Background/Discussion
Case No. OA 22-04 - Staff receives numerous calls from propert�- owners that have 1+ acres of land within the
Urban Service District (USD) inquiring ho�v much garage/shed space theyT can have and often are frustrated `vhen
they Yealize the size limit applies to all pYopeYties less than 5 acYes.
A one-acre paYcel is allowed 1,200 sf. but if that paYcel were to be subdivided into three parcels (B-1 c allo2��s 19,000
sg. ft. lots� the allowed square footage foY the same aYea would then be 3,600 sf.
The Planning Commission recommends allowing 1+ acre parcels in the R-lb, R-lc, and R-ld zones to follow the
one-acre limitation in the R1-a district, `vhich `vould be 2,500 sf.
Additionally, the table in Section 30-793 (c) should be removed as any remaining larger lots in the USD mayT be
subdivided. This prevents, for example, a 10-acYe parcel building a 4,500-sf shop and then lateY subdividing the 10-
acYes into 11,000 — 14,000 sf. parcels with one of them containing what would then be an out of scale, to the
development, legal non-conforming structure.
Also, there are residents living within the USD that have 1+ acres and drive a tractor trailer for a living. The
ordinance limits tractor trailer parking in the R-1a district on parcels greater than five acres or with a CUP on lots
less than five acYes. FuYther, the oYdinance does not allow the paYking of a truck tractoY and/oY trailer, in excess of
7,000 pounds gross `veight, on public propertyT (right-of-`vayT) within an area zoned residentiaL The on1�T option for
these Yesidents is to paYk their tractoY traileY in an accessory structuYe ��hich needs appro�mately 800-1,000 sf.
Staff and the Commission also recommend some "housekeeping" amendments. The Planning Commission
unanimously recommended approval of the ordinance amendment.

of Elk River, Minnesota, City Code
The City Council of the CityT of Elk River does herebyT ordain as follows:
SECTION 1. That � Section 30-793, AccessoryT buildings of the CityT of Elk River Code of
Ordinances shall be amended to read as follo�vs:
a Ti1ne of constTz�ction. No accessory building or structure shall be constructed on any Yesidential
lot prior to the time of construction of the principal building to which it is accessor�T.

adjacent lot.
v. The structure shall be removed if the parcel is subdivided into lots smaller than five
acres in area.
With the exception of the A-1 district, galvanized coYYugated panels shall not be allowed. Metal
panels shall be allowed as a Yoofing material on any accessoryr structure.

{�r} � TempoYaryr tent structures of any size will be allowed for, but not limited to, family
gatherings, `veddings and special occasions/events. TemporaryT accessoryT structures shall not
be erected for more than four consecutive dayTs and shall not be erected again for a period of
three days thereafter. TemporaryT tent structures shall comply with the required minimum
setbacks and shall be anchored to the ground in compliance with all applicable building
codes. For events requiring more than four day s, a general planning permit shall be required.
{�} 1( i) In all single-familyr Yesidential zoning districts, a minimum 20-foot X 22-foot single
garage shall be constructed with a minimum of 440 square feet in area.
