NW Conditional Use Permit for outdoor storage, Case No. CU 22-10 — continued from May 24, 2022 Action Requested Recommend, by motion, approval of the Conditional Use Permit with the following conditions to satisfy the standards set forth in Section 30-654: 1. The property shall comply with Section 30-807. 2. A 6-foot tall, 100% opaque fence shall be installed in the location as shown on the site plan dated July 18, 2022. 3. The fence shall be installed by September 1, 2022. 4. The parking lot shall be striped by September 1, 2022 5. All outdoor storage must occur in the fenced in area or within the two temporary structures. 6. No product can be stored behind the building, on top of the two temporary structures, or higher than the top of the fence. 7. The temporary structure located in the northwest corner shall be relocated next to the other temporary storage structure by September 1, 2022. 8. The two temporary outdoor storage structures shall be removed from the property two years after City Council approval of the CUP (July 18, 2024). 9. An amendment to this Conditional Use Permit will be required for any changes to the site plan dated July 18, 2022. Background/Discussion Elk River Winlectric has been part of the city since 1995 and are a wholesale provider of electrical equipment. Due to supply chain issues and delays in recent years, they have been forced to order much more inventory than they typically have needed to in the past. The need for the extra inventory is to ensure they have adequate supplies for their contractors. As a result, they have needed to utilize their property for storage as their building is at compacity. P I I E I 1 0 IY NATURE Updated. August 2020 The property is zoned I1-Light Industrial where Outdoor Storage requires a Conditional Use Permit (CUP). As a result of a complaint regarding the products stored outside, the applicant has applied for a CUP for outdoor storage. The applicant is proposing to utilize the parking lot on the west side of the property for the outdoor storage and fencing it on three sides. This would displace 10 parking stalls, but they can be relocated to the east side of the property. Staff recommends the area be fenced on all sides to meet the requirements in Section 30-807. The applicant has been utilizing two temporary structures for storage. One is in the northwest corner of the site and the other in the northeast corner. The applicant has requested to continue to use these in the interim. Staff recommends the two temporary outdoor storage structures be removed from the property two years after city council approval of the CUP. Staff also recommends the one located in the northwest corner be relocated next to the other temporary storage structure. Applicable Regulations In approving a Conditional Use Permit, the council may impose such specific conditions with regard to the development or operation of the proposed use as it considers necessary to satisfy the seven standards set forth in Section 30-654 and the requirements contained in this article and to promote compatibility with and minimize any potentially adverse effects upon adjacent properties, the neighborhood or the city. The issuance of a Conditional Use Permit can be ordered only if the use at the proposed location: 1. mill not endanger, injure or detrimentally affect the use and enjoyment of other property in the immediate vicinity or the public health, safety, morals, comfort, convenience orgeneral welfare of the neighborhood or the city. Over the past few years (covid) the supply chain has been a serious issue for all wholesales throughout the country. We have been forced to order more inventory of products, with the hope of getting them and thus creating more items being stored outside. We have now rented 3 garages to our neighbors (Kiser construction) to keep less outside. We have experienced theft of several items during the last 2 years, two trailers have been stolen and have yet to be found. We have kept the front of the building looking very green and maintained and try to distract away from the few overstocked items that are in our yard/parking lot. I have thought of several things to do over the past 5-6 years to best use our lot, but figured by building a fence or lean too would look worse. McChesney on our back side haven't had an issue with us or the other business of Kiser Construction. I attached a picture of a possible solution that could be somewhat easy and prevent us from cutting any trees down to expand, the outdoor boxes we have are only temporary until we get the supply chain back on track. Is it possible to get a temporary permit for the use of these and remove them eventually? Maybe we can do a cleanup/organization of outside items, all the items sitting outside are sold to our contractors, but do to delays in jobs because of supplies, we are forced to sit on them until job site is ready. I thought also of painting the conex box a solid color to make more acceptable. Outdoor storage. (a) Definitions. The definitions in section 30-1 are applicable in this section. (b) Purpose. It is the intent of this section to establish regulations which allow the outdoor storage materials within the city in a clean and safe manner. Outdoor storage areas must be approved by the city in accordance with the standards outlined in this chapter. (c) Standards. (1) Outdoor storage shall not exceed 50 percent of the parcel area. (2) Approved outdoor storage areas must be paved with an approved surface in accordance with section 30-900(a ). (3) Outdoor storage areas shall maintain the front yard setback established for the district where the use is located. The side and rear yard setback shall be ten feet. (4) Outdoor storage areas shall not be located in designated parking areas or areas striped for parking. (5) Outdoor storage areas shall be completely screened from view within all public rights -of -way and commercial or residentially zoned parcels. This requirement shall include gates constructed of the same screening material that can be closed when not in use. a. Screening must provide a visual barrier. Any such barrier shall reduce visibility in a manner that restricts vision of the object being screened, but is not required to totally block the vision of any such object. b. Screening shall consist of one of the two following methods. 1. A screening fence of at least six feet and constructed of one or more of the following materials: (i) Wood; (i i) Factory finished metal or vinyl panels; (iii) Chain link with vinyl slats. The slats must be maintained at all times and must be replaced within 30 days at the request of the city. 2. An earthen berm of at least three feet in height with a mixed hedge of evergreen and deciduous plant materials. (i) Plant materials must include a variety of shrubs, ornamental trees, and overstory/evergreen trees. Shrubs must be at least three feet tall at the time of installation and the plan must be approved by city staff.
