations are at curb flow line or finished bituminous
surface unless otherwise noted.

EROSION CONTROL INSTALLATION SCHEDULE
1. Silt fence shall be installed or restored prior to any construction. Silt fence
shall be located as shown to intercept runoff. The area located beyond the
perimeter silt fence shall not be disturbed during construction.
2. Rock Construction Entrance shall be installed prior to grading operations.
3. All storm sewer inlets shall have inlet protection inserts installed. Inserts shall
be "Road rain -Top Slab" or "Road Drain -Curb & Gutter" inlet protection devices
as manufactured by WIMCO (or approved equal) and installed per manufacture's
recommendations.
4. All erosion control installations shall remain in place and be maintained in good
condition by the contractor until the site has been re -vegetated, at which time
it shall be removed by the contractor. For proposed paved surface areas, the
contractor may remove necessary silt fencing to construct roadway, while
maintaining adequate erosion control in adjacent areas.
5. Sufficient topsoil shall be stockpiled to allow for the replacement of 6" topsoil
for disturbed areas to be re -vegetated.
6. The contractor shall schedule site grading, utility installation and roadway
construction so that the general site can be mulched and re -seeded soon after
disturbance. Areas that will not be subject to construction traffic for 7 days
shall be seeded and mulched or sodded within 7 days of final grading.
SWPPP AMENDMENTS
1. One of the individuals described in Responsible Party information must complete
all SWPPP changes. Changes involving the use of a less stringent BMP must
include a justification describing how the replacement BMP is effective for the
site characteristics.
2. NPDES permittees must amend the SWPPP to include additional or modified
BMP's as necessary to correct problems identified or address situations
whenever there is a change in design, construction, operation, maintenance,
weather or seasonal conditions having a significant effect on the discharge of
pollutants to surface waters or groundwater.
3. NPDES permittees must amend the SWPPP to include additional or modified
BMP's as necessary to correct problems identified or address situations
whenever inspections or investigations by the site owner or operator, USEPA or
MPCA officials indicate the SWPPP is not effective in eliminating or significantly
minimizing the discharge of pollutants to surface waters or groundwater or the
discharges are causing water quality exceedances or the SWPPP is not
consistent with the objectives of a USEPA approved TMDL.
INFILTRATION BASIN NOTES
1. Iniltration area shall be staked off during construction to restrict heavy equipment
traffic from compacting native soils.
2. Install appropriate temporary erosion control devices to prevent sediment from

earth-movingequipment to prevent compaction of the underlying soils. Small

What are the power needs and what structures will be serviced?
Engineering
ADA ped ramps are needed across entrance.
Stormwater requirements of city ordinance and NPDES permit must be met, which are under
review. A private maintenance agreement is required to be submitted to the city for review and
approval.
Water Department
A water service connection was not included in the documents. The City of Elk River design
standards for water service installation will need to be followed.
Fire hydrants may need to be installed. Hydrants shall be spaced so that all portions of the
buildings to be protected are within a 250-foot radius of a hydrant. Final review will be made by
the Fire Chief and City Engineer.
